Plead not guilty. No bond. (5/18/20: bond denied due to COVID). DP Case.

3/5/21 Update: Blankenship plead guilty to involuntary manslaughter, a first-degree felony & child endangerment, a third-degree felony, as part of a stipulated plea & sentencing agreement. Blankenship was sentenced to 6 years in prison as part of a plea agreement.

1/17/21 Update: Almena is expected to accept a plea deal that will keep him from prison & prevent him from undergoing a second trial, a victim’s family member said. Derick Almena, the master tenant of the Fruitvale neighborhood warehouse, is expected to plead guilty to 36 counts of involuntary manslaughter on Jan. 22. In return, he will be sentenced to nine years in custody & three years of post-custody supervision. There is a disposition & setting hearing scheduled on 2/5/21 & hearings on 2/26, 3/1 & jury selection to start on 3/8/21 with trial to start on 4/2/21.
1/22/21 Update: Almena plead guilty Friday to 36 counts of involuntary manslaughter, avoiding a second trial and will be back in an Alameda County courtroom March 8 for sentencing. In May, Almena posted a $150K bail & was released to his Lake County home after being jailed since his arrest in June 2017. In return for pleading guilty, Almena would be sentenced to 9 years in jail & 3 years of post-custody supervision. Based on time served & good behavior, Almena could be out in less than 2 years. He also could finish his sentence at home under house arrest because of the coronavirus pandemic.

*Trial set to begin (@ 9am CT) - MN – George Perry Floyd, Jr. (46) (May 25, 2020, Minneapolis, arrested for forgery & killed in police custody) - *Derek Michael Chauvin (44/will be 45 in 11 days) police officer who held his knee on Floyd’s neck for 8 minutes & 46 seconds (Note: on 10/14/20 this has been changed to 9 minutes & 30 seconds) (& non responsive for 2 minutes & 53 seconds before officer took his knee off his neck; from 8:19pm to 8:27pm his knee was on Floyd’s neck; has been fired (5/26/20) & arrested & charged (5/29/20) with 3rd degree murder & 2nd degree manslaughter. Charges changed (6/3/20) to 2nd degree murder-unintentional-while committing a felony, 3rd degree murder-perpetrating eminently dangerous act (3rd degree charge was dismissed 10/22/20) & evincing depraved mind & 2nd degree manslaughter-culpable negligence creating unreasonable risk. $500K bond, reset (6/8/20) @ $1.25M & $1M w/conditions. Posted non-cash $1M bond (10/7/20) & has been released from jail.

3/2/21 Update: Court of Appeals still mulling over whether to reinstate the 3rd degree murder charge against Chauvin. Prosecutors will argue before the Court of Appeals next Monday, outlining why they should be allowed to reinstate a count of third-degree murder against Chauvin based on a ruling the court issued earlier this month.
3/3/21: The process is scheduled to begin Monday, March 8. Each day, eight potential jurors will go to the courthouse - four in the morning & four in the afternoon & Judge Peter Cahill, prosecutors & the defense will question each person, one at a time. Once 16 potential jurors have been questioned & passed through without a challenge, then they are seated as the jury for the murder trial - 12 jurors & 4 alternates. During jury selection, each day's session will begin at 8am, with first hour reserved for motions. Jury selection begins at 9am & is expected to end by 5pm. On 3/29 trial begins with Opening statements. During the trial itself, sessions could continue until 7:30pm if the jury is sequestered.
3/5/21: MN Appeals Court rules Judge Peter Cahill made mistake in not reinstating murder-3 charge against Chauvin. Says its ruling in prior Noor conviction is the law of the state right now. Sends argument back to Cahill for reconsideration. Appeals Court ruling did NOT immediately reinstate murder-3 charge against Chauvin. Judge Cahill will have some leeway to hear further arguments. Expect him to do that when this trial is scheduled to start Monday AM with motions, before then beginning jury selection.

