You may be right, but the state does still seek and gets convictions in capital cases, and they are one of the few states that actually still carry them out. Only 11 death sentences were carried out in 2021 in the USA, and 3 of them were in Texas. She may get a sympathy verdict, but I wouldn't bet on it. It appears to be a cold-blooded murder, with perhaps premeditation, based on comments to friend about wanting to kill MW when she found out about the affair in January) JMO
If she actually faced trial I'm not sure what would happen at this point, like that anonymous call to LE about what KA said I'd think would I think be inadmissible in court since there's no way to cross-examine that person or even know who they are so KA saying she wanted to kill MW months ago wouldn't be part of the trial evidence unless that person is willing to testify otherwise it would be hearsay. The only evidence that CS for instance didn't go into the apartment is from CS and that also goes for KA owning a gun, which again CS purchased them and it's only his word that one of those was hers. It would be a circumstantial case with the star witness also being a known liar, like perhaps this would be plead to manslaughter.
