For the week of Tuesday, August 1st thru Friday, August 4th:

Tuesday, August 1st:
*Plea Hearing (@ 8:30am CT) – TX – Michael Lee Swearingin (32) & Jenna Kay Scott (28) (Jan. 4, 2019, Temple; found in Clearview, OK 1/9/19) – *Maya Renee Maxwell (26/now 29) (Mark’s GF) arrested (1/11/19) & extradited from MI to TX (1/16/19), charged (1/16/19), indicted (4/3/19) & arraigned (4/26/19) with capital murder of multiple persons & 3rd degree tampering or fabricating physical evidence. $750K bond. Bond reduction denied (8/18/20).
Maxwell admitted in an arrest affidavit she took Swearingin’s car and drove it to Austin to hide it, was in the house with Marks when he reportedly killed Swearingin and Scott, drove with him to Oklahoma and was there when the bodies were buried.
Trial was set to begin on 11/15/21 continued no further dates. Maxwell is accepting a plea deal to serve 20 years for two counts of tampering with evidence with chance of parole for testifying at Marks' trial. And capital murder charge is dismissed.

3/31/23 Update: Next pretrial hearing on 5/19/23 @ 8:30am. Maxwell is accepting a plea deal to serve 20 years for two counts of tampering with evidence with chance of parole for testifying at Marks' trial. 5/19/23 Update: Next pretrial hearing on 7/7/23 @ 8:30am.
7/7/23 Update: Plea hearing on 7/11/23. 7/11/23 Update: The hearing for Maxwell was set for early this morning, but it is now rescheduled for 8/1/23. According to Maxwell’s defense attorney Kyle Watkins, “the basis of their motion was that Mr. Garza was not in town & he wanted to be here.” The decision of the court was to grant continuance for the plea deal, but the judge emphasized the need to ensure a date was set quickly to avoid further delay. Maxwell has an agreement with the state to plead guilty to tampering two counts of tampering with a corpse, which is punishable by 2 to 20 years in exchange for the dismissal of the capital murder charge & we were set for a plea today” says Watkins. She has already served over 4 years in jail, making her eligible to be considered for parole.
*Cedric Joseph Marks – Trial began on 4/17/23 & ended 6/9/23 with a guilty verdict of all charges & sentenced to death.
*Ginell Marie McDonough – 1/31/20: Plead guilty. Sentencing was on 11/19/20: charges dismissed testified against Marks.



Thursday, August 3rd:
*Sentencing Hearing (@ 3pm CT) – MO – Goodknight Berretta June Ribando (7 wks old) & Ireland Autumn Jane Ribando (2) (July 4, 2018, Kearney) – *Jenna Boedecker Ribando (29/now 33) “mom” arrested (7/4/18) for a prior incident (7/3/18) & placed on 24-hour hold; was formally charged (7/6/18) & indicted (8/8/18) with 3rd degree domestic assault, armed criminal action & 1st degree property damage. Charges stem from an argument w/husband re his infidelity on night of 7/3. Plead not guilty. $75K reduced (7/31/18) to $25K cash or Surety only bond, & then changed (8/16/18) to $200K.
*Recharged (1/29/19) with 2 counts of 2nd degree murder, 4 counts of 1st degree endangering the welfare of a child creating substantial risk, 3rd degree domestic assault, 1st degree armed criminal action & 1st degree property damage. $500K bond. Bond reduced (10/3/19) to $50K Cash or Surety. Posted 10%. Upon written motion by defendant, defendant's bond is modified as follows (6/25/20): Radius of GPS monitoring increased to 50 miles & curfew changed to 9:00pm to 6:00am. Bond modified to allow Ribando to travel to Colorado & Missouri (5/10/21). Bond changed (5/22/23) to $5M Cash or Surety after guilty verdict & taken into custody.
Trial began on 5/15/23 & ended on 5/19/23 after about 2 ½ hours of deliberations came back with a guilty verdict on 2 counts of 2nd degree murder, 4 counts of child endangerment, 1 count of 4th degree domestic assault & 1 count of 2nd degree property damage. Jurors did not convict Boedecker of 1 count of armed criminal action related to the case.

