8/17/21 Update: Marks made his request to represent himself in June. Judge Steve Duskie ordered that Marks meet with different counsel & then determine if he wished to proceed with his plans. Duskie ultimately granted Marks’ request on August 17.
8/4/21 Update: Hearing on 10/26/21. 10/26/21 Update: Marks will stand trial on 4/4/22, 426th District Court Judge Steve Duskie ruled Tuesday. Marks will represent himself on the capital murder charges.

4/1/22 Friday, Trial Day 14: On Friday, jurors heard a government prosecutor describe the defendants as "filled with rage" & bent on sparking a civil war, followed by defense attorneys who accused the FBI of entrapping their clients, who they said were often high on drugs & prone to "crazy" talk rather than concrete action. The 12-person jury was presented with dueling narratives during closing arguments that concluded late on Friday afternoon. Granted the option by U.S. District Judge Robert Jonker, jurors chose to start discussing the case on Monday. Jurors briefly began deliberations on Friday afternoon & were scheduled to resume those discussions on Monday, 4/4/22.

San Mateo County Sheriff’s office forensic labs created a DNA profile used CODIS & was tentatively linked to Bacom.
Trial began on 2/28/22 but continued to 3/14/22 & ended 3/15/22 with a guilty verdict.

3/15/22 Tuesday, Trial Day 3: On Tuesday afternoon, after a half-day of deliberations, a Contra Costa jury found Bacom guilty of murdering 14-year-old Suzanne. Bacom now faces a sentence of life without the possibility of parole; sentencing hearing on 4/6/22.

4/8/22 Friday, Trial Day 19/Jury Deliberations Day 5: Deliberations resumed Friday with a court employee handing over a large plastic bag known as exhibit 291. The pennies were requested before jurors went home Thursday. Jurors say they've reached decisions on some charges & are deadlocked on others. Chief U.S. District Judge Robert Jonker announced the development just before 11am Friday & encouraged jurors to keep deliberating in hopes of reaching a unanimous verdict. Judge Robert Jonker acknowledged the struggle but told the panel to keep working during lunch on the fifth day of deliberations. (8:30am to 11am/11:30am to 2pm - ~5 hours).
Around 2 pm, the jury reemerged before Judge Jonker to indicate they remained at an impasse. Jonker instructed them to return to the jury room to confirm the impasse & fill out forms to indicate what charges they were in agreement on if so. They returned minutes later to reveal their verdicts.
A jury in the trial against four men charged with plotting to kidnap Michigan Gov. Gretchen Whitmer has returned a mixed verdict. The jury found Daniel Harris & Brandon Caserta not guilty on all charges & were unable to reach a verdict in the charges against Adam Fox & Barry Croft, resulting in a mistrial. The verdict was read in federal court on Friday afternoon. Fox & Croft will return to jail for the time being. Harris & Caserta are being freed right now. Andrew Birge, U.S. attorney for the Western District of Michigan, vowed to retry the accused ringleaders, Fox & Croft.

*Ty Gerard Garbin (24) - plead guilty (1/27/21) to kidnapping conspiracy & was sentenced (8/25/21) to 6 years & 3 months in Federal prison. Garbin will testify at the trial of the other defendants. Lengthy testimony & repeated debriefings have been critical in building a case to counter defense arguments that revolve around free speech issues as well as accusations of entrapment by federal undercover informants, Nils R. Kessler, the lead U.S. attorney on the case.
Kaleb James Franks (26) – Plead guilty (2/7/22) to kidnapping conspiracy. Will testify at trial & will be sentencing afterwards.

