Def. OS: [In a report of people who lived at Southside flats] 93 tenants had unintentionally parked on the wrong floor. 71 of those lived on the 3rd or 4th floor. There is no number posted on the entrance to the hallway. You'd have to go over to the elevator and look for the number. Most people don't do that. ... the higher you go the more confusing it is.

46 tenants had gone to the wrong apartment and placed their key in the door. (My comment: He then changed it to 38 tenants in the next sentence, but did not imply he made a mistake. He seemed to not realize he said different numbers, or I heard it wrong.)

(My comment: he didn't say whether it was people who had ever lived there, or people who lived there at the time, or people who lived there at some later date of the study)

The texts were deleted off of her phone within a day or two, but they were able to preserve some information because LEOs acted so quickly to get them.

That's obstruction. Wonder why she wasn't charged with that.

CourtTV posted this 1:02 minutes short clip of Prosecution's opening summary:

Twitter

"Amber Guyger made a series of unreasonable errors and unreasonable decisions and unreasonable choices."

Unreasonable error - not looking at the signs, no red mat, walking past 16 doors.

Unreasonable decisions - pulling the gun out and shooting with no conviction what so ever.

Unreasonable choices - not/continuing to render aid.

Prosecution and defense describe the signage and atmosphere indicating different floors in the parking garage very, very differently. I hope we get to see photos, and I hope they actually take the jury to that parking garage. JMO.

So far, I'm not impressed. Seems they are claiming she was "tense" & "on alert" because of her job. moo

Nobody's mentioned a dog! Who had a dog? Wiw

Amber supposedly had a dog. I'm not sure if it's ever been confirmed or not. It's been mentioned several times as yet another thing she should have noticed absent when she entered the apartment.

How do you miss the fact that the floor you parked on is open to the sky, whereas the floor you normally park on isn't?

She's obviously not claustrophobic and terrified of parking garages! I'd never be able to fail to notice that fact.

I thought it was pretty powerful. I was young once. I know how important a booty call can be, but damn... We'll see what the defense throws against the wall, but at this point, I think she is screwed.

I agree, a booty call is fine, I don't care what she does in her downtime. But when you decide to wear a badge and carry a gun... you have certain responsibilities.

One of those is to ensure you act responsibly with that weapon. Your booty call is not more important than Botham's (or anyone else's) life.

So, she should have gotten out of her uniform and gear. Then if she wanted to be oblivious to the world, fine. Whatever. Just put your weapon away first so you don't kill anyone.

If you are THAT distracted by being horny... that's probably also a problem that needs to be addressed. What if she'd been serving a warrant? She could have gotten her fellow officers killed.

She had something else (that I can’t say)
on her mind is the bottom line .
And so for her to save her own skin
she blames this on
1)exhaustion from work
2)Bo not following commands

I do pray the jury sees straight thru this
JMO

It could definitely be due to exhaustion from work. But then she had an even higher duty of care when carrying a loaded weapon. Not being cautious, ensuring she knows where she is and who she's aiming at and why, that's at least negligence IMO.

Also, the defense is somewhat lying about the numbers not being posted in certain areas and it’s bothering me. I pray that the state has those, because I’m almost certain he’s lying about that and the state needs to expose that lie. I’ve seen video from residents and a news station showing that.

WHAT?! Crap. I didn't get an alert there was a verdict.

Def. OS: What was going through AG's mind was 'I am going home.' When she left work, she went into auto-pilot.
...
SG sees a spot, and she can't believe it is right by the entrance [to her floor.] She backs into the spot, it's facing the entryway. She didn't walk over here to see what floor she was on. She didn't do a 360 scan to see the skyline. She just knows everything looks the same; this is my floor. Just like 93 other people had done.

@Rocco - huge apology to you from me on BJ possibly being in movement. I am so pleased though that we are all getting some actual FACTS.

So he was sitting down when are aimed at him? Whoa.

Def. atty is now describing where the door numbers are in the hallway. Points out that she is 5'3".

Amber owned a dog and we'd asked why she didn't react to the dog not greeting her. Turns out the dog had been left with a relative (per Defense OS).

Def. OS: She's going home, she's worked a long day, she's tired...the doors are the same, the lights are the same, and she gets to 1478.

He then describes how the door has a fault when it is humid that it bulges out...I missed the relevant words. But he says the jury needed to know that was an important difference of 1478's door where it sometimes doesn't latch all the way shut.

Yeah, I think if they can prove that she wasn’t tired and missed all those things. She’s done. Defense has to come out swinging because I don’t think there is a reason at the end of the day that she should get off for not recognizing where she was at, at that time. She still has to know exactly what’s going on in her surrounding regardless of her being tired or distracted by something else.

For me that's the bottom line. She's LE. And she carries a loaded weapon. She's not a college kid who can afford to be careless.

And if she shot at him while he was sitting down that's reckless as hell to me.

  • #239
And they realized that the lock blinking red I’m sure .. Again another missed opportunity.

  • #240
She didn't look down at the floor mat. It's reasonable to say that if she looked down at the floor mat she would've said 'huh?' and looked up at the numbers. To say otherwise is preposterous. But AG was in auto-pilot.
...The door was open, and it was strange because normally you would have to turn the handle.