Count 6: 1 ½ half years. Count 7: 6 months. Count 9: 3 months. Jury discharged. MFNT due no later than 6/16/23. SAR Ordered. If MFNT denied, Court will immediately proceed to Sentencing. Oral motion for Bond Modification by Plaintiff-Granted. Bond now set at $5M cash or surety. Sent Assessment Report Ordered. Motion for Acquittal. Exhibit filed. State's Witness List & exhibits. Questions to Judge from Jury. Jury Instructions filed. The jury recommended 22 years on each of the 2nd degree murder convictions & a total of nine years for the endangering the welfare of a child convictions. *Sentencing Hearing (@ am PT) – CA - Jackson Telnas (12) & Jacob Ray, Jr. (7) (Jackson drowned, June 29, 2019, Porterville; Jacob was in critical condition, but died July 7, 2019) - *Sherri Renee Telnas (45/now 49) arrested & charged (6/29/19) & arraigned (7/2/19) & re arraigned (4/26/21) with 2 counts of homicide, 1 count of gassing & 1 count resisting arrest. Plead not guilty. Held without bond. DA will seek DP.
Trial was set to begin on 10/16/23 but began on 6/23/23.

Friday, August 4th:
*Sentencing Hearing (father only) (@ am MT) - Canada- *6 week old baby girl brutal assault & SA, Jan. 18, 2023, Lathbridge, Alberta - *Man (52) arrested & charged (1/20/23) with aggravated assault, sexual assault, sexual interference & failing to provide the necessaries of life. Calgary Court, Alberta
*Woman (31) arrested & charged (1/20/23) with failing to provide the necessaries of life. Plead guilty on 6/17/23.
6/17/23 Update: According to an agreed statement of facts released in court on Friday, police were called to the home the mother shared with the child's father & a roommate in Lethbridge on Jan. 18 after the roommate reported suspicions of abuse. When officers arrived, they found a six-week-old girl in medical distress. The child was having trouble breathing & her hand was twitching. The agreed statement of facts says that the father had abused the child, slapping her face, throwing her on the bed & shoving a bottle down her throat. The child's father was also in court. His name has also been withheld to protect the identity of the child. He is charged with aggravated assault, sexual assault, sexual interference & failing to provide the necessaries of life. A resolution may be reached at his next court appearance on 6/23/23. John Oman, the lawyer for the woman, entered plea of guilty in court on Friday. Sentencing hearing on 8/18/23.
6/23/23 Update: The Lethbridge father has plead guilty in a horrific case of abuse that left a six-week-old girl hospitalized with traumatic injuries. The father, who cannot be named to protect the identity of the child, plead guilty to aggravated assault & failing to provide the necessaries of life during a Friday court appearance. In addition, the Crown has withdrawn charges of sexual assault & sexual interference laid against the father, stating there was no evidence of injuries consistent with a sexual assault. If not for the guilty plea, which is considered a sign of remorse, the father could have faced, after a trial, 10-12 years in a federal penitentiary, Crown Prosecutor Suzanne Kendall told the judge. “By taking into account the early guilty plea & (the father’s) expression of remorse & his background, that was how we came to a sentence today of seven years incarceration,” Kendall said. After the agreed statement of facts was shared, Judge Kristin Ailsby gave the father a chance to speak on the matter. He told court "I hope my daughter develops as normal as possible & has a safe, happy & healthy life." The defense says the father is remorseful for his actions & has wanted to resolve the matter since April. The father is set to be sentenced on 8/4/23.

