Harris County's 14th Court of Appeals denied AY's appeal today!

AY comes up for parole on 10/29 of THIS YEAR!! I'll try to get the address / information for anyone who wants to share their thoughts on this with the parole board.

How can she possibly be up for parole that soon? That isn't even half-time. I thought Texas was tougher than that.
 
Oh God. Reading the decision brings it all back. May she never, ever know a day's peace. Ever.
 
AY's attorney's based their appeal on - insufficient evidence to prove beyond a reasonable doubt, and they wanted a CPS psychologist who evaluated Coe twice before Emma was murdered to testify but the judge didn't allow it.

Young's attorneys claimed that testimony would have shown Coe "was capable of maintaining a facade of non-threatening behavior around children."

The appeals court said there was sufficient evidence to find Young guilty even if that testimony had been allowed.

"Appellant had her day in court," according to the opinion.

"The elements of the offense were the same on the day she was convicted as they were when the crime was committed. "In addition, on appeal, we have determined that the evidence is sufficient to support her conviction."


The jury acquitted her of intentionally causing serious bodily injury to Emma, something that still chaps my hide - I still believe AY chose to over look the injuries Coe had been inflicting on her baby for weeks (such as the active herpes virus our poor girl was suffering from) seeing their basis for appeal just makes me angry all over again.

Young's first parole review with the State of Texas Pardons & Parole Board (STPPB) is scheduled for 8-16-12.

That is 25 mos, 4 days after her conviction.

TX has a formula they use to determine parole. I found this shortly after the trial and calculated her parole date back then. I wonder if the jury was aware of this when they tossed out the charges that would have gotten her Life w/o parole, instead finding her guilty by omission (what a farce). 5 to 20 years.

Amanda, Emma Thompson's maternal aunt, sought justice for Emma. Today she called (a friend of mine) to advise her that she and others did not receive notification about Abigail Young's upcoming parole hearing until today. Some one dropped the ball!

Being that Amanda is Emma's maternal aunt, she plans to appear in front of the Parole Board to object to her sister, Abigail Young's parole. She also will write a letter opposing Abigail Young's parole.

Amanda is asking all who support justice for Emma to please write a letter to the Parole Board stating you oppose parole for Abigail Young.

Amanda provided the following info so you can either type or hand write a letter.

For your info, on 7-12-10, Abigail Young was found guilty of causing injury to a child by omission, but the jury found that she did so recklessly rather than knowingly and intentionally. Unfortunately, it was the lesser charge.

On 7-13-10, Abigail Young was sentenced to 20 years in prison. She was taken into custody after sentencing.

Abigail Young has served 1 year and 7 months (19 months) of her 20 year (240 months) sentence.

Young has appealed her case and the Fourteenth Court of Appeals denied her appeal. Abigail Young did not make a statement of remorse for Emma's death when she had the opportunity at sentencing.

For those of you that do not know me I am Amanda, Emma's maternal aunt! I have fought hard for justice for my beautiful Emma since she was taken away from us by the hands of Lucas Coe while my very own sister Abigail Young sat by and did not protect her! 20 years was her sentence and as Ann said above this is 240 months...

Abigail Young has never once admitted she did wrong! Abigail Young has served only 17 months of her punishment for her crime and she continues to make it all about her innocence and finding a pardon, a retrial, or appeal! Her appeal was denied! She was rightfully convicted by a jury of 12 of her peers! So why such little time for A horrific crime on a beautiful sweet little girl that had her whole life ahead of her! This just shows what our tax dollars are going to! Our Justice system is so screwed up! Abigail has to be remorseful in order to rehabilitate! She has no remorse so therefore she should not be forgiven nor released this soon! Please if you feel like I do about this send a letter! And please send it quickly! Thank you RC for always keeping her thread up and for always seeking justice for my sweet little Emma!
 
Great news! KBTX (CBS) - Bryan will run a story about Abigail Young's parole on the 6 PM CST News tonight.

Today the reporter interviewed Amanda, Emma's maternal aunt, and two now former friends and next door neighbors of Abigail Young's for their report. The two neighbors testified for the Prosecution in the trials of Abigail Young and Lucas Coe as well as the Child Custody case regarding Abigail Young and her two other children.

