Wednesday, March 1st:
*Preliminary Hearing (@ 9am PT) - NV - 6-month old, on a Las Vegas inbound flight, July 12, 2022 from Oregon. *Tiffany Burks (42) foster mother arrested (7/12/22) & charged (7/13/22) with felony child abuse/neglect. Released (7/13/22) own recognizance.

2/14/23 Update: Negotiations hearing heard. Bail conditions: stay out of trouble & comply with any CPS directives. Remote appearance by defendant. Next preliminary hearing on 3/1/23 @ 9am.
3/1/23 Update: Dispositions. Preliminary hearing held. Defendant's presence waived as Notice of Non-Appearance pursuant to State v. Sargent was filed 2/27/23 by Defense. True Name provided for the record. Defense represented the Defendant's true name is Burks, although the Complaint shows the name of Brooks. Defense invokes the exclusionary rule. State's Witnesses: FBI Special Agent, Erin Walsh, testified under oath & identified the Defendant via State's proposed exhibit #1. State moves to admit proposed exhibit # 1-Admitted. Witness, Kailynn Bailey, testified under oath remotely. Oral Motion by State to amend complaint by interlineation Line 14 & Line 19 - language amendments. Motion granted. State rests. Per Defense, Defendant has been advised & understands her rights at preliminary hearing & following the advice of Defense counsel, waives her rights. Defense rests. State reserves for rebuttal. Defense makes closing arguments & moves to dismiss. State makes final arguments. Defense motion to dismiss granted. Case closed-Dismissed. Judgment entered. 3/2/23: Notice of Disposition & Judgment.

Friday, March 3rd:
*Trial continues (Day 13)-MISTRIAL Declared! (Day 2) (@ 10:30am PT) – AZ – Isabel Mercedes Celis (6) (missing from home April 21, 2012, Tucson, found in a desert area in Marana, located off of Avra Valley & Trico roads on Mar. 3, 2017, Id’ed Mar. 31, 2017) – *Christopher Matthew Clements (30 @ time of 1st crime/36/now 41) aka Damion James Johnson indicted (9/15/18) & arraigned & charged (9/24/18) with 1 count of 1st degree murder, 1 count of kidnapping a minor under 15 & 14 counts of sexual exploitation of minors. Plead not guilty. $2M cash only bond. DA will not seek DP.
Murder trial for Isabel began on with jury selection on 2/9/23 & a jury was selected. Jury: 9 men & 6 women. Only 12 will actively participate in the trial (other 3 will be alternates). One juror was dismissed (2/22/23) 2 alternates. Pima County Superior Court Judge James Marner presiding.
Trial began on Tuesday, 2/14/23 thru 3/9/23. State rested their case on 2/28/23. Defense started their case on 2/28/23. Jury deliberations: 3/2/23: 4 ½ hours. 3/3/23: ~2 ½ hours – total: ~7 hours. Jury could not come up with a verdict & Judge James Marner declares a mistrial.

3/3/23 Friday, Trial Day 13/Jury Deliberations (Day 2): A jury could not agree on whether Clements is guilty or not guilty. The jurors considered the case for about seven hours over two days. Judge James Marner accepted the jury's assertion it cannot come to a unanimous verdict & declared a mistrial. A mistrial does allow prosecutors to put on a new trial. The Pima County Attorney's Office released a statement saying they will pursue a new trial. That will include a new jury. But prosecutors say they do not yet know when the new jury selection will begin.

*Maribel Victoria Gonzales (13) - Trial started 9/13/22 & ended 9/30/22 with a guilty verdict. Sentenced on 11/14/22 to natural life in prison & 17 years for kidnapping. The kidnapping sentence will be served consecutively with the sentence of natural life.
*Christopher Matthew Clements (41) charged (2/28/23) with promoting prison contraband a felony (2/7/23).

DA will seek DP. Bond reduction denied (3/30/21). Will be representing himself.

*Charged & indicted (3/13/19) & arraigned (4/26/19) with 1st degree felony burglary (on 8/21/18 at Scott’s home). $16,500 bond on charges of interference with an emergency call, making a false police report & violation of a protection order, bond for the burglary charge is $250K, the murder of multiple persons is carrying a bond of $1.5 million & $250K. Plead not guilty to all charges.

