Court is now on lunch until 1:55pm. Justice Heeney will continue with his jury instructions then

I'll repost the tweet and then I'm off this topic because we're obviously not interpreting the tweets the same way. The key words "recapping" and "stream of ex girlfriends".

Linda Nguyen ‏ @LindaNguyenPN
Court is on another 15 min break. Judge has just finished recapping stream of ex-girlfriends who came to testify against #Rafferty in trial

I think all that means is the judge is recapping, and mentioned the "stream of ex-girlfriends". He didn't actually "recap" them all. If he did, he'd still be talking about them.

giantalkinghead,

I agree that TLM may qualify for a DOA. If she keeps going the way she has she will commit more crimes/assaults etc. in jail and be declared a dangerous offender.

MR, he'll probably have all kinds of women on the outside writing to him and sending him money.

gosh... thank you to those who have been posting the tweets..... my brain is numb and I am not even in the courtroom!

I'm glad I'm not the only one.

And yes, thanks everyone for the tweets!

Another example. Why is it necessary for the judge to recap how Rafferty and McCLintic met? That's all in testimony.

Is he giving his closing arguments or what? This is weird.

I think as much as he is giving instruction, he may also be reminding the jury of the evidence that was put forth to match the instruction. The jury has been sitting since March 5, right? They took notes - but there must still be some gaps between the notes and their individul memories. So I'm thinking (and obviously I don't know, just my thoughts) that the judge is trying to link particular segments of evidence to specific instructions.

it would not surprise me that after sex with Tori he had sex with TLM. MOO

They had her DNA and since she was at the crime scene, I'm sure they would have said MRs mixed with Toris and TLM's, they said MR's for sure, Tori's 1 in a 50 something billion and another one which they didn't specify...I just find it bizarre that they mentionned three people and only named two and one of them was not TLM

I know I did some digging on the internet a few weeks back on this subject. I posted some links in one of the past threads, but I have no idea which one. LOL

From what I recall, a dangerous offender designation has to be done within 6 months of the sentencing. Only 2 or 3 women have been designated as such in Canada. One has since died, and another had the designation revoked and was freed (!!). I don't think TLM will be designated a dangerous offender, but I am not a lawyer and, like you say, who knows what other trouble she will get into in the future.

You can't just appeal because you didn't like the outcome. There has to be legal errors made in the original trial before the Supreme Court will even consider it. I don't think there has been any legal errors made and I don't think the Supreme Court will think so either. But everyone tries. What do they have to lose?

MOO

... I'm pretty sure the first stop is the Ontario court of Appeal before the Supreme Court

I'm happy this judge is going over all of it with a fine tooth comb because the chances of the defense being granted another trial, especially since someone here posted that Heeney said since the defense only opted for one witness, I doubt it will be granted...dot your i's cover your t's, I don't want him out if found guilty IMO

I'm glad he is doing it carefully too, since a mistake in the judge's charge to the jury is grounds for appeal.

Sadly KMouse... you may be right about the women. Though I'm not completely convinced that the one girl - CS - I think were her initials... were telling the whole truth and nothing but the truth ... LOL... I think she might have been covering her a$$ ... errrrr .... bank deposits.... but, I think it was more likely she was selling drugs with MR - than she was selling her other a$$ets so to speak....

As for TLM.... why on earth would she want to get out of jail ??? I mean think about it ???

I'm still wondering about MTR's reactions in the court room. I wished I knew something about psychology. I don't understand why he started all his mumbling and rolling eyes during the closing argument. Why not during the testimony? Why showing any kind of reactions when the trial is in the wrapping up process? Everything he did hear there was nothing different than weeks earlier during the beginning of the trial... ?? So why starting when it is way too late??

She's up on more charges of assault right now.... God know what she'll do during her next 20+ years !!

How the heck did that happen? She clearly kidnapped TS???

I never really thought of it. That is a very good question. Why is she not charged with kidnapping too?

Derstine was asked if he's worried about 9 women on jury, he said, for what its worth, that statistically women acquit more than men

  • #298
actually I tend to think that the closing argument was much more in his face.. like all of it all together: the totality of the evidence (and tended to shine a light on the lack of a defense that his lawyer put up for him imhoo)

as for all the facial pulls he was exhibiting.. well... I watched Casey Anthony do it for months! I don't think it is that odd.... but I do think it is very disturbing (my opinion of course)

Not showing emotions could show disregard, showing emotion disrespect. Lets face it no matter what he is being judge ... oh thats right he is on trial