Bond was at $500K, but on 1/31/18 ordered to be held with no bond. Remains in Duval County jail without bond.

2/16/21 Update: Present: Judge Jeb Branham, Asst. State attorney Chyna-Michele Makarowski, attorney for defense Alan Chipperfield & defendant present in jail. Defendant has agreed to plead guilty in a negotiated sentence to charges of second-degree murder & evidence tampering. He’s scheduled to formally enter that plea during a Thursday, 2/18/21 @ 1pm disposition hearing. Sentencing on 3/11/21 where the terms of the finalized agreement, not yet release, will be provided to the Judge before the 3/11/21 sentencing hearing.
2/18/21 Update: Judge Jeb Branham has accepted Rodarte’s guilty plea to the 2nd degree murder of Savannah. Rodarte had also been charged with evidence tampering & abusing a body, but those charges were dropped as part of his plea agreement. The plea agreement would have Rodarte serve 40 years (with credit for time served) in state prison rather than the life sentence that he was eligible to if the case went to trial. Sentencing hearing on 3/11/21.



Friday, March 12th:
*Sentencing Hearing (@ 1:30pm PT) – CA – Elizabeth Sullivan (31) (reported missing Oct. 14, 2014, San Diego; found Oct. 6, 2016 in San Diego Bay) – *Matthew Scott Sullivan (29 @ time of crime/33/now 36) “husband” arrested (1/31/18 in Wyoming, Delaware, extradited 2/9/18), charged & arraigned (3/4/19) with 1st degree murder. Plead not guilty. $2M bond. Judge changes (3/13/20) to no bond.
Trial began on 2/18/20 with jury selection, trial started on 2/21/20 and ended on 3/11/20. Jury: 7 men/5 women & 4 alternates. Jurors’ took about 8 ½ hours (3 days) to reach a verdict of guilty of 2nd degree murder, plus allegations of using a knife in the killing. Was acquitted of 1st degree murder charge.

3/8/21 Update: Alameda County Superior Court Judge Trina Thompson accepted a plea deal Monday from Almena who plead guilty. As part of the plea deal, Almena is expected to receive a 12-year sentence. But because of his time served, he will most likely not see the inside of a jail again, as he is expected to serve the rest of his sentence on an ankle monitor at home. After he serves that sentence, Almena will then enters a period of three years of supervised release. Defense attorney Tony Serra also read a statement from his client at the hearing: “I am sorry. I am very afraid to say more. I am sick with shame. I am so sorry. My shame cannot stand as any defense, but it’s what I’m responsible for. It’s my fault.” Earlier Monday, family members of those killed in the fire finally got a chance to address Almena and they didn’t mince words. Because of COVID-19 restrictions, the family members were able to confront Almena through a video feed. A hearing on Almena’s restitution to the victims in the case is scheduled for April 30.

2/18/21 Update: Judge Jeb Branham has accepted Rodarte’s guilty plea to the 2nd degree murder of Savannah. Rodarte had also been charged with evidence tampering & abusing a body, but those charges were dropped as part of his plea agreement. The plea agreement would have Rodarte serve 40 years (with credit for time served) in state prison rather than the life sentence that he was eligible to if the case went to trial. Sentencing hearing on 3/11/21.
3/11/21 Update: Rodarte was sentenced Thursday to 40 years in prison per peal deal. The judge gave Rodarte credit for the time he has already spent in jail, meaning he has about 37 years left on his sentence. Rodarte had been eligible for life if convicted by a jury. Victim impact statements were done before sentencing by: D. Gold (Savannah's father), by her brother C. Gold & S. Gold, her mother. The judge said Gold’s mother will receive nearly $9,000 in restitution and roughly $12,000 will go toward a victim trust fund.

3/12/21 Update: McKeever-Hauschultz pleaded “no contest” to felony counts of Fail/Prevent Mental Harm to Child & Child Abuse-Fail/Prevent Great Harm. She was found guilty by the court. As part of a plea agreement, the following charges were dismissed but read into the record: Intentionally Contribute/Delinquency & Child Abuse-Fail/Prevent Bodily Harm. She was sentenced to five years in prison & five years on extended supervision.
Hauschultzes were court appointed guardians for Ethan & his 2 siblings in 2016.

