He didn't sound very confident
Very disappointed in state closing...he is not the member of the team that did the cross of Amber or that has passion for this case. Very disappointed...it seems both state and defense are trying to scare the jury into a verdict rather than rationally going over the case...defense doing better than state so far.

Prosecutor: You are the voice of the community. Your home is supposed to be your sanctuary. You can't have people coming in and killing homeowners. It can't happen. There have to be consequences

State points out that the bullet that went through the wall could have killed someone outside and THAT may have been manslaughter, but this was murder. She went in there "guns blazing".

Good argument.

I thought the prosecutor did great. I also liked his demeanor. He didn't rub me the wrong way at all.

I didn’t like the prosecutor’s tone. Get Hermus! This guy doesn’t sound convicted himself. He’s conceding there are problems with the state’s case - he told them there’s nothing he can do if they believe it’s recklessness. WTH? What kind of argument is that?

He did? Ugh. That's bad.

Exactly. Letting AG off the hook will set a terrible precedent.

That judge isn't corrupt. I don't believe there's any fix with her. I guess it's just TX law. If she made a reasonable mistake the doctrine would come in.
Sorry, but with me, this logic does not compute. I hope the jury thinks the same.

Well Shook is coming off much better! He knows the law is on his side. He’s calling the prosecution to task. They have the burden and they didn’t open well with that closing. Hopefully Hermus brings it on home with his rebuttal.

This is a complex and subtle case, now made even more so by the applicability of the Castle Doctrine. No outcome will surprise me really. I hope she gets charged with something and does some time, but I really don't have any hope.

I'm not an expert. But it might have to do with the fact she wasn't charged in relation to that.

Can we pause to talk about all these ppl going to the wrong floor and apt? What’s going on? I’ve never done that. Defense made a strong point just now with the number of ppl doing that. Almost a 100 between the 3rd and 4th floors.

And I can understand why people would erupt in despair and rage if she gets off. There is no equivocation. Here was an honorable man. A man of God. Innocent totally. No criminal record. No argument that he was reaching for a gun or looked like a suspect or resisted arrest.

He was in his castle. And was shot dead for no reason. By someone hired to protect people like him. Failure to impose a consequence for that means no one is safe. Any cop could murder you and claim it was an accident.

BTW? The Castle Doctrine appears to hold that an intruder in your home constitutes a threat of harm just because they're there. They don't have to rush at you or have a weapon or say anything to be considered a threat. TX law allows you to kill them without provocation. Then being there is the provocation.

It's not logic. It's the law. The judge applied the law. That's not corruption.

I think they all had their faces in their phones. None of them got into so much as a verbal confrontation with the apartment tenant. One even stopped because her doormat missing. A bust for the defense.