*Probation/Sentencing Hearing (@ 8:30am PT) - CA - Kris Anderson (57) (June 11, 2016, Santa Monica, stabbed in the head) - *Theo Andrew Krah (28 @ time of crime/31/now 36, Navy SEAL) indicted & arrested (6/13/16) & arraigned & charged (10/21/16) with 1st degree murder. Plead not guilty. $2M bond.
Trial began on 6/15/22 & restarted on 6/21 thru 6/30/22 (Day 1-8), 7/5 thru 7/8/22 (Day 9-12) & Jury deliberations Day 1-2 (7/7-7/8/22).
Jurors reached a verdict (7/8/22) guilty on 2nd degree murder. Sentencing hearing on 8/1/22 reset on 9/9/22 & reset to 12/9/22 & reset to 2/17/23 & reset to 6/2/23 & reset to 8/4/23.

The baby was born alive & died due to asphyxia) - *Arya Singh (25 @ time of crime/29/now 30) arrested & charged (12/16/22) with 1st degree murder. (No action taken by DA on 1/13/23). Recharged & arraigned (1/13/23) with 2nd degree murder & abuse of a dead human body. Plead not guilty. Held without bond.

8/1/23 Update: 426th District Court Judge Steve Duskie sentenced Maxwell to 20 years in a Texas Dept. of Criminal Justice prison with credit for time served on two counts of tampering with a corpse, both third-degree felonies. Maxwell plead guilty to two lesser charges on Tuesday afternoon after accepting a plea bargain agreement with the Bell County District Attorney’s office with no right to appeal.

In Count IV, the Court sentences Defendant to Seven (7) years in the Missouri Dept. of Corrections to be served consecutive with Count I, II, & III. 8/4/23 Update: Man: Judge Kristin Ailsby handed down her sentence, saying the Crown & defence's joint submission was "fit and proper." He has been sentenced to seven years in prison. The 52-year-old father will serve his sentence at the Bowden Institution. He plead guilty to aggravated assault & failing to provide the necessaries of life. The Crown had withdrawn charges of sexual assault & sexual interference, stating there was no evidence of injuries consistent with a sexual assault.''
 
For the week of Monday, August 7th thru Friday, August 11th:

Monday, August 7th:
*Sentencing Hearing (State) (@ 9am CT) - MN – George Perry Floyd, Jr. (46) (May 25, 2020, Minneapolis, arrested for forgery & killed in police custody) – for *Tou Thao (34/now 37) was fired (5/26/20), arrested (6/3/20) & charged (6/4/20) with aiding & abetting 2nd degree murder-unintentional-while committing a felony & aiding & abetting 2nd degree manslaughter-culpable negligence creating unreasonable risk. Bond set at $1M for all or bond conditions @ $750K. Thao released (7/4/20) on $750K bond with conditions.
As of 10/7/22 Kueng is in custody at the Elkton, Ohio, federal prison & Thao remains at the federal medical center in Lexington.
Trial was set to begin on 10/24/22 with jury selection, but Kueng plead guilty on 10/24/22 to aiding & abetting 2nd degree manslaughter. Sentenced on 12/9/22 to 3 ½ years in Federal prison. Thao requested a Bench Trial. Judge will have decision in 90 days after 11/17/22 when evidence is submitted.

5/1/23 Update: Thao will be in court Monday, 5/1/23 to learn his future.
5/1/23 Update: Judge Peter Cahill has ruled that former Minneapolis police officer Thao is GUILTY of aiding & abetting second-degree manslaughter in the killing of George Floyd. Sentencing is scheduled for Monday, 8/7/23 @ 9am at the Hennepin County Government Center in Minneapolis.
*Thomas Kiernan Lane (37/now 40) - plead guilty (5/18/22) to a State charge of aiding & abetting 2nd degree manslaughter. As part of Wednesday’s plea deal, Lane will have a count of aiding & abetting 2nd degree unintentional murder dismissed. Per plea will only serve 3 years in Federal prison currently with his federal sentence of violating Floyd’s civil rights. Sentenced on 9/21/22. Sentenced to 3 years in Federal prison.
*J. Alexander Kueng (26/now 29) - plead guilty (10/24/22) to a State charge of aiding & abetting 2nd degree manslaughter. As part of Friday’s plea deal, Kueng will have a count of aiding & abetting 2nd degree unintentional murder dismissed. Per plea will only serve 3 ½ years in Federal prison currently with his Federal sentence of violating Floyd’s civil rights. Sentenced on 12/9/22. Sentenced to 3 ½ years in Federal prison.
*Derek Michael Chauvin (44/now 47) - Found guilty of all charges. Sentenced on 6/24/21 to 22½ years in Federal prison currently with his Federal sentence of violating Floyd’s civil rights.