2/28/22 Update: Haobsh was originally scheduled to be sentenced on 1/24/22 but that was postponed after he requested his trial counsel be replaced. The request was denied & sentencing set for 2/28/22 but the Santa Barbara County District Attorney’s Office on Monday says Haobsh is now due back in court 3/8/22 for a hearing on whether the defendant can represent himself (Farreta Motion). Sentencing is now scheduled for 3/28/22 at 1:30pm. If it does in fact take place that day, it is expected he will be sentenced to a maximum of three consecutive life sentences without the possibility of parole. A Faretta motion is a petition that criminal defendants file with the court seeking permission to represent themselves, that is act as their own attorney, in a criminal proceeding. This is commonly referred to as going “pro per.”
3/8/22 Update: Appointment of expert. Next hearing on 3/21/22. 3/21/22 Update: Haobsh was granted a request to represent himself after applying to drop his legal counsel in February. Haobsh was transported from Santa Barbara’s Main Jail to appear in Judge Brian Hill’s Dept. 2 courtroom Tuesday, 3/21/22. When Haobsh requested the court provide him with access to a laptop & two private investigators, the Judge reiterated that he would not be granted any extra time or provisions. “You’re not going to get any special treatment from the court,” Judge Brian Hill said. The only courtesy Hill provided Haobsh was one final continuance for sentencing. Haobsh was scheduled to appear on March 28, but with the new developments, Hill granted him an extra four weeks to file any motions he needed to. “We’re not gonna continue it again — I’ll make that clear,” Hill said. Haobsh spoke only a few times, seeming to have plans to reintroduce new evidence. Like his fanciful testimony, he said that there was “discovery evidence” of text messages that would show involvement with “government agents” & clear his name. Judge Hill said Haobsh would have to provide an account of what the evidence would show, but sentencing would likely proceed as planned. Haobsh faces three life sentences at his next court date on 4/15/22.

Jury sent off to deliberate ~12:30pm ET. 5:38pm Correspondence from jury - deadlocked at this point. Bringing jury back in. 5:42pm Judge asked jury foreperson if they were decided on any of the counts. Upon an affirmative answer, the judge requested that they go back & fill out the paperwork for each count that had been decided on. Jury back in jury room. 5:49pm After sidebar, judge stated that he would reiterate to the jury that the verdict is not final until it is published in court. The judge asks the jury to continue deliberating. He tells them if they can't reach a verdict, they need to let him know & he will declare a mistrial. 6:48pm Jury has reached a verdict. He is found guilty on all four charges of first-degree murder, as well as the animal cruelty charge. Judge Carsten says they will take a quick recess & go into sentencing. The only punishment is life in prison. 7:09pm Court in order, victim statements first. Judge Carsten sentences Todt to four consecutive life sentences without the possibility of parole. He calls him "a destroyer of worlds." "You destroyed the world of your 4-year-old daughter," he says. "... The jury has unanimously determined you murdered each of them with premeditation." He has 30 days to appeal verdict in writing.

4/4/22 Monday, Trial Day 4: Closing arguments by prosecutors & defense. Jury deliberations started about noon. After deliberating for 5 hours Monday, the jury found her guilty of murder & not guilty of aggravated murder. The jury's verdict in this case, by saying it was only a purposeful killing & rejecting the aggravated murder, the jury said that she did not have the plan ahead of time to kill the child. The judge revoked her bond & she was arrested at the conclusion of the trial. PSI ordered & remanded to GCSC pending sentencing. A sentencing date has not been set yet. 4/7/22: Jury list filed. Commitment pending sentencing returned & filed.

4/15/22 Update: Haobsh was sentenced Friday to three consecutive counts of life in prison without the possibility of parole, followed by 75 years to life in prison. Haobsh appeared in Santa Barbara County Superior Court, representing himself for sentencing.It was delayed multiple times as Haobsh requested new attorneys after the guilty trial verdict & when he was denied, decided to represent himself. Judge Brian Hill sentenced Haobsh to life in prison without parole for each murder, as well as 25 years to life in prison for special allegations that the killings were willful, premeditated & deliberate; committed by means of lying in wait; and committed for financial gain. The court also ordered Haobsh to pay $22,500 to the California Victim Compensation Board, along with other fines & fees. In addition to the sentencing, Hill addressed motions that Haobsh had filed seeking a new trial & a petition for writ of habeas corpus. Haobsh said part of his reasoning for wanting a new trial, as well as his decision to represent himself, was due to “ineffective assistance of counsel.” During the trial, Haobsh was represented by deputy public defenders Christine Voss & Michael Hanley. Judge Hill ultimately denied both the motions, although Haobsh can re-file the motions in appellate court.

