Tanner Horner, the FedEx driver accused of kidnapping and killing 7-year-old North Texas girl Athena Strand, appeared in a Tarrant County criminal court Tuesday as the jury selection process continues for his upcoming capital murder trial. Horner’s attorneys and a team of prosecutors with the Wise County District Attorney’s Office conducted one-on-one interviews with prospective jurors on their fitness to serve.

About 57 individuals out of a pool of 300 were omitted Jan. 29 after indicating they’d already made up their minds about Horner’s innocence or guilt. The 243 who made the cut filled out an 18-page questionnaire, which attorneys used Tuesday as the basis for their examination.

This phase of the selection process is expected to take several days. Presiding Judge George Gallagher said they will narrow down the jury pool to around 55 people, who will return March 31 for the final selection.

So - since they said "several days" for jury selection - I updated my notes. Guessing that they are still going on....

Thursday, February 12th:

Reported missing by mom @ 6:40pm on 11/30/22; found deceased along the water’s edge of the Trinity River southeast of Boyd on the evening of Dec. 2, 2022 about 9 miles from her home). *Tanner Lynn Horner (31/now 34) arrested (12/3/22), indicted (2/16/23), charged & arraigned (3/6/23) with capital murder (under the age of 10) & 1st degree felon aggravated kidnapping. Bond $1M (murder) $500K (kidnapping). Surety Bond total $1,545,000. Plead not guilty (3/6/23). DA will seek DP (2/18/23). Wise County/Now in 297th District Court-Tarrant County

1/30/26 Friday, Jury Selection continue begins [Day 2]. Individual interviews will be conducted with prospective jurors staring on 2/10/26 ahead of the April 7 trial date. No info – moving to Jury Selection hearing on 2/10/26 @ 9am.

Well - finding absolutely nothing in articles...

Do you all think jury has been picked yet? Day 6 was Friday. Should I move it to Tuesday, 2/17 as Monday is a Holiday? ?? 😕

Thank you! Wondering if there will be a Final jury selection on 3/31/26 as they mentioned before though. I just went through 25 pages of searches & most just say "Jury selection begins".... nothing on that they have been selected. :(

I will put him on 3/31/26 & keep looking thru March.

edited to add - I see I have trial beginning on 4/7/26 - so now wondering if the final jury selection is going to be on 4/1. Okay - putting him on 4/1 for final jury selection. LOL! :D

NO new reporting thus far in March that I can find.
As for a trial live stream, that's anyone's guess. I do recall a few live streamed trials in Texas, but not many compared to other states, IMO. Would love to know the answer myself.

I have in my notes that final jury selection is supposed to be on 4/1/26 & trial starts 4/7/26.
There were 4 days of preliminary jury selection which ended on 2/11/26.

Don't know about live streaming....

In a motion filed last week, the office of the regional public defender for capital cases asked Judge George Gallagher to order that experts refrain from using two terms, psychopath and sociopath, in reference to the defendant, Tanner Horner, who is accused of killing Athena Strand inside his FedEx truck in Wise County. The motion asks Judge Gallagher to exclude in the punishment phase “any and all psychiatric or psychological expert testimony offered by the state that incorporates a prediction” on whether Horner is a future danger or will constitute a continuing threat to society, attorneys Susan Anderson and Steven Goble wrote in the motion. Future dangerousness is one of two questions at the core of sentencing in death penalty cases.

Wise County Criminal District Attorney’s Office prosecutors are themselves hoping to limit possible evidence. In a motion, the state requested an order directing defense attorneys not to mention in the trial’s guilt-innocence phase that Horner has Asperger’s, autism, bipolar or multiple personality disorder, and not to refer to a civil settlement of a lawsuit Athena’s parents reached with FedEx. Judge Gallagher has not ruled on the motions.

Jury selection in the case was finalized on Monday. Opening statements are scheduled for April 7.

I recall the early days of this case. I followed it so frantically and wrongly believed a family member was responsible. We were all so relieved when the Fedex guy was caught. This is one trial I'd love to see streamed.

Authorities said Horner told investigators he accidentally hit the little girl with his truck while delivering a package to her home. She reportedly survived, but Horner told authorities he panicked and kidnapped her, later killing her.

In December, Horner’s defense team asked the judge to throw out all of those police interviews because of a possible violation of his Miranda Rights.

In January, his attorneys filed 28 additional motions, including one to preclude the death penalty because they claim Horner has autism.

The trial was also moved to Tarrant County because defense attorneys successfully argued Horner wouldn’t get a fair trial in Wise County, given the extensive media coverage of the case.