*Motions Hearing & Sentencing Hearing (@ 9am PT) - CA - Kristin Denise Smart (19) (missing May 25, 1996 while walking back to her dorm from a off campus frat party at Cal Poly, reported missing on May 26, 1996, San Luis Obispo, still missing; legally declared dead on May 25, 2002) – *Paul Ruben Flores (19 @ time of crime/44/now 46) arrested (4/13/21), charged (4/14/21) & arraigned (10/20/21) with 1st degree murder. Plead not guilty. No bond.
Trial began on 7/18/22 & ended 9/29/22. 10/4/22: Verdict: Total: ~27 hours of deliberations. Found guilty of 1st degree murder. Sentencing hearing on 3/10/23.

1/13/23 Update: Defense attorney Robert Sanger says that the court reporter has indicated that certified transcripts will take 60 days to finalize after payment has been received. Court reporter tells Judge O'Keefe she can have the entire trial finalized by 1/15/23, but transcripts of jury selection will take longer, which Sanger has also requested. Monterey County Superior Court Judge Jennifer O’Keefe set a status hearing for 2/9/23 @ 1:30pm & the sentencing will now take place on 3/10/23 @ 9am.
2/9/23 Update: Defense attorney Robert Sanger was not present at hearing because he is working on another trial in L.A. He asked attorney & retired Santa Barbara County Judge Frank J. Ochoa to sit in for him. Ochoa indicated that Sanger still intends to file a motion for a new trial before the sentencing date of 3/10/23 but has been delayed as he had to secure funds to order trial transcripts. He was given 60 days to do this on 12/2/22. Deputy DA Christopher Peuvrelle said that today's status hearing & Flores' sentencing date were both on calendar before Mr. Sanger's other trial began & he should have prepared accordingly. Judge O'Keefe said she will not push the sentencing to a later date as it is already 5 months after the end of trial. The motion for a new trial marks Sanger’s 10th attempt to restart legal proceedings in the case after unsuccessfully motioning for a mistrial nine times before the verdict. The motion will include new information Sanger’s team received about one of Peuvrelle’s witnesses after the verdict was read. Sanger did not elaborate on which witness was involved or the information they had. The motion will be heard 3/10/23 & if it is denied, Flores will be sentenced immediately after. He faces 25 years to life in state prison or life without parole. Sentencing is still scheduled on 3/10/23 @ 9am. And if a motion for new trial is filed by Sanger before then, it will likely be heard on 3/10/23.
2/28/23 Update: Defense attorney filed a set of motions seeking to throw out Flores' guilty verdict. One of the motions filed by attorney Robert Sanger requests an acquittal & dismissal of charges, "on the grounds that a rational trier of fact could not find the defendant guilty beyond a reasonable doubt based on the State of the evidence at the conclusion of the trial." Another requests a new trial, claiming "prosecutorial errors & the admission of junk science as evidence." and that there was insufficient evidence to find Flores guilty. The motion also claims the verdict "was based on a violation of the defendant's constitutional rights to due process & a fair trial." In the court filing, which was submitted to the Monterey County Superior Court on Friday, 2/24/23. The court filings request that the motions be heard at 9am on Friday, 3/10/23.
*Ruben Ricardo Flores (55 @ time of crime/80/now 81) - Found not guilty of accessory after the fact on 10/14/22.

2/24/23 Friday, Trial Day 16/Verdict Watch (Day 1): Superior Court Judge Samuel Ohta will deliberate & render a verdict as both the prosecution & defense agreed to have the case tried without a jury.
Per news reporter Judge might have is decision today, Friday, 2/24/23.

3/7/23 Update Trial Day 17: Judge Sam Ohta found Barron & Leiva guilty of 1st degree murder & torture in the June 21, 2018, death of Anthony. The judge also found true the special circumstance allegation of murder involving the infliction of torture. They were also convicted of two counts of child abuse involving the boy's half-siblings, identified in court as "Destiny O." & "Rafael O." Leiva & Barron now face a maximum of life in prison without the possibility of parole when they are sentenced on 4/25/23.

