He may very well get off scot-free because of your exact reasoning. If that happens, there is something seriously wrong in our society when a cop trespasses, lurks, and frightens a homeowner and then shoots and kills them when they merely try to protect themselves from the trespasser, which they have every legal right to do.
If she had shot him she would’ve had every right to do so as well. Because she had every reason to think it was a burglar. However, he wasn’t trespassing. If this was an actual burglary in progress she would’ve wanted him there doing exactly what he was doing. He was responding to a burglary in progress call. He didn’t announce himself per general protocol for a burglary in progress. He had a good faith basis for being there - investigating. It was a terrible sequence of events. But he did not murder her and he wasn’t reckless.
Had she shot him, she'd more than likely be in jail right now. She did not know he was a police officer. Since he didn't ID himself she knew him as a trespasser. End of. The responsibility for this terrible sequence of events lies with Dean and only Dean. If it is true that this is police "general protocol", then whoever came up with this horse#%^ general protocol is at fault as well.