*Trial continues (Day 6) (@ 8:30am CT) – TX – Antonio & Dawn Armstrong (both 42) (July 29, 2016, Houston) – *Antonio “A.J.” Armstrong, Jr. (16 @ time of crime/17/now 23) arrested (7/29/16), charged (8/1/16) & arraigned (7/26/17) with capital murder. Plead not guilty. $200K bond. Out on bond 4/12/17.
First trial: after ~20 hours of deliberations verdict was 8 Guilty & 4 Not guilty. Judge declares mistrial.

*Sentencing Hearing (State) (@ 9am CT) - MN – George Perry Floyd, Jr. (46) (May 25, 2020, Minneapolis, arrested for forgery & killed in police custody) – for *Tou Thao (34/now 37) was fired (5/26/20), arrested (6/3/20) & charged (6/4/20) with aiding & abetting 2nd degree murder-unintentional-while committing a felony & aiding & abetting 2nd degree manslaughter-culpable negligence creating unreasonable risk. Bond set at $1M for all or bond conditions @ $750K. Thao released (7/4/20) on $750K bond with conditions.
As of 10/7/22 Kueng is in custody at the Elkton, Ohio, federal prison & Thao remains at the federal medical center in Lexington.
Trial was set to begin on 10/24/22 with jury selection, but Kueng plead guilty on 10/24/22 to aiding & abetting 2nd degree manslaughter. Sentenced on 12/9/22 to 3 ½ years in Federal prison. Thao requested a Bench Trial. Judge will have decision in 90 days after 11/17/22 when evidence is submitted.

5/1/23 Update: Judge Peter Cahill has ruled that former Minneapolis police officer Thao is GUILTY of aiding & abetting second-degree manslaughter in the killing of George Floyd. Sentencing is scheduled for Monday, 8/7/23 @ 9am at the Hennepin County Government Center in Minneapolis.
8/7/23 Update: Thao has been sentenced to 57 months in prison for his role in the 2020 killing of George Floyd. The sentence handed to Thao by the county judge was six months longer than the sentence proposed by Minneapolis prosecutors. 'I was hoping for a little more remorse, regret, acknowledgment of some responsibility. And less preaching,' Judge Peter Cahill said to Thao during sentencing on Monday.

8/14/23 Monday, Trial Day: Crown witnesses: Diane Fairley, who worked as an RCMP search technologist at the police agency's national laboratory in 2018. Fairly was among three technical DNA witnesses who testified on Monday. She said she also worked on a known DNA blood sample from a source with the initials I.A. on Sept. 20, 2018. Known DNA samples are samples of known origin. Amanda Gladas, a lab attendant who also handled the exhibit, described the blood sample as being obtained by a DNA warrant. Both lab workers told the jury they followed standard operating procedures while handling the exhibit to prevent any contamination. See post 144 on page 8.