3/10/23 Update: Monterey County Superior Court Judge Jennifer O’Keefe on Friday denied a motion seeking an acquittal/new trial for Flores. Judge sentences Flores to 25 years to life in prison with no probation. He will be eligible for parole. With time served & good behavior he’s eligible for a parole board hearing in about 15 years. The parole could grant or deny paroled release at that time. Probation is governed by the county & can allow custody credit programs to decrease sentences. Parole is governed by the state ^ a minimum sentence must be served. Paul was under 25 at the time he killed Kristin, so despite life without parole being the max sentence for 1st degree murder, CA’s young offender law doesn’t allow him to get more than 25 to life with parole. Violent crimes in CA are 1/3 custody credit for good behavior. So if Paul has good behavior in prison, his sentence is around 17 years. He’s already served around 2, so he will be eligible for a parole board hearing in 15 years. Flores is also required to register as a sex offender for the rest of his life.

*Change of Plea Hearing (@ 9am CT) - IN - Emma Grace Patricia Sweet (2) (Last seen Nov. 24, 2021, reported missing Nov. 25, 2021; found Nov. 28, 2021 -2 ½ miles downstream from truck. The death certificate filed for 2-year-old Emma indicates her manner of death as homicide & cause of death as complications of hypothermia & asphyxia due to drowning). Also Jeremy Sweet, dad & truck found Nov. 26, 2021 in the White River, Columbus, Bartholomew County. *Jeremy W. Sweet (38/now 39) arrested (11/28/21) & charged (12/1/21) with neglect of a dependent resulting in death & unlawful possession of syringe. Plead not guilty. $1.2M bond.
No actions were taken by her adult caregiver to rescue Emma from the dangerous environment & this inaction resulted in her death," the Bartholomew County Sheriff alleged in a statement, "and thus the manner of death is homicide."
Trial set to begin on 4/11/23.

3/10/23 Friday, Trial Day 10: Charge conference hearing for Judge & attorneys. Closing arguments start on Monday, 3/13/23.
*Amber Nichole McDaniel (31) aka Amber Odom, mother charged (7/2/19) with tampering with physical evidence & endangering a child in connection with incidents Oct. 11, 2018, the day her son was discovered dead. Amber was free Thursday from Wichita County Jail on $60K bond.
Withholding this evidence & deleting the text messages resulted in the felony charge of tampering with evidence. According to Texas law, tampering with evidence is punishable by up to 10 years in prison. If convicted of child endangerment, Amber faces up to two years in a state jail.

Tuesday, March 14th:

*Sentencing Hearing (@ 9am CT) - IA – Xavior Christopher-Tyler Harrelson (10) (went missing May 27, 2021, last seen at 11am riding his bike near his home, Montezuma, found on Sept. 30, 2021 by a farmer tending his bean crop near 110th Street & Ewart Road, about 4 miles from Xavior's home; id confirmed on Oct. 15, 2021; his birthday was May 30, 2021). Poweshiek County
*Sarah Kay Harrelson (42/now 43) arrested & charged (10/31/22) & arraigned (12/16/22) with 2 counts of controlled substance violation & 1 count of failure to affix drug stamp. Plead not guilty. Bond @ $10K, $5K & $25K. Polk County Trial was set to begin on 2/13/23 was cancelled. Plea hearing on 1/24/23 & plead guilty, sentencing on 3/14/23.

1/17/23 Update: Motion for release pending Appeal & Restitution hearing on 2/17/23. 2/17/23 Update: Balwani returned to federal court Friday in a last-ditch attempt to stay out of prison while appealing a jury’s verdict convicting him of orchestrating a blood-testing hoax with his former boss & lover, Holmes. Besides overseeing arguments about Balwani’s attempt to delay the start of his nearly 13-year prison sentence, U.S. District Judge Edward Davila also heard a vigorous debate about how much money Balwani should pay investors & patients duped by the Theranos blood tests that never worked as promised. The deceit resulted in Balwani’s conviction on 12 counts of fraud & conspiracy. Davila didn’t issue any rulings at the end of the 90-minute hearing. His decision on whether Balwani can remain free on bail while he appeals his conviction, however, is likely to come soon. That’s because Balwani is scheduled to report to prison in Lompoc, California, on March 15. The judge said he doesn’t expect to decide on the question of how much Balwani should pay in restitution until another hearing on the same issues is held for Holmes, Theranos’ disgraced CEO, on March 17. 3/8/23 Update: U.S. District Judge Edward Davila, who sentenced Balwani & denied his request to remain free on appeal, had recommended he serve his time in a Lompoc prison. In June 1984, a woman living in an apartment in Pompano Beach endured a sudden, cruel & violent attack in the sanctity of her home. She was brutally raped at knifepoint by a man who broke into her apartment. On at least eight occasions in 1984 & 1985, detectives believe Koehler snuck into homes in Broward County late at night or in the wee hours of the morning through unlocked doors & attacked his victims while they slept or prepared for bed. He sometimes covered the heads of his victims or his own head, sometimes with pillowcases & threatened to kill them or their family members before raping & robbing them. Koehler will be brought to Broward County to face the charges against him, once the cases against him in Miami-Dade are adjudicated.

