Oh no one knows yet, the ID hasn’t been confirmed publicly. The reporter’s tweets just indicated that he had become very close to and fond of Martin’s family over the past week. He seemed to imply that the fact that APD called the family to the scene, and their grief at the scene, seemed to indicate that there was a great possibility it truly was Martin who was found.

This is truly heartbreaking to hear.

My heart goes out to Martin's family. May they hold one another close during this terrible time.

I’m so surprised LE would call a victim’s family to a scene like that.

Also, did anyone else catch during the brief statement that the blonde PIO officer gave, a reporter asked a question that started with “So you said there is no ID on the body...” I’ll try and find the exact clip.

I thought it was interesting that the officer had seemed to confirm that there had been no ID on the body. It seems unusual that a young man bar hopping in Austin wouldn’t have ID. Could a wallet fall out of a jeans pocket in the water?
Or he was robbed.

Austin police say while they investigate the discovered body and the Gutierrez case, they're asking for the public's help.

“If you were in the area, if you saw anything suspicious, or something out of the ordinary, please call (the homicide) tip line/"

The homicide tip line is 512-477-3588.

Some details from Martin’s behavior at the Alibi that I hadn’t heard before. The bartender refused to serve him anything there.

The Texas Alcoholic Beverage Commission (TABC) told KXAN that they opened an investigation Monday into The Alibi related to Gutierrez's disappearance.

Chris Porter, a spokesperson for the commission, explained the investigation was prompted by news reports which included video of Gutierrez acting strangely at The Alibi.

"The investigation is in no way an indication of any violations on the part of the bar; this is standard procedure any time TABC learns of incidents involving a licensed business," Porter said. He added that the investigation aims to find out whether violations of the Alcoholic Beverage Code may have contributed to Gutierrez's disappearance.

TABC said there are currently no active investigations involving Luster Pearl on Rainey Street.

Boone said Martin was at the Alibi from 12:30 a.m. to 1:15 a.m. on Monday November 19. At that time, Boone said another manager was working behind the bar and refused to serve Martin any alcohol. At that point, Martin was intoxicated and the bartenders weren't comfortable with serving him with the way he was acting, Boone said.

The Alibi staff working at the time reported that Martin just hung around with his friends the whole time he was at the bar.

"We hope for the best and we just want him to get home safe and sound to his family," Boone said.

Another horrible tragedy. I wonder how his friends are feeling. If I had been on a night out and one of my friends had been refused service for being drunk, then disappeared, I'd feel awful for not making sure he got home ok.

I think there is some indication on the body or based on the lack of a wallet/phone/etc to lead the APD to ask for tips to the homicide line. In other cases like this, where a young guy walked away and is found in a body of water, I do not recall such a request from police.

Does anyone else know of a similar case where the police asked for tips to homicide after finding the body?

This is just a guess but perhaps when finding a deceased person it is investigated as a homicide until it's ruled otherwise by the coroner.

I would expect the police to investigate as a homicide until ruled otherwise. But I have never seen the police department make a public appeal for tips in the immediate aftermath of finding a body in a case like this. Maybe it is just the video of his "weird" behavior that is causing them to suspect foul play.

Also if his ID (wallet) was not located, as was mentioned he had no identification on his body, then there is the possibility of robbery which would lead to at least considering homicide. Of course, his body could have also provided evidence and clues to this as well. jmo

These kind of stories make me so angry. When someone is so intoxicated that the bar refuses to serve them why in the world did the bar and friends allow this man to just run out of the bar on his own?

APD Homicide detectives confirmed that the deceased person located in 1300 E Riverside Dr. yesterday morning is missing person, Martin Gutierrez.

Next of kin has been notified and we are still waiting for toxicology results from the Travis County Medical Examiner. No other information is available at this time. -APD PIO
