Police are also looking for three suspects they believe to be with the baby.

According to APD, after checking into a local hospital under a false name, 30-year-old Brittany Sadi Smith gave birth to Elijah on Friday, July 19th.

On Wednesday, July 24th, Child Protective Investigations received a court order for Elijah to be removed from the mother’s custody and placed into theirs.

Currently, police are looking for Smith, Gilbert, as well as the baby's father, 37-year-old Carl Dennis Hayden Jr.

They are believed to be in the Austin or Killeen area, possibly with Elijah.

This is probably why DFS was taking the baby... or something related to it. It is from 2013.

Typically, they do not keep a baby in the hospital that long, unless there were health issues at the time of birth, do they?
You used to get eased into motherhood with a 3 day stay or so, but now you usually get kicked out the next morning. At least in my experiences.
Also, this baby is likely to be darker in color than the photos show. African American babies skin will darken in the following weeks after birth.

Month-old baby found safely after Amber Alert in Austin; family member arrested
The Amber Alert issued for a missing baby boy in Austin was canceled Monday night after the infant was found safe, Austin police said.

Police said Brandy Galbert, who may be related to the baby’s mother, was arrested. Police were still looking for the boy’s mother — 30-year-old Brittany Smith.

Police are also looking for the child’s father, Carl Hayden. Hayden is black, 37-years-old, 5’10” and 125 lbs. with black hair and brown eyes.

Police: Austin mother lied about giving birth to keep baby from CPS
  • Court documents say Smith checked into Seton Northwest Hospital on July 19 using her cousin Brandy Galbert's name. An affidavit said Smith was with the child's father at the time, who also provided a fake name.
  • Three days after Elijah was born, the real Galbert came to the hospital and was introduced to staff there as Smith's sister. Smith requested staff to release the baby to Galbert and they did.
  • The day after Elijah left the hospital, CPS visited following an anonymous tip. CPS said Smith has a history with them for parental termination related to neglect and abuse of her previous children.
  • Four of her kids live with her ex-boyfriend, JB.
  • The affidavit states when an investigator visited Smith at the hospital, she again gave them Galbert’s name and checked out against medical advice.
  • CPS was granted an order for temporary custody of baby Elijah on July 24.
  • A CPS investigator found Galbert at her home in Killeen two days later. Galbert told CPS Elijah was her child, and would not reveal where he was.
  • On August 6, Smith was ordered to appear in court and turn over custody of Elijah. At that time, Smith testified she never gave birth to him. That's when Austin police got involved to help locate Elijah.
  • Sperm donor and recipient are still on the loose.

Noting: Carl Hayden used the name "Dennis Thompson" at the hospital.

On Aug. 6, Smith, Hayden and Galbert were ordered to appear in court.
  • Smith denied giving birth to the baby and claimed there was no baby.
  • Hayden said he didn’t know where the baby was or who might have him.
  • Galbert did not show up for the hearing.
Family members said Galbert brought the baby to the Safe Alliance shelter in southeast Austin Monday evening and was taken into custody after the shelter called APD.

Galbert was booked into the Travis County jail on a $5,000 bond and is facing felony interference in the custody of a child. By Tuesday morning, she had bonded out.

What the heck were they planning on doing with that poor baby? This makes me so sad. Even though the baby has been found, I'm sure he not getting the love and care he desires, and even if someone would be willing to adopt him, I'm sure the parents will fight for custody and draw out the process indefinitely. Heartbreaking.