3/13/23 Monday, Trial Day 11: Both the prosecution & defense were allowed 90 minutes apiece. Closing arguments by prosecutor lasted 45 minutes & defense finished their closing arguments. Prosecutor did a rebuttal. The jurors started deliberations about 12pm to ~4pm.
Staley has been found guilty of capital murder for the 2018 killing of Wilder McDaniel. Staley was sentenced to life in prison without parole around 4:20pm. The jury came back with the verdict after over four hours of deliberation following closing arguments made by the prosecution & defense. Jurors had heard just over nine days of testimonies in this case.

*Amber Nichole McDaniel (31) aka Amber Odom, mother charged (7/2/19) with tampering with physical evidence & endangering a child in connection with incidents Oct. 11, 2018, the day her son was discovered dead. Amber was free Thursday from Wichita County Jail on $60K bond.
Withholding this evidence & deleting the text messages resulted in the felony charge of tampering with evidence. According to Texas law, tampering with evidence is punishable by up to 10 years in prison. If convicted of child endangerment, Amber faces up to two years in a state jail. Pretrial conference on 3/24/23.

3/17/23 Update: Chauvin plead guilty specifically to two counts of aiding and abetting, failing to file tax returns to the state of Minnesota for the 2016 and 2017 tax years. Chauvin admitting that he didn't file Minnesota income taxes for two years due to “financial concerns.” He was sentenced to 13 months in prison on the tax charges, but he has already been incarcerated for longer than that & was given credit for time served.

3/17/23 Update: Judge Daryl Trawick sentenced Koehler to 17 years in prison in connection with one case in Miami-Dade. During a hearing Thursday Judge said the 17-year sentence was the maximum Trawick could impose under the state's guidelines. Koehler will get credit for time served. It was learned Koehler couldn't be sentenced for the sexual battery charge, since it was barred by the statute of limitations.

3/9/23 Update: Pretrial readiness hearing held. Fourth Judicial District Attorney Michael Allen said that despite not having the final sanity report from a defense expert in hand, the prosecution still wanted to move forward with the set trial date of March 20. Allen said the prosecution’s hope is to receive the report prior to March 20 so its team can have experts from the state hospital interpret the findings. The defense said it would continue doing all it could to get the report to the people & the court by the deadline, and understood the court’s concerns. The defense also stated it had dropped off a flash drive to the prosecution and was unaware that everything was not turned over. On Thursday, the judge set a firm deadline for Letecia’s mental health report to be done, 5 p.m. March 16. Judge Gregory Werner asked Stauch if she would be “dressing out” for the trial, to which Stauch responded that she is choosing to wear her inmate jumpsuit. Another concern brought up by the prosecution was the potential for an MRI request from the defense for Stauch. The defense responded that it was frantically working on when that could be done. Werner said he was puzzled as to why an MRI had not been conducted prior and also why it was taking so long to get a final report from the doctor. “It is what it is, and we will deal with it as best we can … Be ready for trial on 3/20/23 & we will see where we go,” Werner said. Opening statements will start 4/3/23 & each side will get 1 hour. The Court denied the request for extended voir dire. 3/17/23 Friday, Jury Selection Day 1: Ali, his defense team & Crown prosecutors were in court for stage 1 of the jury selection Friday, but the jury panel (all of the prospective jurors who got summonses & confirmed they would attend) were not. A court clerk drew the juror numbers one-by-one in a random selection, and the numbers were recorded in the sequence in which they were drawn. On Wednesday, 3/22/23, the jury panel will appear in groups of about 30 in the order in which their numbers were drawn & jury selection will begin. Trial set to begin on 4/3/23 & run thru 6/30/23.