*Sentencing Hearing (@ 1:30pm PT) – CA – Elizabeth Sullivan (31) (reported missing Oct. 14, 2014, San Diego; found Oct. 6, 2016 in San Diego Bay) – *Matthew Scott Sullivan (29 @ time of crime/33/now 36) “husband” arrested (1/31/18 in Wyoming, Delaware, extradited 2/9/18), charged & arraigned (3/4/19) with 1st degree murder. Plead not guilty. $2M bond. Judge changes (3/13/20) to no bond.
Trial began on 2/18/20 with jury selection, trial started on 2/21/20 and ended on 3/11/20. Jury: 7 men/5 women & 4 alternates. Jurors’ took about 8 ½ hours (3 days) to reach a verdict of guilty of 2nd degree murder, plus allegations of using a knife in the killing. Was acquitted of 1st degree murder charge.

3/12/21 Update: Sullivan was sentenced Friday to 16 years to life in state prison. San Diego Superior Court Judge Albert Harutunian III denied a defense motion to impose probation, saying “the jury verdict & the evidence at trial makes clear that Sullivan brutally murdered his wife, methodically cleaned up the messy murder site & then hid the body for years. He almost got away with it, but his final attempt to hide the body at the bottom of the bay failed.” Sullivan made a brief statement at the hearing, in which he said some defense witnesses were not able to testify for various reasons & that he believed they would have turned the case in his favor.

He showed up at Fotis’ door Christmas Eve (2019) being invited by Fotis. Ragaglia gifted Fotis holy water, capsules of magnesium & two spiritual books. They exchanged phone numbers. They texted for about a week. Fotis thought the holy water & capsules might be poisoned. Police never tested them. February 2nd — after Fotis’ death. That's when police say they found Ragaglia trespassing at 80 Mountain Spring Road. It’s another Dulos property searched in connection to the murder investigation. Ragaglia was charged with first degree trespassing.

Plead not guilty (insanity defense). Held without bond.
Trial (murder) began on 10/13/20 & ended on 10/26/20. Jury deliberated from 10/27-10/28/20. Found him guilty of all charges. Penalty phase started on 10/28/20 & ended with Prince being criminally responsible. Jurors: 9 women & 3 men.
In Delaware charged & convicted of shooting an acquaintance: Trial was 5/8/18, charged with attempted murder, jury found him guilty of attempted manslaughter. Sentenced (8/31/18) to 40 years in prison. Sentencing for this murder on 3/19/21.

11/2/20 Trial Day 10 Monday-Penalty Phase (Day 4): The jury came back with that Prince was criminally responsible for the murders/he was in his right mind. Sentencing for Prince has not yet been scheduled. Prince could face up to a life sentence without parole for each of the three counts of first-degree murder & two counts of attempted first-degree murder, plus up to 25 additional years in prison for the remaining charges. However, Prince will first serve a sentence in Delaware before returning to Maryland for whatever sentence Judge Yolanda Curtin imposes. 11/5/20 Update: Sentencing is scheduled on 3/19/21 @ 9:30am. 2/18/21: Motion: request for new trial. 3/7/21: Pre-sentencing report received.

Trial is set to begin for 2 days on 10/5 & 10/6/20. 10/5/20 Update: Trial has been continued due to COVID. Set for trial on 3/15/21 only on other charges. Murder charges will be considered at later proceedings.
3/16/21 Update: In opening statements, the prosecution alleged that Hellman said that everything that happened was his idea & he asked Thomas to do it; however, the defense said that Hellman didn’t actually participate & it was Thomas who actually carried out the acts in question. During court, the jury was shown a 45-minute audio interview with Hellman that was done a week after the incident occurred. In the interview, Hellman said he was trying to explore the extent of his sexual desires, but said in the end that he was disgusted by them. Jury found Hellman guilty of all five charges against him. Hellman was in Montgomery General District Court on Monday & pleaded not guilty to producing child porn, reproducing child porn, animate object sexual penetration, producing child porn & forcible sodomy. The jury recommended Hellman serve two life sentences & his sentencing hearing on 6/29/21.

