UPDATE: @LeagueCityPD says 2 YO Malakhi was found w/ his parents & is SAFE. They say his parents aren’t in custody, and they’re not facing any charges. Police confirm they were supposed to drop off their son to CPS last week, but never showed. #KHOU11 #HTownRush

We asked @LeagueCityPD police where they found the boy and how, but they wouldn’t say, because this is a CPS case. Just that the boy is safe. #KHOU11 #HTownRush

How could they not be facing charges? Was this not ordered by the courts?

I don't know and unfortunately, it sounds like we're not going to be privy to anything more because of the CPS case. I'm just so glad that he's safe. MOO

Well the first son "died in his sleep" so that sounds like sudden cardiac death in childhood. Which is the older version of SIDS.

I'm guessing that CPS didn't actually have custody of the boy, or the parents would have been charged with custodial interference or kidnapping.

Hopefully whatever is going on can be worked out quickly. I can't imagine losing one baby and then having the next one taken away. If they weren't abusive I have tons of sympathy for them.

This has me perplexed. They were supposed to turn him over to CPS (by who's orders) on the 4th and never showed. Once they left town an amber alert was issued but now there's no pending charges? wth?
I just really hope this turns out ok for everyone, especially the little boy.

I'm wondering if there was a report made and the parents were not allowing CPS to examine Malakhi. So they were ordered to bring him to CPS but took off instead. Since CPS hadn't been allowed to examine Malakhi they had to consider him in danger?

I don't know, I've seen nothing to indicate that he was actually in danger. Obviously I know you can't always tell. Just saying it wouldn't be the first time a false or mistaken report resulted in chaos.

Quite honestly the closest thing to hinky for me in this case is both babies having the same first name. I have seen people use the deceased child's name as a middle name for the next child... but the same first name? It seems like that would be extremely triggering. I don't know.

I just hope that if it was all a misunderstanding he's reunited quickly. No need to traumatize anyone.

A toddler who was located after a Monday night Amber Alert has been examined and determined to be in good health, CPS spokeswoman Tiffani Butler said Tuesday.

An alert was issued for Malakhi Bankhead after his parents, Katherine Ulrich, 21, and Cody Bankhead, 24, failed to turn him over to CPS custody after a judge ordered them to do so last Wednesday, League City police spokesman K.R. Williamson told the Chronicle on Monday.

If a child is not turned over to CPS custody, the organization will make efforts to locate them and fill out a missing persons report as soon as it is determined the child is missing, Butler said explaining the process.

Well this is incredibly odd.

They are still under investigation... of course they are. CPS isn't going to come out and say "OUR BAD, false alarm.... go back to what you were doing." Even if there was nothing wrong and it was a false report they will be dealing with CPS for quite a while now. I'm guessing that if they were able to find anything we would have heard about it...
