The judge also refused to cooperate with the SCR for Ellie.

I wonder what this judge later said when the poor baby was murdered by this monster?
Did he/she even say sorry? :(
I'm sure I read she retired not long after Ellie was murdered

Despicable behaviour. She disregarded all evidence that painted him negatively

Oh the defence managed to find another Hughes brother.

14:48 Hughes brother 'never observed Arthur being naughty'
Hughes' barrister Bernard Richmond calls his client's brother Andrew Hughes to the witness stand.

He asks him some questions about Thomas Hughes' relationship with Olivia Labinjo-Halcrow.

Mr Hughes says it seemed 'great initially' and 'very doting'. He adds that they both appeared to be 'excited' when Olivia became pregnant with Arthur but that they had 'apprehensions' because they were 'both very young'.

Mr Hughes confirms there were some 'issues' in his brother's relationship to Olivia shortly after Arthur was born.

Describing what happened after they split up he adds: "It had a massive effect on Tom. He started to regress within himself. His bubbly, happy-go-lucky way seemed to diminish."

Asked how his brother's relationship was with Arthur when he gained sole custody Mr Hughes says: "Stronger than ever, it was them against the world."

Mr Hughes tells the court he never observed Arthur being naughty beyond pushing the normal boundaries

Tustin was 'very cold' towards Arthur
Mr Hughes states Tustin appeared to be 'very cold' towards Arthur.

He tells the court that when he was playing with Arthur and Tustin's son with toy boxing gloves Tustin would enthusiastically 'praise' her own son but tell Arthur he needed to 'get a lot better' to be as good.

Mr Hughes says both children were impressive at boxing with the gloves for their age.

He states his brother found it 'increasingly hard to spend time with Arthur' because Tustin would 'make an effort to intervene'.

Mr Hughes confirms the last time he saw Arthur was the week before lockdown in March 2020.

He says: "He seemed far more timid. He seemed more aware he may get in trouble. There was this voice Arthur would sometimes make referred to as his baby voice. Before it was never an issue but it became an issue not long after Ms Tustin came on the scene."

15:02 His brother became 'stricter' with Arthur
Mr Hughes says Arthur 'idolised' his grandfather while his grandmother took on the role of 'someone to provide care'.

He states when he met Tustin and tried to talk or 'have a laugh' with her she appeared 'very, very cold' adding: "I got very little back from her."

Mr Hughes tells the court his brother's relationship with Tustin appeared to move 'very quickly' and adds: "I had my concerns it was moving too quickly and they didn't know each other well enough."

He tells the court his brother would argue with him more over little things after he met Tustin. Mr Hughes recalls an incident where he was only wearing shorts in front of Tustin because he had just come out of the shower.

He says: "Tom said Emma believed I was showing off for her."

Mr Hughes states his brother became 'stricter' with Arthur and would 'punish him for more and more minor infractions that weren't an issue before'.

He says he made a 'passing comment' that the pink chair was 'not fair' but his brother told him it was not any of his business so he never mentioned it again

There was a remark from her too about her termination at 21wks. She said something like “Tom isn’t so special that I’d use a baby as a weapon”
This is a telling phrase “isn’t so special” because it’s really demeaning..again, insight into her twisted psyche

Yup, it's all for me.
My hubby and son walk about in pants/ boxers after their showers. At least he put some shorts on!

Yes I picked that up too. Nasty piece of work

So Andrew has made amends with Tom. I'm sure I read Blake hasn't spoken to him since Arthur died.

This is another weird thing she does…she isnice and encouraging to her own kids, but puts other kids down to big up her children…she only cried during prosecution questions when she heard an audio clip of her own son saying to Arthur that he would give him a cuddle…the prosecutor picked up on it and she admitted that she was crying because her son was so kind…her mind really is warped…is this behaviour with her kids a narcissistic trait too?

Yes narcissistic parents will often have a golden child and a scape goat among their kids. They will view their golden child as an extension of themself. That child cannot do wrong. They are perfect In every way and better than all other children. The scape goat will be the opposite. The hated one. You only need one scape goat though, so that’s what Arthur’s role was.

I would imagine so. 'Everything of mine is better than yours' mentality.
When my kids friends are here I try to be as fair as possible, I'd never say to someone else's child they needed more practice. It seems to me she's already started criticising Arthur. I posted before about her testing the waters, I believe this could be an example of that

Tustin 'the controlling partner'
Mr Hughes states the text message sent to his family in April last year accusing them of harassment, was 'not something I would expect to see off Tom' because his brother's texts were less grammatical and more 'chaotic'.

Asked how his brother was before meeting Tustin he says: "Very friendly, very warm. He had a strong belief in the nuclear family, mom, dad, children. Very strong family unit. He believed in the family unit."

Asked how his brother was afterwards Mr Hughes adds: "He went within himself. With his immediate family, mom, dad, brothers, the ties seemed to become weaker and weaker. He didn't seem to be invested in keeping that strong."

Mr Hughes states Tustin appeared to be the 'controlling' partner in the relationship with his brother. He states she was 'domineering' towards his brother and Arthur.

Mr Hughes confirms he fell out with his brother after Arthur's death but they have since made amends.

Mr Richmond concludes his questions.

Mr Hughes 'Not close' to his brother
Mary Prior, for Tustin, begins cross-examination.

She asks why Mr Hughes did not make a police statement. He replies that he was willing to but did not realise what he had to say would be relevant.

Ms Prior puts it to him he only met Tustin twice. Mr Hughes denies that was the case.

He confirms he never lived at his parents' home at the time but says he estimates he encountered Tustin between eight to ten times.

Ms Prior puts it to Mr Hughes he is 'not close to your brother at all'. In reply he says: "I believe I am."

In response to the next question he says he 'doesn't know' if his brother thought he was a 'bit of a bully'.

'I believe she's the catalyst for it'
Ms Prior states Mr Hughes was told off by Thomas Hughes for 'showing off' in his boxing shorts in front of Tustin.

Mr Hughes accepts his brother did say that to him. He also agrees at the time he did Mixed Martial Arts (MMA) and was the most 'athletic' of his brothers at the time.

Mr Hughes confirms he did play with Arthur with boxing gloves and says 'he was as good as a five/six year old could be' when using them.

He describes his relationship with Arthur as the 'fun uncle'. Mr Hughes says he was not aware Arthur was having nightmares or fears his dad would harm him.

Mr Hughes confirms he did know his brother had concerns Arthur was being 'clingy' and that he did not like it.

Ms Prior asks if he thinks everything that has happened is Tustin's 'fault'.

Mr Hughes: "I believe she's the catalyst for it."
