TX - Former NFL Antonio Armstrong & wife Dawn, both 42, fatally shot, Houston, *son charged* 29 Jul 2016 *Mistrials, 3rd trial in 2023 Guilty*

You have to feel sorry for Josh, don't you. And it seems that his mental health only took a dive after the killings, so I don't understand why some folk seem to think that makes him a suspect.

After a break, Winston continued her testimony with defense attorney Chris Collings discussing the fire AJ set inside the home.

“Antonio [Sr.] was the one who put the fire out, and we had bible study that night,” she told him.

When asked if AJ was punished for the fire, she said, “He wasn’t punished for it.”

Collings asked her if she knew about the gun being fired in AJ’s room and if AJ was punished for it. She replied, “No he was not.”

They then talked about the night of the murders. Winston sat with daughter Kayra in the police car that night. [...]

The next witness called was Antonio Armstrong Jr.’s defense and pass coach Theadis Reagins.

He was called as a character witness.

While at Lamar High School, AJ played as a wide receiver and defensive back.

Reagins testified about the father and son interactions.

“I witnessed him being very respectful to his parents,” Reagins said.

Aug. 11 -12:48 p.m.

Houston Dr. Mark Moeller, a clinical psychiatrist and forensic psychiatrist, was called to testify about Josh Armstrong’s medical records.

Before they could get into the records, the judge called a lunch break.

Court will resume at 1:45 p.m.

Aug. 11 -5:27 p.m. (Here’s the latest information we have received from the courtroom)

The judge told the jury they should plan on packing a bag.

All signs indicate the defense will wrap up their side of the case on Monday.

It’s not clear if both sides will give their closing arguments Monday or if it will happen on Tuesday morning.

Before all that happened, AJ’s sister Kayra Armstrong sister testified.

She says she set the alarm the night her parents were murdered.

Kayra said AJ was “urgent, frantic, excited” after he woke her up and rushed her down the stairs.

She then remembers standing at the end of the driveway with AJ until officers put them into separate patrol cars.

Kayra recalls being “hysterical” in the patrol car until her grandmother Kay came to her side.

Prosecutors didn’t ask her much of anything during her cross.

Court ending the day with her testimony.

A look ahead to next week

On Monday morning the defense’s forensic psychiatrist will go back on the stand.

We expect to finish talking about the medical records of AJ’s brother, Josh.

Day 9 of the AJ Armstrong trial consisted of the jury hearing from a psychiatrist on AJ's half-older brother, Josh Armstrong.
 
Monday, August 14th:
*Trial continues (Day 11) (@ 9am CT) – TX – Antonio & Dawn Armstrong (both 42) (July 29, 2016, Houston) – *Antonio “A.J.” Armstrong, Jr. (16 @ time of crime/17/now 23) arrested (7/29/16), charged (8/1/16) & arraigned (7/26/17) with capital murder. Plead not guilty. $200K bond. Out on bond 4/12/17.
First trial: after ~20 hours of deliberations verdict was 8 Guilty & 4 Not guilty. Judge declares mistrial.
2nd Re-trial After ~18 hours of deliberations verdict was 4 for Guilty & 8 not guilty. Judge Kelli Johnson declared (another) mistrial.
3rd Re-trial began on 5/2/23 with jury selection & ended 5/19/23 with total of 48 potential jurors back on 5/31/23 for final jury selection.
12 jurors & 4 alternates were selected. (6 women (4 white & 2 Hispanic women) & 10 men (4 Hispanic, 2 Black, 2 white & 2 Asian men). Four of these jurors are alternates, but those 4 are not being told that until it’s time to deliberate.
There are two Marines, engineers in the oil & gas industry, a retired teacher, a Space Center Houston worker & therapists who work or have worked with mental health patients. The jurors range in age from a 26-year-old man to a 65-year-old grandmother. 6/27/23 Update: One of the original twelve jurors was excused for personal reasons. That means one of the four alternates is moving into the jury of 12 to hear the case, leaving the court with three alternate jurors.

Monday, August 14, 2023 is Day 11 of Antonio (AJ) Armstrong Jr.’s third murder re-trial.


Judge is not allowing any cameras in the courtroom, no one inside the courtroom will be able to use cellphones or laptops. There is no live streaming of the trial. moo

The defense rested its case on Monday afternoon. In total, more than 30 witnesses took the stand during the entirety of the trial.

The state called Dr. Ian Lamourbux back to the stand after hearing from the defense psychiatrist, Dr. Mark Moeller.

Dr. Lamourbux testified that there Josh showed no indications of religious delusions and there were no signs at the crime scene. He also said AJ showed signs of homicidal ideation and premeditation before the murder of his parents with several of his actions, including setting fire to the carpet, shooting the gun in his room and the search of a car bomb found on his iPad.

A jury will begin to deliberate in the third double murder trial of Armstrong once the defense concludes its closing arguments, most likely on Tuesday.

Armstrong, who has pleaded not guilty to two counts of capital murder, faces life in prison if convicted.

Both sides rested Monday on day 11 of Antonio "AJ" Armstrong Jr.'s third capital murder trial. He's accused of killing his parents, Antonio Sr. and Dawn Armstrong, in 2016 when he was 16. His first two trials ended in mistrials.

The defense's final witness was forensic psychiatrist Dr. Mark Moeller. They spent much of the day dissecting the December 2016 medical records of Josh Armstrong -- A.J. Armstrong's older brother. The defense has painted him as an "alternate suspect" as they tried to convince jurors that his mental health issues started before the murders.