3/19/21 Friday, Day 9 of Jury Selection: Motions today: Judge Peter Cahill said he’ll rule on the forensic psychiatrist’s testimony on Friday, when he plans to issue a broader ruling on the admissibility of Floyd’s 2019 arrest & on defense motions for delaying or moving the trial. First up is the May 6, 2019 arrest video of Floyd. Judge Cahill says the cause of death is the clear issue here. Defense saying it was due in part to drug toxicity & not positional asphyxia from Chauvin's knee. Judge says behavior between the 2019 & 2020 arrests is "remarkably similar" but the 2019 behavior is not admissible. Judge says the 2019 arrest video would be admissible from the time one officer approaches Floyd's on the passenger side of the vehicle. Judge: I will allow a portion of the video from the one officer when he approaches the car until the time he's handcuffed. That's all that's admissible. Photo of pills in the backseat is admissible. Floyd's statements surrounding blood pressure allowed. Judge Cahill also ruled that the State's expert Dr. Sarah Vinson cannot testify that Floyd was experiencing anxiety or claustrophobia but if defense opens the door, it could be allowed. 2/18/21 Update: Krystal Kenney’s three year sentence has been thrown out, because the district court “erroneously sentenced Kenney outside the presumptive maximum term.” Colorado appeals court on Thursday ordered a new sentencing for an Idaho woman imprisoned in connection with the murder of Kelsey Berreth. Kenney lost a bid for parole last year, and her attorney has argued that her sentence was too long. A three-judge panel of the Colorado Court of Appeals agreed, ordering the case to be returned to 4th Judicial District Court Judge Scott Sells for resentencing. Appeals Judge Neeti Pawar wrote the opinion. Judges David Richman & Lino Lipinsky concurred. So far she has served 13 months of that three-year term. The maximum, without the aggravating factors, is now 18 months. The ruling is likely to set her up for release on parole.

Because the trial court failed to articulate why Jones's sentenced should be both enhanced and the separate counts run consecutively to one another, the case should be remanded back to the trial court.

11/12/20 Update: Change of Plea hearing on 12/3/20. 12/3/20 Update: Hidalgo plead guilty. In a plea bargain, Hidalgo admitted to 1st degree felony aggravated murder & 2nd degree felony obstructing justice. The Weber County Attorney’s Office in return agreed to drop a charge of 3rd degree felony desecration of a body & said it would recommend Hidalgo be sentenced to 25 years to life in prison.
1/8/21 Update: Judge Michael Direda sentenced Hidalgo to consecutive sentences for aggravated murder and obstruction of justice. When combined, Hidalgo will serve at least 26 years and up to life in prison.

3/23/21 Update: Kenney has been resentenced to 18 months. This will include time served & will be followed by 1 year of parole. She has served 14 months so far. Judge apologizes to Kelsey's family. Judge Scott Sells, who imposed the original sentence, said he disagreed with the court of appeals ruling, though he would follow it. “The court of appeals described the findings I made regarding your involvement when I imposed an aggravated sentence as ‘disconcerting,'" Sells said. “... I strongly disagree with their description of your involvement as ‘disconcerting.’ I find again, as I did at your original sentencing, that your actions were cold, calculating, cruel and devoid of any compassion of human life." "You could have warned her. You could have called law enforcement. You could have prevented the murder & done the right thing," Sells told Kenney at a virtual sentencing hearing. "But you did not." "Your actions were not impulsive. They were not spur of the moment," Sells said. “You had hours & hours & hundreds of miles to do the right thing & you never said a word until you were later confronted by law enforcement.” Colorado Dept. of Corrections tells me Kenney has been released from prison. Her new sentence, given today, was max 18 months plus 1 year parole. She served about 14 months (new sentence started on same date as original - Jan. 28 2020.