6/23/23 Update: The Lethbridge father has plead guilty in a horrific case of abuse that left a six-week-old girl hospitalized with traumatic injuries. The father, who cannot be named to protect the identity of the child, plead guilty to aggravated assault & failing to provide the necessaries of life during a Friday court appearance. In addition, the Crown has withdrawn charges of sexual assault & sexual interference laid against the father, stating there was no evidence of injuries consistent with a sexual assault. If not for the guilty plea, which is considered a sign of remorse, the father could have faced, after a trial, 10-12 years in a federal penitentiary, Crown Prosecutor Suzanne Kendall told the judge. “By taking into account the early guilty plea & (the father’s) expression of remorse & his background, that was how we came to a sentence today of seven years incarceration,” Kendall said. After the agreed statement of facts was shared, Judge Kristin Ailsby gave the father a chance to speak on the matter. He told court "I hope my daughter develops as normal as possible & has a safe, happy & healthy life." The defense says the father is remorseful for his actions & has wanted to resolve the matter since April. The father is set to be sentenced on 8/4/23.

Hood military base, remains were found by contractors working on a fence along the Leon River in Bell County on June 30, 2020 in 3 shallow graves & the remains were sealed in concrete in Belton; ID’d on July 6, 2020) - *Cecily Ann Aguilar (22/now 25) – (Robinson’s GF) – arrested (7/1/20), charged (7/2/20) & arraigned & indicted (7/14/20) with 1 count 2nd degree conspiracy to tamper with evidence with intent to impair a human corpse, to corruptly alter, destroy, mutilate or conceal an object, or attempts to do so, with the intent to impair the objects integrity or availability for use in a criminal case & 1 count conspiracy felony tampering with witness, victim or informant & 1 count felony tampering with witness, victim or informant. Plead not guilty. Held without bond.
Superseding indictment: *Indicted & charged (7/13/21) with conspiracy to tamper with documents or proceedings, 2 counts of tampering with documents or proceedings. 3 counts of accessory after the fact, 1 count of destruction, alteration or falsification of records in a Federal investigation & 4 counts of false statement or representation. A federal affidavit released on July 2, 2020 says Robinson beat Guillen, with a hammer & that her body was later dismembered & burned. If convicted, Aguilar could face up to 20 years in prison with a maximum fine of $250K.

4/3/23 Update: A federal judge approved a request by the defendant to postpone the sentencing hearing. Aguilar is now set to be sentenced on 8/14/23.
8/14/23 Update: Aguilar has been sentenced to 30 years in federal prison. Aguilar pleaded guilty last year to one count of accessory after the fact & three counts of making a false statement. Aguilar’s boyfriend at the time, Spc. Aaron Robinson, is accused of killing & dismembering Guillen & then recruiting Aguilar to assist in disposing her body near Fort Cavazos, Texas, formerly known as Fort Hood.

Prosecutors agreed to drop a weapon charge. Fix acknowledged helping plot leader Adam Fox pinpoint the location of Whitmer’s home, key information that was used for a 2020 ride to find the property in northern Michigan. Fix, who faces a maximum penalty of 20 years in prison, agreed to testify if called by prosecutors.
*Brian Higgins (51/now 54) 3/15/23: Higgins plead guilty in Antrim County Circuit Court to attempting to provide material support for terrorism, a potential five-year felony; he had faced a 20-year charge & agreed to cooperate with authorities in an alleged plot to kidnap the governor. Higgins won't be sentenced by Judge Charles Hamlyn until after the August 21, 2023 trial of his four co-defendants. His cooperation could improve his chances for a lighter sentence.

