That’s how it should be and sounds like good reason why CPS should fall under LE agency and not family services which has been mentioned on another thread.Dang when we filed a petition asking for our grandson to be declared a CINC and to be permanently legally be with us. We already had , had him almost 2 years but had no legal rights if his mother wanted drug money etc. she would threaten to take him every time she was mad. We couldn’t risk that. Anyway CPS was never involved . However we got a lawyer we were required to hire a lawyer to represent the child.
The lawyer for the child came to our house a few times some unannounced. To “visit with the baby” she checked our house which I didn’t expect. But I was glad it meant they were doing the best for him. She even looked through his living space (room) checked out his crib. Opened drawers to see his clothing. Even looked at his toys. Made comments about “learning toys” and age geared toys. Noted they were clean and safe . She even commented that she was very impressed that he had a book shelf with toddler aimed books. clothing for all seasons. She looked briefly in our daughters room. She checked for child locks etc. we have a tall gate mounted to keep the kitchen off limits. But she noted healthy snacks clean kitchen house smoke alarms etc.
We even had to pay for back ground checks. They checked our finances to show that we could afford the child ( not a cps case so no state aide for his care). They asked permission to visit with our dr to make sure we were healthy enough to take on a young child. They visited with our remaining child at home’s pediatrician and even her school. To verify with the dr she had been seen regularly if there were concerns ever. Checked if the school had concerns and her attendance history. Credit checks. We were told we needed drug tests but I have a CDL and had just had one recently. My husband had one for his job just weeks before. But they straight up told us if we would of waited for cps to take him and then do a family placement we wouldn’t of been put through half of this stuff. It honestly was totally overwhelming to be put under basically a microscope. This was all just done by the child’s lawyer to show what was his best interest. I was mind blown that cps wouldn’t of done much more then a walkthrough but often if it’s family they fail to do that.
This totally blows my mind after all we went through that more wasn’t done for the baby.
