So the mom (according to the cps affidavit) has no criminal history-nor does the bio father. This poor baby is simply a victim of horrible parenting. There are no (known) "excuses" i.e. drugs that the parents can blame this on. Not that drug abuse would make it any better. They are just shi**y parents.:furious: I hope they if either of them ever decides to breed again that those babies are removed immediately.
FWIW- I really think everyone here who still has questions about the exact things that went on should read the affidavit again-it pretty much lays it all out.

I think that Froggy posted that LE had talked to the mom and she refused to come in?? That would mean that she is ok. Did I misunderstand that information??

Thanks for the legal docs MS POOH. That poor child. I think she will probably feel she is in heaven if they place her in a good foster home. Three meals a day, bathes, clean clothes, other kids to play with...doesn't sound like she ever has experinced the simple things iin life we take for granted that all kids need. Poor, poor child.

The apartment is currrently leased to ***************, he was not there when LE responded.
On Oct.8, worker spoke to *********** by phone, he stated a note was found at his residence and he was inquiring as to what was goin on, he was in jaill at the time this went on....

The real father knew the mother often left the baby with people she didn't really know well. The baby was crying for mommy and daddy up to two days. This lists out multiple injuries on the child. Says the same as posted below about waterbottle, blanket and pillow found in the closet, a gun found in the house and the child was in the bathroom for two days or so while the man of the house was in jail and no mention that I saw of where the mother was. Apparently the child was injured previously and not taken to the hospital for fear of getting into trouble. The father started to get custody of the child, but never finished the process.

Dad CANT have her because he was supposed to pursue getting full custody but didn't AND he handed her over to Mom even though he knew there was a history of abuse/neglect.

Maybe he ran out of money. Custody is very costly. I can't fault him until I know why he stopped his pursuit.

Oh, I'm not faulting him for not legally pursuing full custody-but if you're court ordered to get take full custody because Mom is neglectful and you in turn hand the baby back to Mom-then I may have a different opinion.

Missy, that's the way I read it. The court wanted the little girl to live with her father and not with her mother. They didn't say he could keep her only if he went through the entire custody process. He should never have turned the child back over to the mother.

Officers found her at a Robstown hotel with her boyfriend. Mendietta is being held on theft charges out of San Patricio County. She's also expected to be charged with child endangerment, injury to a child and unlawful restraint. She is currently being held at the Nueces County Jail.

Well, it is good to know she is in custody. Too bad they can't keep her long enough to give her a hysterectomy. I don't see much jail time in her future, though. They will probably just slap her on the wrist and she will either get her daughter back eventually or just have more kids. Sad, sad, sad.
