Sipe summarizes eerie comment John Feit made to Tilley Sanchez about suggesting she disappear in a basement as “under the area of creepy. It certainly fits into a pathological pattern.” #FeitTrial

Defense: They used ur words in Spotlight?
Sipe: Yes, but u get no money for that.
Defense: Maybe u should have had better representation.

A moment of levity in otherwise heavy testimony about sexual repression and aggression among clergy

Defense files motion for mistrial since Sipe mentioned reviewing Feit’s polygraphs during his testimony, which he was instructed not to

Judge to make ruling on that by tomorrow morning. Prosecution calls it “harmless error.”

Court adjourns for the day however state and defense taking up an issue regarding something Sipe said during his testimony.

Says believes instructing jury to disregard it will “shed more light on” the polygraph — defense will make that call once jury brought in

Defense motion for a mistrial denied. “Although it was mentioned I don’t know that it rises to the level where it’s harmful." Judge Singleterry will instruct jury to disregard the word "polygraph." #FeitTrial

It is quite possible the state rests its case by the day’s end.

If so the defense is expected to call at least two of its own witnesses. #IreneGarza #rgv

Former monk testifies against ex-priest accused in beauty queen's 1960 slaying (with clip)

"EDINBURG, Texas -- A former monk has testified that an ex-priest accused of killing a Texas woman in 1960 confessed to him three years after the killing. Dale Tacheny testified Monday in the murder trial of John Feit, now 85, who is accused of suffocating Irene Garza after she went to confession at Sacred Heart Catholic Church in McAllen. ...

Tacheny said Feit confessed to him in 1963, after the church sent Feit to a Missouri monastery where Tacheny worked. The former Trappist monk said Feit expressed no remorse during the confession.

Tacheny said he didn't initially report the crime because it "was not my place to make a judgment." The 88-year-old said he instead tried to counsel Feit to change his behavior toward women. But in 2002, Tacheny went to police in San Antonio and reported what Feit allegedly told him decades earlier.

Tacheny spoke to "48 Hours" in 2014 about what he says Feit told him and read excerpts of the letter he penned to investigators in 2002.

"I covered up the evidence," Tacheny told "48 Hours." "I'm sorry for what I did." ..."

Forensic pathologist on stand — instructed not to reference 1960 autopsy to jury, but can reference review of medical records/reports/photos

This is because the judge granted the defense’s motion to exclude the autopsy report from being entered into evidence

Dr Norma Jean Farley also not allowed to speculate about manner in which #IreneGarza died from asphyxiation, eg from a gag, a hand or pillow

Farley is contracted by @HidalgoCounty since the county does not have a medical examiner system since its population is under 1 million

She trained under the pathologist who assisted in the autopsy of JFK after his assassination — second JFK reference of the trial

Apparently now that the evidence has been entered, the attorneys no longer need gloves to handle items recovered from the crime scenes

Outside presence of jury, defense argues state has not meet burden to prove Feit behaved w/ “malice of forethought” on April 16, 1960

Defense argues that case should be dismissed — Judge DENIES defense’s motion for direct verdict.
