Fist bump for Christina. ❤️

I feel like with spring being here and people being more active, she will be found soon. I hope. I know EA was a lazy 🤬🤬🤬 about it. Surely, she will be found soon.

Praying for Christina and all other loved ones.

New docket entries (Collin County Court Records) from yesterday:

Defendant's Motion For Restrictive and Protective Order
Defendant's Motion For Certification by the State Of Texas of Compliance with Article 39.14 of the Texas Code of Criminal Procedure

Wonder who he's seeking the restrictive and protective order from...

I will take a stab at this. Perhaps EA is trying to protect himself from some part of the discovery process.

I do not know what this means or how it applies, FWIW.

Article 39.14 of the Texas Code of Criminal Procedure

New criminal case discovery standards put into effect January 1, 2014.

It looks like it's just normal discovery kind of things to me?

Yep. Normal process being played out, and shouldn't read much into the details of the process as we move to trial.

I don't see where a restrictive and protective order comes into play under this 39.14. Is it something different? Is EA filing a protective order against someone?

Please tell us what happened, Enrique!

I think there must be more info than has been released to be able state "intent to violate or sexual abuse" as a charge. What am I missing? All that we know to suggest this could be the case is the testimony of the party goers that he left angry and sexual frustrated. Correct?!

One possibility is that the "unknown male DNA sample could be in the form if DNA typically associated with SA un kidnapping cases. We don't know the results of the test or what it was. I don't think LE makes statements where there is no evidence pointing in that direction. That would sink their case for sure.

  • #672
I have sometimes wondered if the unknown male DNA could relate to EA but not actually be his DNA.

  • #673
From what I've gathered, the consensus is the unknown male DNA is EA's because they didn't have his sample until he went to the hoosegow. MOO

I googled this. If I understand 39.14 correctly, it orders the state to produce all documents, photos, etc. related to the case to be inspected and or copied on behalf of the defendent.

We've pretty much gathered that. What does the restrictive and protective order mean? SteveS, you're the go to guy. What say you?

I believe it has something to do with limiting certain evidence, witnesses, discovery, or testimony. SteveS?

Where are you Steve?

With names & identifying info redacted, if I understood it correctly. (The comments under the 1st link I posted above discussed this in part. Alas, most was beyond my knowledge of Texas criminal law procedure.)

BUT... Are these 2 completely separate and unrelated docket items?

The Motion for Protective and Restrictive Order may have nothing whatsoever to do with the 39.14 compliance certification motion. It could be an order of protection vs the picketers or someone else harassing EA.

My understanding is that the picketers are well within their rights, to do what they are doing & in the manner that they are doing it.. and the only ones that could be harassing EA are in jail with him.. JMO

I totally agree they are well within their right to picket. I am wondering if that's not why he is seeking a restraining order. It could very well be someone harrassing him from the jail. We don't know, that's why I'm "wondering."

Wish SteveS was here to set us straight with the law.