5/25/23 Update: A plea agreement comes four months after Gallatin County Attorney Audrey Cromwell withdrew the county’s intent to pursue the death penalty against Batts. The details of the agreement were unavailable Thursday. Change of plea hearing on 5/26/23.
5//26/23 Update: Batts is charged with five felonies, including deliberate homicide, aggravated kidnapping, criminal child endangerment, strangulation of a partner or family member, and tampering with witnesses & informants. With the plea agreement Batts plead guilty to deliberate homicide, criminal child endangerment & tampering with witnesses & informants in an agreement that calls for her to spend the rest of her life in prison. Sentencing hearing on 7/11/23.
6/21/23 Update: The sentencing for Batts was originally scheduled to be sentenced on 7/11/23, but Gallatin County District Court Judge John Brown moved to delay the date until 8/22/23 at a hearing on Wednesday.
*James Danny Sasser, Jr. (47/now 49) (paternal grandfather) - 3/4/22: was sentenced to 100 years for the count on deliberate homicide on 3/4/22 Friday afternoon by Judge John Brown. He was also sentenced to 10 years for the charge of criminal child endangerment & 10 years for tampering with evidence.
*James Danny Sasser III (14/now 16) (2/12/20 date of offense) - 10/29/20: Judge Brown handed down a sentence that requires the teen to be detained at a juvenile detention facility until he turns 18. After his release, he will be on probation until he turns 25. The 15-year-old will not be registered as a violent offender.
*Gage Anthony Roush (18/now 20) - 11/18/20: Per peal deal Roush was given a 5 year deferred sentence for assaulting James.
*Madison Sasser (18/now 20) - 1/29/21: Per plea agreement Madison was sentenced to youth probation with the Montana Dept. of Corrections until she turns 21. After that she’ll be on adult probation until she turns 25. As part of a plea deal, prosecutors dropped the felony negligent homicide charge against her. Part of plea agreement she will testify at trial.

8/17/23 Update from CNN: Fulton County’s sweeping indictment against Trump & 18 additional co-defendants also includes details involving 30 “unindicted co-conspirators” – people who Fulton County District Attorney Fani Willis alleges took part in the criminal conspiracy to overturn the 2020 election. Some of the co-conspirators are key Trump advisers, like Boris Epshteyn, while several others are likely Georgia officials who were the state’s fake electors for Trump. 8/15/23 Update: Mark Meadows officially filed to move the election interference case from Fulton County to Federal court. The motion, filed in the U.S. District Court for the Northern District of Georgia, argues that the charges filed by Fulton County District Attorney Fani T. Willis (D) covers Meadows’s conduct while he was a federal official working as the top aide to then-President Trump. In the motion, Meadows’s attorneys cite a federal law known as the “removal statute,” which generally allows “any officer … of the United States” who is facing criminal prosecution in state court to move those proceedings to federal court if the case relates to actions that were part of the individual’s duties as a federal official.
8/16/23: A state agency is moving ahead with plans that will determine whether Lt. Gov. Burt Jones faces criminal charges as part of a scheme to overturn the 2020 presidential election in Georgia. Pete Skandalakis, executive director of the Prosecuting Attorneys Council of Georgia, said he has reviewed the Fulton County indictment & hopes to appoint a special prosecutor to consider Jones’ actions soon. Jones is one of 30 people who prosecutors said participated in a conspiracy to overturn the election but were not charged in a Fulton County indictment released late Monday. But Jones may yet face charges & his fate will rest with a special prosecutor who will determine whether further investigation is needed.
8/16/23 Update: Per DA's office & presiding Judge - It is expected that all 19 defendants named in the indictment will be booked at the Rice Street Jail. 8/16/23 Update: Former Trump White House chief of staff Mark Meadows is seeking to move the Fulton County, Georgia, prosecution against him to federal court so that he can try to get the case dismissed under federal law. On Wednesday, a federal judge scheduled an 8/28/23 hearing for Meadows & others to present evidence about whether to move the case. The judge noted the state court case can proceed at this time. In the filing, Judge Jones said the notice of removal & the attached indictment “do not clearly indicate that summary remand of this matter is required,” meaning there is no need for a higher court to send the case back to a lower court for further action. Judge Jones also ordered Meadows to give Fulton County DA Fani Willis a copy of the notice of removal & the order for the hearing. Once Willis receives the documents, she is allowed to submit a written response by Aug. 23.
8/17/23 Update: Fulton County DA Fani Willis has asked a judge to set a trial date of 3/4/24 for Trump & his 18 co-defendants. Willis’ proposed schedule also requests arraignments for Trump & his allies the week of 9/5/23. She hasn’t changed her Aug. 25 deadline for them to surrender at the Fulton County Jail.
8/17/23 Update: A former Justice Dept. official who served in the Trump administration & is one of 19 defendants in the Georgia 2020 election probe is seeking to pause an ethics case against him, citing the charges he's now facing in the Fulton County indictment. In a 13-page filing in D.C. federal court, lawyers for Jeffrey Clark on Thursday argued that an ethics violation case brought by a licensing authority for attorneys in the nation's capital should be put on hold until the resolution of the Georgia charges because "they involve substantially the same allegations." The D.C. Bar’s Office of Disciplinary Counsel, which regulates the conduct of attorneys admitted to the Bar in Washington, began a disciplinary proceeding against Clark in July 2022.
8/18/23 Update: Attorneys for Trump are expected to meet early next week with the Fulton County DA's office in order to negotiate terms of the bond package for Trump following this indictment last Monday. The meeting between Willis & Trump's attorneys is expected to occur prior to any surrender by Trump at the Fulton County Jail.