3/20/23 Update: Gonzales plead guilty Monday to abandoning a child & injury to a child by omission in a plea bargain with the McLennan County District Attorney’s Office that called for Gonzales to serve two concurrent, 10-year prison terms. Gonzales, who has been jailed 1,006 days, must serve at least half of his 10-year term before he can seek parole. He also has been placed under an immigration detainer & is expected to be deported after he serves his prison term.
*Laura Jane Villalon (Sanchez) (35/now 37) “mom” – Working out a plea deal with DA. Tentative jury trial 5/15/23 & no date set yet for plea change hearing.

Murder: Defendant plead guilty & was sentenced Count 1-4: Life in DOC without possibility of parole. Counts 5 &6: Life & counts 7-14 Life in DOC. 1/27/23 Update: Defendant Griffin in court. Defendant in custody at the Brown County Jail. Attorney Jeffrey Joseph Cano, attorney James M. Schoenecker & attorney Peter R. Heyne in court for Griffin. Attorney David L. Lasee, Assistant DA Aaron Linssen & Assistant DA Kevin Steuck appear on behalf of the State. Cash bond is revoked. Griffin has reached a plea agreement with prosecutors. Griffin appeared in Brown County Court Friday to enter a plea in the death of Lisa Holstead. The case was once considered the longest-unsolved murder in Green Bay. On Friday, Griffin pleaded “no contest” to a charge of Homicide by Reckless Conduct. The court found him guilty. Griffin was originally charged with 1st degree intentional homicide, a higher class of felony than the reckless conduct charge. Order for pre-sentence investigation. TN/MN – April Lee Pease (30) (missing Mar. 17, 2009, Bloomington, not found) - *Cedric Joseph Marks (45/now 48) charged (3/16/20) with 2nd degree murder in the abduction & death of April.
*Kellee Kristine Sorensen (34) – charged (3/16/20) with 2nd degree murder. $3K conditional bond. In custody in Washington State.

*Trial continues (Day 3)-MAYBE! (@ 8:30am PT) – WA – Sarah Yarborough (16) (Dec. 14, 1991, Seattle) - *Patrick Leon Nicholas (27 @ time of crime/55/now 58) arrested (10/2/19), charged (10/3/19) & arraigned (10/17/19) with 1st degree murder with sexual motivation & 2nd degree rape. Plead not guilty. $5M bond.
DNA from 2 cigarette butts matched DNA from crime scene.
Trial began on 3/23/23. (for the 10th time). Judge Wiggs presiding.

*Sentencing Hearing (@ 9am PT) – CA – Diego Villa Torralba (newborn-12 hours old) (July 19, 2019, Oxnard; strangled after birth) – *Andrea Torralba Comacho (20/now 24) ”mom” arrested (7/19/19), charged (7/23/19) & arraigned (9/30/19) & re-arraigned (10/7/21) with murder & assault on a child by means of force resulting in death. Plead not guilty. Was $1M bond, changed (9/30/19) to $5M.
Trial was set to begin on 3/29/23 but was cancelled due to a guilty plea (1/20/23).

Update!

Monday, March 27th:
*Sentencing Hearing (@ 8:30am CT) – WI – Lisa Holstead (22) (last seen August 11, 1986, found August 12, 1986 strangled & partially submerged in a swamp in an area known as Ken Euers Nature area, Green Bay) - *Lou Archie Griffin (31 @ time of crime/65/now 67) arrested (10/28/20), charged (10/29/20) & arraigned (2/8/21) with 1st degree intentional homicide. Plead not guilty. $1M Cash bond. Cash bond has been revoked (1/27/23).
DNA tested for forensic genetic genealogy-match.
Trial was set to begin on 1/27/23 with jury selection but was cancelled as Griffin plead no contest/guilty to a plea deal.

3/27/23 Update: 3/27/23 Update: Griffin was sentenced Monday to ten years in prison for the charge of homicide by reckless conduct for the death of Lisa Holstead. Back in January, Griffin pleaded “no contest” to a charge of Homicide by Reckless Conduct. The court found him guilty. Griffin was originally charged with 1st Degree Intentional Homicide, a higher class of felony than the reckless conduct charge. This was the maximum penalty available under the law in 1986. Under the old sentencing law, Griffin can be released after serving two-thirds of his sentence. He was also granted 2.5 years of time served which means he could be released in 4.5 years & is eligible for parole in less than 6 months.
