Showing Rafferty's phone records from April 8th, 2009. They exchanged text messages between midnight and 12:30.

He sent her a text at 9:36 that morning, as well as 12:23' and 12:46 pm. They were about getting together the next day.

Rafferty sent her a text at 10:39 pm, then others later in the evening

She was on her way home from school on Easter weekend. She stopped in at his house on April 8th. Around 10 am.

I really don't like this judge. It's not up to him to decide what the jury thinks, imo!!

LOL ... no worries nt. His Honour just nicely coined a phrase that will stick in the jurors minds (not that they hadn't already formed their own opinion of him). Judge not stupid

They may not consider character flaws as a reason to convict Rafferty.

It's more than character flaw, imo!! It has everything to do with this trial and goes towards motive!!

RaffertyLFP: Next time saw Rafferty on April 26 to get CD from him.

They went for a drive, got some food, watched TV and had sex. She left at 3 or 4 pm.

She saw him again on April 26th. She sent him a letter and CD, and picked those things up. She never saw him again.

RaffertyLFP: Derstine refers her to police statement where she said it might have been the 9th or 10th.

RaffertyLFP: Jury being dismissed.

She says they had sex on April 9th, in her police interview in February, she couldn't remember when they had sex. April 9th or 10th.

She says it was either the 9th or tenth on Cross examination from Derstine.

On reexamination Gowdey asked about the date again. Derstine objected. Jury excused.

It is his responsibility to let the jury know what they can and cannot use as evidence to convict or acquit.

Her testimony WAS evidence! The best one to date. Why didn't he bring this up when the other 10 testified?

Does anyone have a legal reference for not considering the character of the accused at trial? This is absolutely baffling to me. Seriously. I am dumbfounded at that.