Friday, August 18th:
*Hearing (@ 9am ET) - IA - Kayleen Lee Blaha (newborn) allegedly drowned by parents to hide meth in her system, Nov. 16, 2022, Fort Dodge. The couple alleged to have disposed of her remains somewhere near the Kenyon Road Bridge across the Des Moines River, but Kayleen's body is yet to be found. – *Taylor Kay Blaha (24/now 25) arrested (12/7/22), charged (12/8/22) & arraigned (1/3/23) with 1st degree murder. Plead not guilty. $1M Cash Bond.
Court documents say Blaha admitted to investigators that she & the father of the child, Brandon Thoma, drowned the baby girl shortly after she was born on November 16, 2022. They were worried the two-year-old son they shared would be taken away if authorities learned there was methamphetamine in their daughter’s system when she was born, according to the documents. Police said Thoma admitted to disposing of the baby’s body.
Trial was set to begin on 9/12/23 but plead guilty on 8/18/23 & sentenced to 50 years in prison.

7/11/23 Update: A tip led investigators to the shallow grave of a mother of nine on an arid remote lot in Eastern Washington. The discovery five miles outside of Connell ends a more than four-year search for Estela Torres Rodriguez. Franklin County sheriff’s officials announced the discovery at a news conference Tuesday. They were joined by the county coroner & prosecutor & Torres Rodriguez’s family, still grieving the loss of a woman they have described as “selfless and caring. Clemente Torres Rodriguez but only Clemente has been arrested. He was caught returning to the U.S. from Mexico in September 2019. He remains jailed in Franklin County with a trial set for Aug. 16. His father remains on the run & is believed to be in Mexico. Franklin County released new photos of Tiburcio Larios Rodriguez on Tuesday. On Tuesday, Conner said they are still working to find Tiburcio & asked if anyone has any information on his possible location to call the sheriff’s office. Estela Rodriguez Torres’ remains are being sent to the Washington state forensic anthropologist at the King County Medical Examiner’s Office in hopes of determining how she died. Next hearing (one article) or trial (another article) on 8/16/23.
8/16/23 Update: Trial was vacated. Next change of plea hearing on 8/22/23 @ 8:30am.
*Carlos Torres Rodriguez (31) son – All charges dismissed (6/4/19). Prosecutors say that they can refile charges if and when they deem it appropriate. After a meeting recently with detectives, the Prosecutors office believes that there could be additional information that could be necessary before proceeding to trial.
*Tiburcio Larios Rodriguez (63/now 65) estranged husband. Murder warrants issued (4/1/18) & charged with 1st degree murder. $1M bond. Believed to have fled to Mexico.

