Morning All
I maybe having a silly moment or misinterpreting the information but can anyone clear this up for me...? The last known cctv footage of LB was at 4.06 which we belive is taken from the bungalows, we are only assuming from here she made her way towards coppice via path at side of WA pub. However there seems to be plenty of footage of the defendant which during statements indicates he turned left or right depending upon direction of travel by the WA pub. Why did the same Cctv not show which way LB turned? Is it how I am interpreting the info? Just has me puzzled.

Morning. Lindsay wss captured for the last time on cctv that was taken from one of the bungalows. The police came to the conclusion that she turned left at the bungalows and walked up that path towards the coppice. The reason they came to this conclusion is because Lindsay was not seen on any of the cctv footage further down Burnley Road. Hope this helps?

Regarding the defendant, if he was walking up Burnley Road from Whitewell Road he will have turned right into one of the two paths at either side of the Whitakers Arms

Recap continued

On Friday - cross examining Dr Carter, Mark Fenhalls QC for the defence, asked her if the dark patches on Mrs Birbeck’s arms could have been defence bruises.

She said this was possible.

First witness is Zoe Braithwaite
The first prosecution witness today is Zoe Braithwaite.

She is giving evidence in the witness box from behind a screen.

Her Honour Mrs Justice Yip has told the jury that it is no reflection on the witness or the defendant and it is to put the witness at ease.

Zoe Braithwaite on CCTV heading towards the Coppice
Zoe Braithwaite is being asked about events on August 12, 2019 - the day of Lindsay Birbeck’s disappearance.

The jury is being shown CCTV of the witness on Elmwood Close walking towards the Coppice in Accrington at 3.44pm and then walking back at around 4.04pm near to the Peel Park Hotel.

'I saw a lone male figure'
Zoe Braithwaite said: “I looked to my left and saw a lone male figure on a a path that runs parallel to the path that I’m on.

“There was a lot of foliage. I didn’t have a clear view of him at that point.”

The prosecution asks Ms Braithwaite to go through what she saw while walking in The Coppice.

At the first stage pointed out on the map Ms Braithwaite said she saw a lone male figure on the path pararell to her.

Further down the path, Ms Braithwaite said she would take a different route through the coppice to him.

She said she felt weary of him and he looked out of place in the woods.

Further on she said she wanted to keep him in sight, so she slowed down to

'I was wary of him'
Zoe Braithwaite told the jury that as the paths got closer together she had a clearer view of the male.

The jury heard that she could see him at a distance of 15m through the trees.

She described the male from a side view as between 20 and 25 years old, around 6ft to 6ft 2ins, of slim build and that he had his hands in his pocket.

She said: “I decided whatever route he went I would take another route.

“From the first time I saw him I was wary of him.

“He looked out of place in the woods.

“He was in front of me. He was walking very slowly.

“I didn’t want to be in front of him.

“I wanted to be able to see him at all times. I slowed down so I could be behind him.

Ms Braithwaite described to the court what he was wearing.

At point 5 she said she looked back and noticed the male had joined her path and believed he was around 50 metres away.

She said he pulled up as if he had been running.

She became concerned and picked up her pace and went down the decent of the path as quickly as she could.

'I didn’t look back again. I just daren’t'
Zoe Braithwaite told the jury that at one point the male was about 120m away.

She said he then joined her path and was about 50m away and ‘pulled up as if he had been running’.

She said: “That’s when I became concerned. I picked up my pace and down the descent as quickly as I could.

“I didn’t look back again. I just daren’t. I never saw him again.”
