FORT WORTH, Texas — Two months after Tanner Horner was arrested for the kidnapping and murder of 7-year-old Athena Strand, a woman came forward to police, alleging that he sexually assaulted her when she was 16-years-old.

According to an arrest affidavit obtained by WFAA Wednesday, a woman told police that Horner sexually assaulted her when she was 16 years old and that messages reveal Horner was aware of her age at the time of the assault.

The Tarrant County District Attorney's Office chose not to prosecute Horner for the sex assault crimes while he is being tried for the death penalty in the case of Athena Strand.

I do believe Horner sexually assaulted Athena. Like so many predators he’s lining up all the reasons why he murdered an innocent child that we’re supposed swallow like DID or PTSD but even he knows there’s a step beyond what society will accept in murder cases. He’s working hard to skirt the real reason he abducted and murdered Athena. IMO it was sexual gratification front and center mixed with the thrill of watching her life drain away.

Sorry to be so graphic but it is what it is. He needs to forfeit his miserable life so that Athena’s family can rest assured that he’ll never harm another child again. JMO

Reported missing by mom @ 6:40pm on 11/30/22; found deceased along the water’s edge of the Trinity River southeast of Boyd on the evening of Dec. 2, 2022 about 9 miles from her home). *Tanner Lynn Horner (31/now 34) arrested (12/3/22), indicted (2/16/23), charged & arraigned (3/6/23) with capital murder (under the age of 10) & 1st degree felon aggravated kidnapping. Bond $1M (murder) $500K (kidnapping). Surety Bond total $1,545,000. Plead not guilty (3/6/23). DA will seek DP (2/18/23). Wise County/Now in 297th District Court-Tarrant County
Admitted kidnapping & killing Athena.
Jury selection began on 1/30/26 & ended on 2/11/26. Final jury selection began on 4/1/26 & ended. 12 jurors & 2 alternates.

Jury shown body cam footage of 3rd interview at Sheriff’s office & video (2 hours) on 12/7/2022, it was 5 days after Athena has been found. Horner asked to speak with Espinoza to “cut a deal” [with Investigator Albert. Deal that he is on GPS for a month so he can spend Christmas with his GF & son & he would fully cooperate] & various other videos.