*Sentencing Hearing (@ am MT) – MT – James Alexander Hurley (12) (found Feb. 3, 2020 deceased in living room, West Yellowstone) - *Patricia “Trish” Lynn Batts (48/now 51) aka Patricia Sasser & Patricia Rone (paternal grandmother) arrested (2/12/20), charged (2/13/20) & arraigned (3/24/20) with 1 count of felony deliberate homicide. Charged (3/5/20) & arraigned (3/24/20) with aggravated kidnapping, criminal child endangerment, 1st degree strangulation & tampering with witnesses & informants. Plead not guilty to all charges. $750K bond. DA will seek DP. DA will not seek DP (1/27/23).
Trial was set to begin on 7/10/23 was cancelled due to plea deal & a guilty plea.

6/21/23 Update: The sentencing for Batts was originally scheduled to be sentenced on 7/11/23, but Gallatin County District Court Judge John Brown moved to delay the date until 8/22/23 at a hearing on Wednesday.
8/22/23 Update: Batts was sentenced to life in prison without parole on Tuesday for the deliberate killing of her 12-year-old grandson in West Yellowstone. Gallatin County District Court Judge John Brown also gave Batts two 10-year sentences for criminal child endangerment & tampering with witnesses or informants. She pleaded guilty to the same three counts last May & will serve her time at the Montana State Women’s Prison.
*James Danny Sasser, Jr. (47/now 49) (paternal grandfather) - 3/4/22: was sentenced to 100 years for the count on deliberate homicide on 3/4/22 Friday afternoon by Judge John Brown. He was also sentenced to 10 years for the charge of criminal child endangerment & 10 years for tampering with evidence.
*James Danny Sasser III (14/now 16) (2/12/20 date of offense) - 10/29/20: Judge Brown handed down a sentence that requires the teen to be detained at a juvenile detention facility until he turns 18. After his release, he will be on probation until he turns 25. The 15-year-old will not be registered as a violent offender.
*Gage Anthony Roush (18/now 20) - 11/18/20: Per peal deal Roush was given a 5 year deferred sentence for assaulting James.
*Madison Sasser (18/now 20) - 1/29/21: Per plea agreement Madison was sentenced to youth probation with the Montana Dept. of Corrections until she turns 21. After that she’ll be on adult probation until she turns 25. As part of a plea deal, prosecutors dropped the felony negligent homicide charge against her. Part of plea agreement she will testify at trial.

(13) (last seen alive on July 18, 2017 at a local Tim Hortons, Burney B.C. & her body was found 5 hours later on July 19, 2017 in Burnaby’s Central Park, Vancouver) - *Ibrahim Ali (28/now 32) arrested & charged (9/7/18) & indicted (11/25/19) with 1st degree murder. Plead not guilty. Held without bail.
Police used a new & somewhat controversial “DNA dragnet” technique, after collecting DNA at the crime scene that indicated a suspect of Middle Eastern descent. (He is a Syrian refugee who entered Canada 3 months before murder).
Trial began on 3/17/23 with jury selection & ended on 3/23/23.
Trial began on 4/5/23 & continued on 4/11/23. (expected to run thru June 30 & changed (5/17/23) maybe thru September). B.C. Supreme Court Justice Lance Bernard presiding. Crown prosecutor Isobel Keeley & defense attorney Ben Lynskey.

*Shawn Michael Fix (38/now 40) - 6/7/23: Fix plead guilty to providing material support for an act of terrorism, namely the strategy to snatch Whitmer at her vacation home in Antrim County. Prosecutors agreed to drop a weapon charge. Fix acknowledged helping plot leader Adam Fox pinpoint the location of Whitmer’s home, key information that was used for a 2020 ride to find the property in northern Michigan. Fix, who faces a maximum penalty of 20 years in prison, agreed to testify if called by prosecutors.
*Brian Higgins (51/now 54) 3/15/23: Higgins plead guilty in Antrim County Circuit Court to attempting to provide material support for terrorism, a potential five-year felony; he had faced a 20-year charge & agreed to cooperate with authorities in an alleged plot to kidnap the governor. Higgins won't be sentenced by Judge Charles Hamlyn until after the August 21, 2023 trial of his four co-defendants. His cooperation could improve his chances for a lighter sentence.