KBTX plans to run the story about Young's parole tonight. Hopefully, they will post an article with a video clip later tonight on their website.

Thank you LCoastMom! I am so sick at the thought of Abigail getting out so soon! Poor Emma suffered so greatly and her "gifted nurse" momster was well aware of how she got the herpes as well as all the other injuries. She did nothing to protect that poor baby! She needs to be locked away for life but at the minimum she should serve her entire sentence! Please everyone email or fax the board in Texas to not let this monster out!!!!

I can honestly tell you that I have never cried this much about a case before, and felt utter disgust and physical illness on so many levels. Being a parent to a beautiful 2 year old daughter and reading what I 'stumbled upon' about the horrible life and death of this beautiful little girl still brings tears. I sent an email protesting the parole of AY. That baby deserved hugs, love, and to be absolutely CHERISHED as should all children. The only Solace is knowing that she can't be hurt anymore. Ahh poor sweet baby, must stop now before tears come.

I am writing to protest the parole of Abigail Young. Abigail Young did more than fail her precious daughter Emma. She did more than FAIL to prevent serious injury. Abigail Young put her own selfish needs ahead of the well being of poor little Emma. She allowed her daughter to be raped and beaten by a monster. As a nurse she knew well how genital herpes is spread. And after Abigail contracted herpes from Lucas Ruric Coe, I am quite sure she knew well where her daughter got herpes. She chose to ignore it. She chose to allow Emma to continue to be abused, until ultimately her life was taken. Imagine that tiny 4 year old body with over 80 bruises, skull fractures and vaginal tearing. Imagine how she suffered, right under the nose of the one person who should have protected her! Imagine her with no one to comfort her in that pain! Abigail Young was a Registered Nurse. She had a duty to protect her daughter. As a nurse she would have a duty to protect any victim of abuse. Instead she sat by. In her silence she was complicit with the grievous acts committed against her innocent daughter. Please do NOT deny justice to Emma Catherine Grace Thompson. Allowing Abigail Young parole is denying justice to Emma. Abigail Young should serve EVERY day of the 20 year sentence handed to her by the jury. There are few crimes more heinous in my opinion as the one of fillicide. One of the facets of this case that makes it more sickening and more surreal is that Abigail served Emma up to Coe on a silver platter. She used her position as a registered nurse to intentionally mislead mandatory reporters. She deliberately witheld information from state investigators and she obstructed the investigation into her daughter's murder by not only cleaning the crime scene, but also by giving the murderer the opportunity to flee. And flee with his incredibly at risk toddler child.

Rather than taking adequate responsibility for her role in the murder and the cover up of her daughter's murder, she has taken a position that there is insufficient evidence to convict her of the crime she is serving time for. It defies reason that this woman was spared a first degree murder charge. For her to deny her role in this sickening crime is a betrayal to all who loved and lost little Emma.

Abigail had choices. She had choices every step of the way. She chose to give her child to someone she knew was a monster. A monster on all levels. How frightened Emma must have been. How she suffered. She had others who loved her and who will live forever with the knowledge that this love couldnt save her. That the person who was responsible for protecting her abdicated that responsibility.

Abigail is a pariah, sure. But her time should be time served in the truest sense of the word. No breaks. No time for good behavior. Emma didnt receive any breaks. Emma didnt get time off for her good behavior. What Emma suffered should be enough, alone, to deny any request for clemency.

This has to be one of the most horrific crimes I've ever followed. Just unbelievable that a mother would allow her child to be abused this way, a nurse no less. I wish she had gotten life W/O parole.

It was horrible hearing about AY's behavior during the trial, it was even worse getting this letter today from the young man who was there and a witness to her total lack of interest in her daughter's brutalized body. UGH!!!

It feels like we were just following this trial a short time ago! The parole hearing sure got here too quick. I'd like to think that AY has suffered every minute of every day but I don't believe it. I'm sure she adapted quite well to life on the inside and she still has the support of Marjorie so her life will go on, probably quite well. Yes, she's lost the Thompson's and she's lost her sister. I'm pretty sure in her mind that's no big deal. She lost her two remaining kids, but eh, kids weren't really a part of her new lifestyle anyway so if "mummy" can just make that felony conviction disappear AY's life may just go on just fine! :banghead: :banghead:
