Thank you, Niner. When I saw the Motion for Recusal I assumed this was more legal wrangling by the Defense, but nope. The Motion to recuse Judge Givens was filed by the Prosecution due to the Court's (alleged) lack of impartiality as well as the Judge's (alleged) personal bias. All of this stemming from the series of recent discovery hearings. Again, what a mess. :( MOO

You got that right - what a mess!! :(

There is NO way this trial for either Beltran or Marano are a go for 3/27/23.
And by going with the court site Beltran is supposed to be in court on 3/22 for a trial announcement hearing.
Maybe we will find out more than - hopefully....

@Niner, this article is paywalled but we are allowed to summarize: The defense filed a motion to dismiss the murder and tampering with evidence charges against Marano. The judge said she’ll rule on their request on the day of trial, which she set this week for March 27.

1/30/23 Update: Per twitter: There was an emergency the day before & it got rescheduled for 2/13/23. No clue what type of emergency, I didn't get details about it. I spoke to the DA’s office this morning to see when the trial was set for & they told me the hearings not happening today that it was postponed last night but they are pretty sure the trial will begin 3/27/23 for Marano. Court site for Beltran shows a trial announcement hearing on 3/22/23, no discovery hearing on 2/13/23.
2/13/23: Beltran filed (by Myra McIntosh) Motion for the appointment of an investigator. 2/15/23: Order appointing Keroy Knowling as investigator; not to exceed $1500 without prior Court Approval by Judge Amber GIvens.
2/13/23 Update: Court site shows trial announcement hearing on 3/22/23 @ 8:30am. And show trial still on 3/27/23. 3/13/23: Motion to adopt motions, objections & requests for instructions of co-defendants. 3/16/23: State's Motion to recuse the Honorable Judge Amber Givens. 3/20/23: Order of referral on Motion to Recuse. Well I see no dates changed on the court site. Next hearing is 3/27/23, but it says Trial, which I do believe has been cancelled. But I do believe the DNA hearing will happen on that day.

No changes in the other court site with individual cases.

In a 28-page motion, the Dallas County District Attorney's office accuses State District Court Judge Amber Givens of a bias against them over the latest missing file snafu at the Dallas Police Department.

The DA's office wants Judge Givens to be recused from an upcoming murder trial. It was during pre-trial motions when it was discovered that a Dallas Police detective didn't properly file reports and body camera video in the arrest of Nina Tamar Marano in the Dallas Police Department's filing system.

Givens has delayed the [Marano] trial until next week to give Dallas Police a chance to come up with the missing evidence, otherwise there is a threat she will dismiss the case.

The DA's office says Givens has made it impossible for them to get a fair hearing because they feel the judge in blaming prosecutors for the Police Department's mistake. But defense attorney Heath Harris wants Givens to stay.

An outside judge will be assigned to hear the DA's motion to have Givens replaced.

Not heard from the lead investigator. Dallas PD officer Cory Parker took the stand & said that 300 pieces of evidence not turned over & 18 videos were automatically deleted which showed officers executing search warrant. Judge wants to know WHEY these were deleted. No other info available. Discovery hearing continued on 2/14/23.

Judge Givens pointed to a September hearing in which Pittman said the DNA results were the only conclusive evidence. Givens wondered if prosecutors had gone through all the police reports carefully. Some reports mentioned the existence of videotapes that were later handed over, Givens said after reading the reports, which were brought to the courtroom in stacked boxes. According to the judge, the prosecutors should have recognized the absence of video recordings from the reports. Discovery hearing continued on 2/16/23.
2/16/23 Update: On Wednesday, prosecutors said additional material had been recovered, including investigative tapes, audio recordings & boxes of women’s clothing & objects believed to be bones. “I’m sorry that I caused all these problems with everyone. It was not my intention at all,” Detective Christine Ramirez said, speaking on Wednesday. “I made a mistake. Big mistake.” Among the evidence removed is footage from body cameras worn by officers who helped execute a search warrant at the Mesquite home where Beltran lived. More than a dozen officers testified at a hearing about whether they could testify in court without their videos. Most responded that they could, but defense attorneys argued that their recollection of the two-year-old search was unreliable. According to lawyers Valerie Baston & Heath Harris, the video could also show things that the officers did not notice. Baston & Harris filed a motion to drop the murder & tampering charges against Marano. Givens said she would rule on their request on a trial date she set this week for March 27. Judge Givens acknowledged Ramírez’s “inadequacy” but said prosecutors were to blame. The hearing was interrupted by long breaks to allow prosecutors to collect evidence they did not have & call additional witnesses. About two dozen police officers waited in the corridors of the courthouse for the end of the hearing after 9pm Wednesday. 2/24/23 Update: Dallas County District Attorney John Creuzot Thursday announced an audit of every case touched by a Dallas Police detective Christine Ramirez involved in a high-profile murder case that defense attorneys want to be dropped over missing evidence. Separately from Ramirez, Police also confirm they have another data issue under review with 52,000 files that were improperly cataloged. In an email Thursday, police said the number of files still in question is down to 13,000.Police issued the following statement about those files. “Notifications were not made due to this being an internal audit & an administrative matter. No digital files on the system were lost. The digital files were uncategorized & were saved on the system. At the time of the audit – 98 percent of the files were categorized. The audit found two percent that were not. Steps have been taken since the audit to categorize the files that were not already & ensure compliance department wide. More than 99 percent of the files on the system are now categorized. Administration is currently working to determine if any uncategorized files are part of any investigation. Any digital files that are identified as part of an ongoing investigation would be turned over as is required by law.” Judge Amber Givens said she will rule on the motion to dismiss when the case comes up for trial next month.

Harris is seeking dismissal of murder charges against Nina Marano for the 2020 murder of Marisela Botello.

Prosecutors won removal of Judge Amber Givens in that case for critical remarks the judge made about prosecutors and the evidence. But Harris said the entire case should be dropped over the evidence problems.

“Yea the case should be dismissed, not because that’s what we want but because we believe that’s what the law dictates,” Harris

Harris said police body cam video from a house where the murder occurred has been lost. Missing video also included interviews with witnesses, he said.

“It’s gone. It’s deleted. We can’t get it back,” Harris said.

A new judge has been appointed to pick up that case and consider the evidence and motion to dismiss the case.

Well I have been searching to see when their next court dates will be.

I hope I am doing it correctly. They were all transferred from the Judicial District Court 282nd to Criminal District Court #6 - which are both in Dallas County - where I have been looking.

Nothing yet - or do I have to look somewhere else?
@Seattle1 - do you know? It should be Dallas County court site, right? TIA! :)
