#Rafferty is in court watching the McClintic's video statement on a monitor that sits before him.

Rafferty ever so slightly shakes his head as he watched the May 24th, 2009 video statement from McClintic.

McClintic is crying throughout the video.

McClintic now describing Tori on the ground curled up in the fetal position.Smyth asks if she is alive.McClintic says she is breathing

Going to warn you that McClintic's video statement will get graphic as she describes the little girls death

In video McClintic says “I see Tori on the ground…I knew she wasn’t’ ok "

In this portion of the video, there is a box of tissue on the table.McClintic leans her head into her right hand as she talks

Smyth now takes the tissue box and says .."lets say this is the car where is she (Tori) now..."

Smyth brought McClintic an ash tray. She is now smoking.

rafferty sitting low in his chair as he watches McClintics statement implicating him. He usually sits straight up

rafferty puts on glasses while sitting alone in his prisoners box.

McClintic says she's willing to tell Smyth where Tori's body is hidden. Trying to describe the area to him.

McClintic is drawing on paper, calmer now, not crying anymore, talking to officer

Rafferty appears passive as he watches the video, squinting as he leans back in the prisoner's box.

Det.-Sgt. Jim Smyth leaves McClintic in the room. She puts her head down on the desk. Smyth returns and McClintic lights up a cigarette and begins smoking as the officer resumes asking her questions. The audio is nearly impossible to understand, however, so there is little I can report.

In the video, McClintic says Rafferty hit Tori with a hammer. The two then placed the body on the edge of the rock pile. Smyth uses a tissue box so McClintic can identify where the body was moved to.