As the trial needs a continuance twice, the judge says the ruling was made in order to summon more jurors & make sure Clements is afforded due process. Monday's ruling was also made with concern for Clements' safety. The judge also noted her decision to have no cameras in the courtroom was made to help accommodate the limited space in the courtroom due to COVID-19 protocols. Each victim's case is being tried separately. Next status conference hearings on 4/11/22.

The judge & Mawhinney’s attorney noted he’s been compliant with the terms of his release since he posted bond in October 2020.

2/3/22 Update: Mawhinney appeared Thursday in State Superior Court in Hartford since a judge ordered Hartford State’s Attorney Sharmese Walcott to provide detailed responses to the evidence the prosecution has gathered in the domestic cases. Another prosecutor stood in for Walcott during the brief proceedings on Thursday. Judge Hope Seeley told the court she expected the case to go in a particular direction Thursday. Instead, she called for a short continuance until 2/23/22 so she could receive “the further information the court has asked for."
2/23/22 Update: Mawhinney plead guilty on Wednesday to a charge of violating a protective order that stemmed from an incident involving his ex-wife. Mawhinney entered his plea under the Alford Doctrine, which means he does not admit guilt but agrees that there is sufficient evidence to potentially be convicted. Under an agreement with prosecutors, Mawhinney would receive a suspended five-year prison sentence & three years of probation. Mawhinney is scheduled to be sentenced on 4/20/22 & review hearing on assault charge.

4/11/22 Update: The prosecution filed a motion on Monday that asks the judge to reconsider his order in regard to experts Duge, Hicks, Hoyland & Stevens. The motion reads, "These experts & their testimony are critical to the People's case." In the motion, prosecutors say their case "relies heavily on evidence of Morphew's motive to harm his wife, the opportunity he alone had as he was the last person to see Suzanne alive, the inconsistencies in his statements to law enforcement & the ultimate cover up he perpetrated the day after & in the following months." The defense team's response to the court states, "The facts in this case are insufficient to reach a murder conviction & the stricken experts do nothing more than bolster uncorroborated theories & hunches the prosecution would like the jury to adopt in what would be a specious & wrongful conviction." Pretrial readiness conference hearing on 4/19/22.
4/19/22 Update: After months of uncertainty, unexplained DNA, the dismissal of most of 16 expert witness, two judges & a change of venue, DA Linda Stanley filed a motion to dismiss with prejudice the murder case against Morphew Tuesday morning just 15 minutes before the motion started. Excerpts from motion: "A dismissal without prejudice, or nolle prosequi, is a formal declaration of record by the prosecutor that the government will not prosecute the current case further. It is a discharge without an acquittal and is not a bar to a subsequent prosecution for the same crimes. A nolle prosequi order is not the final disposition of a criminal case, but leaves the matter in the same condition as before the charges were filed." "As an offer of proof, the People and law enforcement believe we are close to discovering the victim’s body. The People were hopeful that the search for, and the discovery of, the victim’s body would be concluded well before trial, but weather has complicated the efforts. Specifically, the area law enforcement has been focused on is in a remote and mountainous region nearby the Morphew residence. This area received a significant amount of snow over the winter months before a search could be completed. To date, the area has 5 feet of snow concealing the location where the People believe Ms. Morphew is located. As a result, the People cannot safely excavate this area and resolve this unanswered question." "Given the timing of this motion before trial, the Defense does not need to consent, and does not have standing to object. Morphew's defense attorney, Iris Eytan, argued in court that the case should be dismissed with prejudice, meaning it could not be refiled. She said DA was acting in bad faith to avoid sanctions over discovery violations. Judge did not go for that. The judge is reviewing. The judge has dismissed Morphew ‘s murder case against his wife Suzanne. Defense says the motion states prosecution says they possibly found a body, but too snowed in to search. Prosecution has a chance to refile, if they want.
