I’m not playing devils advocate here as the evidence looks very much like he is guilty but I can’t get around how he got her out the house.. the fact that he is trying to blame TM, could she have taken her out the house for him but then not been involved in the rest.. I don’t know why she would have did this but how did he get into the house and take her without leaving any prints in the actual house or waking anyone??

I’m pointing out how ridiculous the claims by people who have been playing devil’s advocate have been on here, specifically agreeing with Edinlass’s comment, although that’s went over her head too

The main door to the building, at ground floor level, was unlocked. Theoretically ( as we have no actual proof ) he only had to get into the stairwell. If Alesha had been sleepwalking and managed to get out of the flat door ( first floor level ) then he could have taken her from the stairwell.

She was prone to sleep walk. She had already been up and sent to bed at least once throughout the night. I don’t think we’ll ever know but the accused was quite proud of this IMO so I’m not giving it much thought.

Mr Bailey also says he could not determine how the semen got there. He says it could have been via intercourse but it's also possible a third party planted it.

He says DNA matching the 16 year old boy accused of raping and murdering Alesha MacPhail was found on 14 different areas of her body. He says because of the volume and spread across the child's body it's "highly unlikely it was transferred via someone else"

I'm new here but have been following for a few days. This has to be enough to convince a jury surely? I couldn't imagine a world in which this could be not proven. His DNA is present on the girl in places that fit with how her injuries and consequent death were inflicted. Coupled with everything else it's hard to see how there could be doubt now.

I've never been this affected by a case in my life. Things like this seriously test your resolve when it comes to introduction of the death penalty, that's for certain.

Is anyone aware of what kind of sentence he is likely to receive if found guilty? I'm unsure of how these things work at the best of times and in particular because of his age.
Yip I’m the exact same, being from the west of Scotland and having kids myself it’s had a big affect on me. Constantly checking every feed for that bit of definitive evidence. I guess there’s a part of me curious as to how someone can be so sick and what on earth has lead to this, why ? Has he shown any signs of this previously etc. It’s been very hard reading today.

Don’t forget, he has come up with the defence of TM planting evidence AFTER he would most likely have known there was no DNA of his inside the house and traces of semen found on her body. We may never know how poor Alesha encountered this evil pig on the night of her murder, but as we know she has a bonafide history of sleepwalking, together with the grandmother having left the key in the door, she could have so easily encountered the accused on the internal staircase.

Besides, DNA is not always left if a person is lucky (unlucky for the victim) and very fast. No fingerprints in the upstairs portion of the flat suggest to me that he did indeed meet her on the stairwell, but we really may never know.

I think if there was any truth to the sleep walking rumour the defence would have been all over that when crossing examining family member.
She might have been out of bed though, as she had already been up that night. No DNA in her bedroom doesn't mean he wasn't in the room

I don’t think we will ever know the truth. This sick person was able to return home and sleep after what he allegedly did. His priority now will be to protect his innocent image amongst the full grown men he will be encountering next year when he turns 18.

I imagine he will maintain his innocence even if he is found guilty. I'm not sure many people will believe him though, even other inmates.

Yeah I think so. That was really hard reading never mind the people in court that have to hear that in real time. I hope His defence is over quickly I can’t bare to read about him trying to worm his way out of it.

Is there a minimum amount of time, in Scottish law, that the jury must deliberate for?

Regardless, we should all relax today. If you’re all anything like me I’d say we’re finding today’s court findings very upsetting and it’s easy to get highly charged and emotional over silly things. What’s came out in court today is very hard to take, even if most of us imagined it being the case already
