Scheffler testified that he no longer had contact or lived with the girls or their mother after Oct. 4, when he was arrested and Bates had a protective order issued against him, the judge’s order said. Scheffler did not file a suit until Jan. 5, which was beyond the time limit set in the family code, the order said.

“Even if the time is calculated from the day after Mr. Scheffler stopped living with the family, the 90-day requirement would have ended on Jan 3, 2018,” according to the brief filed by Brown.

Wow is right! Threatening to kill Tonya should be enough reason to eliminate Scheffler from petitioning for custody. And it should not be overlooked that Luluviolette doesn't want to see or talk to him.

These poor girls - what a horrible family environment! :tears:

Right? I thought they would go to Arkansas together. Maybe Lulu was adamant enough that they were able to expedite her move? Or maybe Lili has other counseling needs that are more available here? Totally guessing...

I say this because The Refuge (group home for sex-trafficked victims) is right down the road from SM. The local support and financial resources that are tied to the Refuge are phenomenal. There may be some outreach for her after all the national headlines.

Maybe the thought of living with aunt and uncle in AR isn't that alluring after everything she has lived through? Or her paperwork takes longer? Dunno.

The group home is near San Antonio. Isn't that where her grandmother lives? Maybe her foster placement in Hays county wasn't working out. Some teen girls end up temporarily in group homes, maybe for several months... for different reasons.

Yeah, maybe it is simply the best option for her now for reasons we can't fathom (or don't need to).

Still no murder charges, strange.
I wonder if anyone will ever be charged?

The girls were recovered unharmed in a car with Miles near La Veta, Colo., on Jan. 3. Miles is a person of interest in the death of their mother, 44-year-old Tonya Bates, police have said. Miles, who was Bates’ roommate, was indicted on two counts of kidnapping and faces 20 years to life in prison if convicted.

A federal judge can determine that it was foreseeable that the death could have been the result of the defendant’s conduct, Dworin said. The judge who determines the sentence in a federal trial could then increase the time a defendant serves if convicted of other charges, he said.

I'm with you. I believe he'll be found guilty and put in prison, leaving TX LE time to build a solid murder case. MOO.

Ugh, I sure hope not! From the link upthread:
"If Terry was a threat, they had every opportunity to get out and run," said the defense, explaining the girls didn't express any fear of Miles, but that they expressed concern for his well-being.

They argued the teenage daughter suggested that Miles come live with them as their "live-in nanny."

The defense is painting a picture of Miles as the white knight, rushing to "save" the girls from their selfish mother. And at the same time he was involved with the teenager, very likely sexually IMO.

So how did Bates end up dead? I hope the defense isn't going to try and pin it on the girls, or at least the older one. In any case, as a minor, nothing mitigates the charges of an inappropriate relationship between Miles and either girl.

Logic says Miles killed their mother and took the girls for nefarious reasons. Remember his criminal history. From January 2018:

  • November 2015 - Domestic abuse battery: Pleaded no contest to amended charge of simple battery on Sept. 7, 2016. Sentenced to six months in jail.

Story has been updated.

The Defense is trying hard to paint Tonya as a victim of her own vices. But could it be that Tonya was just legitimately trying to find companionship? If there was a third person who did it, there would be evidence of the encounter.

The defense has put up a strong front, but I see cracks in that story. IMO.