3/4/21 Update: Yust’s defense team had filed a motion for a change of judge after they say they received an anonymous letter alleging connections between Judge William Collins and the victims’ families. Collins denied the claims but did ask the state’s high court to appoint a senior judge to hear the motion. There will be no change in judge for Yust’s trial, another judge appointed by the Missouri Supreme Court ruled Wednesday morning. Judge Brandon Baker from Henry County said the defense didn't show enough evidence for a new judge to preside over the case. Judge Baker also ruled Wednesday that defense counsel Collins needs to make a decision on whether or not the case will be moved to St. Charles County. Prosecutor Ben Butler asked to drop 2 counts of abandoning a corpse, a felony, which Judge William Collins granted in proceedings today, March 4. Next motions hearing on 3/5/21. Defendant to appear in person.
3/5/21 Update: Next motions hearing on 3/11/21. 3/11/21 Update: The judge presiding over the Yust trial ruled Thursday that testimony & a wiretap from an ex-girlfriend of Yust can be heard during the trial. Attorneys representing Yust had filed a motion to keep the testimony & wiretap out of the trial, alleging it was coerced. According to prosecutors in 2008, Yust allegedly confessed to his-then girlfriend Katelyn Farris to killing Kara Kopetsky who went missing the previous year. Also on Thursday, attorneys agreed to interview potential jurors in groups of 60 to 80 people at a time. Questionnaires are already out to prospective jurors, with jury selection slated to start March 29 in St. Charles County, outside of St. Louis. Jurors will be brought to Cass County & sequestered throughout the trial, which is expected to last three weeks. Opening statements are set to begin April 5.

*Trial set to begin (@ 9am ET) – OH – Baby Boy Doe (2 mos. or younger) (found May 11, 2017 decomposing in a 1988 Ford Mustang, South Toledo) & Giovanna Gabrielle Cisneros (was Baby Jane Doe) (infant) (found Feb. 10, 2020 decomposing in PT Cruiser which had been towed to police lot) – only for *Jacob Andrew Cisneros (33/now 34) arrested & charged (2/3/20) & arraigned (2/4/20) with involuntary 1st degree manslaughter & endangering children. Those charges were dismissed (on 2/13/20) , indicted (2/13/20), Charged & arraigned (2/19/20) with 2 counts of 1st degree involuntary manslaughter, 2 counts of 3rd degree endangering children, 2 counts of 3rd degree tampering with evidence & 2 counts of 3rd degree obstruction of justice. Plead not guilty. $400K bond. Bond changed (2/19/20) to $1,225,000.
Trial was set to begin on 1/19/21 rescheduled to 3/30/21.

10/27/20 Update: Trial rescheduled at defendant's reuest. Hearing held on 10/27/20. Present: Assistant DA Frank Spryszak, Peter G. Boyer on behalf of defendant & defendant. Motion granted pursuant to the request of defendant to continue trial date. Trial has been rescheduled to 1/19/21 @ 9am.
1/19/21 Update: Judge Linda Jennings; Asst. Prosecutor Frank Spryszak by video, Peter G. Boyer by video on behalf of defendant & defendant present by video Motion granted purusant to the request of defendant to continue trial date. Trial date rescheduled for 3/30/21 @ 9am. Bond continued at S/or with electronic monitoring.
*Jenna Nicole Cisneros (34) – 8/17/20: Plead no contest. Sentenced on 9/9/20: 10 years in prison as to Count 1; 30 months in prison as to Count 3; 30 months in prison as to Count 4; 10 years in prison as to Count 5; 30 months in prison as to Count 7; and 30 months in prison as to Count 8. The sentences in Counts 3 & 4 are ordered to be served concurrently to each other.
