Apparently, it will be up to the jury to decide if the "Mistake of Fact" defense is "reasonable".

Guyger's attorneys are going to have to prove to the jury, that the "Mistake" of AG thinking she was in her apartment, is "reasonable".

Let's say the defense convinces the jury that her going into the wrong apartment was a reasonable mistake. Winning that battle isn't going to win the war. They still have to convince them that what she did after she entered that apartment was reasonable.

Did she have to shoot and kill him? I wonder how they're going to convince the jury that shooting and killing him was a reasonable action that she had to take.

Well we made it through Friday without a postponement. It COULD still happen Monday, but the odds are of that are slim. It is likely that trial will occur as scheduled. I hope the city is ready and able to manage everything at once.

Didn't someone explain a while ago that if she could show a mistake of fact, then the castle doctrine would apply ie. she could shoot whatever 'intuder' into 'her' apartment?

I'd better listen to some of those podcasts before trial beginso_O
