My feeling based on the comment is that he is going to instruct them to pull the plug. Let's see. He or she's not bothering with constitutionality (which are privacy issues that have to do with abortion rights) and is going straight to how the law is applied.

IMO, legally, Munoz is not a patient because she's dead and her body should not be forced to host a fetus that is not viable and is horribly deformed.

There have been a number of cases where normal infant was produced from a brain dead mother. I don't know what else to say on the matter.

I read there was maybe one or two cases at the most.

Well, look at the Jahi McMath case. A vegetative state (some brain activity) is not considered legally dead. That's your answer.

But that's the legal answer. The personal opinion answers may be different. For me, I think the difference may be (help K_Z!), that a person with some brain activity has a nervous and circulatory system that can sustain a life growing inside it. It seems that a brain dead corpse can only incubate a horribly damaged fetus. But i don't know for sure.

That isn't accurate.

I hope hospital doesn't appeal. It's one thing if fetus was normal. But why insist on incubating a very abnormal fetus?

This is a truly bizarre case to me. In my personal (not legal) and emotion-based opinion, forcing the family to endure this makes little sense. It is ghoulish. It's even beyond what the mother wanted, since she is now a corpse.

Like others said, it would be different if the baby was close to term. Then I could understand keeping the body going a short time to allow the baby to be born, but come on. Not only is the fetus not viable, it is horribly deformed. So the hospital is forcing a family to watch their loved one's corpse incubate an apparently horribly damaged fetus that is so deformed, it's gender cannot even be determined. That's is insane to me.

I hope the court allows this family the dignity of making their own, private, personal decisions and lets them let their loved ones go. The hospital is playing God here, IMO. There have to be limits on what technology and science are allowed to accomplish with human beings against their wishes.

If the baby was close to term, they would do a C-section. No need to keep her hooked to a vent. If the baby was close to being viable outside of the womb when BD occurred, then maybe they might wait a couple weeks, etc. That should be the families decision though.

I think the hospital misinterpreted the law. I do not believe she is a patient if she is brain dead. I think the hospital is going to play dumb about the law. I think they continued this for a alternate agenda.

This is unheard of. The other cases on record, were most likely because of family wishes.

I'll be surprised if the hospital appeals. I think they're probably relieved to have the guidance from the court that she's not considered a "patient." Assuming that's the basis for the ruling. Does anyone know exactly what the Judge said?

They can now keep brain dead persons on life support for a long time. There have been sucessful cases of brain dead women delivering normal fetuses. I am not sure why this one is so abnormal. Possibly it was abnormal even before mother collapsed.

Please cite to cases where a brain dead mother was kept on life support when she was only months pregnant and her body successfully delivered a viable baby after months on life support.

In addition, the difference is that forcing the body to keep hosting the fetus is against the family's wishes. Period.

How not? We've read repeatedly that because Jahi McMath is brain dead and not in a vegetative state, she is legally dead. And not a patient.

I was right! Hopefully the hospital will not drag this out further with an appeal and requests for injunctions. Let this family be! They have suffered enough!
