Stewart tells court he was 'protecting Helen'

T: So in your mind Helen is still in the clutches of kidnappers and here are all these people wanting to find her. Why didn’t you say anything?
S: By that stage I was protecting Helen at that point, and Boris
T: Not yourself?
S: No

[h=3]Theft of money from Helen Bailey's account denied by Stewart[/h]T: You hadn’t been told by Nick and Joe not to say a word about bank accounts?
S: No
T: The issue about whether you stole money out of Helen Bailey’s account comes down to you and you alone
S: No

Stewart had planned to tell police about kidnap

T: Jurors will want to know exactly how your mind was working. What is it you felt you couldn’t tell the police? S: I couldn’t tell them about Joe and Nick, and all the things that happened
T: What would happen if now [after your arrest] you told police Helen had been kidnapped?
S: My plan was to tell them but they told me they wouldn’t talk to me. In my mind I was going to tell them everything. I thought ‘if Helen’s dead they might as well know everything’.
T: What changed?
S: Time passed, and I took the advice of my solicitor not to say anything. The mannerisms of the police didn’t ring true
T: By this point you had been arrested for murder. What had changed your thinking to the point where you were going to tell them?
S: It wasn’t a clear cut decision at all, it wasn’t a yes or no
T: Why when you were sitting in an interview room with experienced major crime unit officers did you not tell the truth?
S: I’ve already told you that - time passed and my solicitor said to say nothing

"In my mind..."

He uses that phrase a lot doesn't he.

Yep, it's the police's fault now

‘if Helen’s dead they might as well know everything’.

A normal reaction would be "OMG HELEN IS DEAD , I NEED TO TELL THEM EVERYTHING OMG" and "OMG THEY THINK I WAS THE CULPRIT I NEED TO TELL THEM EVERYTHING" or even "OMG MY SONS MAY NEED POLICE PROTECTION I NEED TO TELL THEM EVERYTHING"

NOT "ah well I suppose seens as Helen's dead anyway I may as well tell them everything" before then NOT telling them anything/

[h=3]Stewart denies putting Helen Bailey in cesspit[/h]T: On July 15 you were arrested again?
S: Yes
T: And you’re told that Helen’s body has been found?
S: That’s correct
T: So now all of those thoughts you had previously disappeared. You can’t help Helen she’s dead, but you can catch the killers can’t you?
S: I was thinking about Jamie and Oliver.
T: Jamie and Oliver were with police close by
S: My mind was totally confused. I thought perhaps police were lying about finding Helen’s body and where they found it, it just didn’t seem possible
T: It’s very possible because you put her there
S: No
T: You must have been boiling with rage at those who killed her?
S: My mind was all over the place. I can’t remember back, I’m sorry that’s just not possible
T: Are you not well?
S: Things are just too difficult to remember
T: When you were in the police station why not say ‘you know what I was a fool before, this is what happened’ S: I was worried about Jamie and Oliver
T: How about saying to police ‘my sons are in danger, can you protect them?’ S: I wasn’t thinking that

Stewart feared Helen Bailey would be killed

T: What did you think would happen to Helen if you told police she had been kidnapped?
S: I thought she would be killed
T: Did you really think police were immediately going to advertise the fact that you said that?
S: I didn’t know what police were going to do. My mind was thinking many things during those two and a half days or whatever

In IS's last comment, he reveals that he blames his mind - just as he wishes to pass the blame on everyone.

[h=3]Stewart tells prosecution he was 'not thinking clearly'[/h]T: You were going to stick with story number one wasn’t you?
S: I wasn’t going to stick with anything, I wasn’t thinking clearly
T: It was remarked to you that you were the last person to see Helen alive, that was the cue to say ‘no, Nick and Joe have her’?
S: I’ve just explained all this, my mind wasn’t thinking clearly
T: Did somebody else put Helen Bailey in the cess pit?
S: That is what happened, yes
T: Between then and December the Crown suggest you made up account number two, and by the time you published this, you knew the pathologist’s findings.
S: I can’t remember
T: You had seen Mr Carey’s report on the probable method of her death, by smothering or by an arm lock?
S: Probably yes. I can’t remember

[h=3]Stewart denies allegation he 'crafted a tale'[/h]T: You knew there had been a finding of Helen’s phone at Broadstairs on April 16. And you sat down and crafted a tale that would touch all of those points
S: I didn’t have to craft any tale
T: And you were told many times that that document had to be with the court by a particular date, and that time was eventually October 28.
S: I couldn’t tell you dates
T: Did you have to write a number of drafts of this document?
S: No
T: When did you write it?
S: I can’t remember

There's no way, unless you had some brain injury, you wouldn't remember every little detail about how your dearest love had died and been found. This bull is really wearing now. I hope the jury are feeling how I feel.

 • #356
Well it was a slow burn but he got there, IS is on the ropes and reduced to "can't remembers" but they are not as crafty as yesterday's temp amnesia & deflection as he contradicts what he already told Trimmer 24 hrs earlier.

We might get an attack of the vapours next and a need take a break due to health reasons.

[h=3]Helen looked for information about 'Joe'[/h]T: Did Joe have a second name?
S: When he first came he introduced himself, his second name began with ‘four’ or ‘fa’ or something
T: When you next saw Helen again did you saw who was that?
S: She told me what she knew about him. She said he was a business partner or associate of John Sinfield
T: A certain point later you must have been scrabbling round in your head information about this man. Did you ever write down what Helen told you about him?
S: No
T: Then Nick came into the tale.
S: Helen said she didn’t know Nick, but that he was friend of Joe’s.
T: Did she say whether she had phone numbers for them?
S: No
T: Did she go and get any paperwork relating to them?
S: She did have a look
T: Did you help her?
S: No
T: Did Helen ever tell you in any form what she was looking for?
S: A lever arch file relating to Joe
T: But about what? S: She didn’t say

Solicitor advised Stewart not to comment

Trimmer: We’ve got to your arrest. We’ve seen the contrast in your attitude now after your arrest. During interviews at your home you were happy to speak, but now you were not
S: Yes
T: You chose to say no comment or sit there quietly
S: Yes, I did
T: You understood what the caution is about?
S: Yes, it’s not difficult to understand You had it explained to you that if you didn’t say then, what you later said in court, the jury may ask why. You didn’t say anything about Nick or Joe in these interviews?
S: No, my solicitor advised me not to comment

Going back a little ....
I think this should read

T: You chose to say no comment or sit there quietly
S: Yes, I did
T: You understood what the caution is about?
S: Yes, it’s not difficult to understand
T: You had it explained to you that if you didn’t say then, what you later said in court, the jury may ask why. You didn’t say anything about Nick or Joe in these interviews?
S: No, my solicitor advised me not to comment
