Witness: unfortunately he didn't have any medical records [corresponding to head circumference, etc]

"Brain abnormalities potentially consistent with FASD."

Ugh.

Anyone think the state will call any rebuttal witnesses?

With all due respect, TH was borderline for many of his disgnoses, and significant in some.

He had challenges, no one disputes that.

But Fed Ex hired him to cover packages. That's all. Drive to, drop off, leave. They'd the job and he had one job to do.

And he failed at it because he chose to take advantage of his driveway access to little girls.

I'm really sick of experts giddy to apply diagnoses and theories to TH as if they excuse his choices. Explain, sure, but excuse?

Let me know when someone testifies to his deviant sexual arousal.

He knew it was wrong with the brain he has.

The court reporter isn't the only one having trouble with umderstanding this witness.

Testifying he thinks people will take advantage of TH in prison.

Yeah, no. IMO he'll be in segregated, protected custody as long as he lives.
Segregation, protective custody, general pop, or death row....there is no safe place in prison. Wherever he is housed, he'll be catastrophizing daily until the bitter end.

I hope so. But TH's own testimony, as captured on truck video/audio, says entities this jury needs to know.

Expert diagnosed TH with 'moderate brain dysfunction'.

Like a lot of people IMO.

Fellow WS's, I got very far behind in this thread. I stepped away when it got difficult to handle and am suddenly way behind.

What is happening? Witnesses to help determine his sentencing? Is the defense trying to show he has different diagnoses besides alleged autism (which I find irrelevant)? What are they trying to get him sentence-wise and what's the maximum he can get? Thanks.

The jury is tasked with determining his sentence-- either LWOP or DP.

The Defense is trying to stack the deck with diagnoses to guilt the jury IMO into not giving the DP to a "vulnerable adult" like someone with severe schizophrenia or very limited IQ, never mind that he fits neither of those two exempted classes.

WFAA talking about the inmate testifying as a character witness for TH…..never seen anything like it. Reporter said a few of the jurors were trying to hold back laughing.

Sounds like they decided to put this inmate on instead of his brother.

Thanks. I agree he doesn't fit those descriptions. Glad he'll get at least LWOP.

State elicits from the expert that TH does not have FAS, does not have severe brain dysfunction. [And one other that I missed.]
