I havent quite grasped the significance of the jacket yet. More evidence that the crime happened there? Someone undressed her and then removed it later? And all the cctv puts the defendant right there (for hours!). He was I would think v agitated.

Anything else I'm not seeing re the jacket?

Yes, and hundreds of members of the public throughout the 15 days she was missing.

I think they are saying it could have been her jacket... Also a voice was heard in the area apparently. IMO Its a very small window for it to have been anyone but who Zoe saw.

Next witness is Anthony Dewhurst
The Judge and jury are now in court so the retrial can resume.

Prosecutor David McLachlan QC said the next witness is Anthony Dewhurst.

Gym attendance
Mr Dewhurst was asked if he attended a gym last year and if he saw a younger and older male.

He agreed and said that the younger male he saw on a police CCTV appeal pulling a wheelie bin was the same person who attended the gym.

Anthony Dewhurst saw male pulling wheelie bin
Prosecutor David McLachlan QC is asking Mr Dewhurst about him then seeing a male pulling a wheelie bin on Burnley Road in Accrington. on August 12, 2019.

Mr Dewhurst agreed said he was walking his dog at the time.

Mr McLachlan asks if the wheelie bin appeared empty or heavy. Mr Dewhurst said he could tell the wheelie bin was empty from the way it sounded as it was being pulled along.

He said he thought the male may have ‘nicked’ somebody else’s bin ‘in broad daylight’ and described it as ‘bare-faced cheek’..

Det Sgt Bowler is now showing the jury more CCTV clips of the defendant’s movements on August 16.

The jury is now being shown another CCTV clip of the defendant at 2.13pm on August 16.

This is 26 minutes after the previous clip.

The defendant is seen walking down the side of the Whitakers Arms and crossing Burnley Road.

He then walks down Burnley Road in the direction of Whitewell Road.

Walks to middle of cemetery
Det Sgt Bowler said the defendant is next seen on CCTV walking along a path towards middle of Accrington Cemetery.

He then crosses the grass towards where Lindsay Birbeck’s body was eventually discovered.

August 17 events
The jury is now being guided through the events of Saturday, August 17.

Firstly, they are being shown CCTV of the defendant again walking up Whitewell Road towards Burnley Road.

From another camera at 1.50pm he is then seen walking up Burnley Road and turning right before the Whitakers Arms.

Mr Driver will read a series of statements to the jury.

Male seen pulling wheelie bin by workman
Stephen Greenwood said he was working at a house on Burnley Road between 2.30pm and 2.45pm on August 17, 2019.

He said he spotted a male pulling a wheelie bin on the pavement in the direction of the cemetery and he stopped at the junction of Whitewell Road.

The male changed his grip and manoeuvred the bin onto an ‘uneven surface’.

Mr Greenwood said: “Considering how he did this I believe there was weight in the bin.”

The jury were told the Mr Greenwood watched the male for around 40 seconds but didn’t have a permanently clear view of him as there was passing traffic which would obscure his view.

Mr Greenwood said he later saw a police CCTV appeal and was ‘positive’ in was the same man.

Wheelie bin 'appeared to be heavy'
Next is a statement from Natalie Bartholomew.

The jury were told that Natalie and her partner Nick Haworth took their dog for a walk on the afternoon of August 17.

She said they saw a ‘young lad’ with a blue wheelie bin behind him on Burnley Road and holding it with both hands.

The male didn’t say anything but she thanked him for letting them past.

Ms Bartholomew said she then commented to Mr Haworth ‘how strange it was for such a young lad to be pulling a bin down there’.

She said the male was ‘dragging the bin behind him and still pulling it with both hands and it appeared to be heavy’.

She added that ‘normally if these bins are empty they would bounce around’.

Ms Bartholomew said she then became aware of a police appeal with a video of a male pulling a wheelie bin on Burnley Road on the same date.

She said she ‘immediately felt it was the same young lad’ and showed it to Mr Haworth who called then called police.

On August 29, the couple showed police officers the route the male took.

'Out of context and bizarre'
A statement from Nick Haworth said he ‘definitely thought there was something in the bin’ when he saw the male pulling it along the road.

He then wondered why he was pulling the bin and that it was ‘out of context and bizarre’.

Mr Haworth described the male as ‘looking shifty’.

'It appeared as though something really heavy was in the bin. He was struggling to move it'
Mr Driver is now reading the statement of Elaine Hewitt to the jury.

Ms Hewitt said she took her dog for a walk in Accrington Cemetery with her partner Trish on either August 17 or August 18.

She described seeing a lone male pushing a blue wheelie bin and thought he was taking it to a nearby house. She then saw the male again a few moments later and ‘paid more attention to him’.

Ms Hewitt said: “He was really struggling to push it. It appeared as though something really heavy was in the bin. He was struggling to move it.”

Ms Hewitt said she ‘immediately felt uneasy’ and it seemed ‘odd’.

The jury were told that she thought he was ‘about to drop some litter’ and they were ‘appalled and considered saying something but never did’.

The male was then seen continuing to struggle pushing the bin down the path.

Ms Hewitt said the male then stopped and was ‘sat on top of the bin’ for around five minutes and was ‘looking towards the bushes and the railway line’.

Ms Hewitt said the male was acting ‘so suspiciously’ and observed him for about 10-15 minutes in total. She said the contents of the bin ‘didn’t make a noise’.

A statement from another dog walker in Accrington Cemetery on August 17 describes seeing a ‘young male slouched on top of bin’ and looking at his hands.

The witness said he then saw the male ‘walking diagonally away from the path, pulling the bin towards the railway line’.

The Judge Mrs Justice Yip told the court: “The defendant has admitted that that was him and that was the day he was moving the body to the cemetery.”

Interesting stuff so far, quite a few more witnesses who saw him pulling the bin than I expected! I'm still wondering whether we'll find out why the soles of the shoes were cut away from the upper part of the shoe. That's always baffled me O.o

'Bloodied tissue'
The jury are now hearing a statement from Christine Alderson who visited Accrington Cemetery on Sunday, August 18, 2019.

Blood was 'fresh and red'
Christine Alderson said she was walking their dog and saw a tissue on grass near the trees.

She said the blood on the tissue was ‘fresh and red’ and about ‘four or five inches wide’.

The jury heard that she thought it might have belonged to a ‘tramp’ she had seen in the area a few months earlier.

Ms Alderson also described seeing a ‘flattened area like someone had laid carpet and removed it’.

The soles of her trainers being cut off is very odd... What could the reason be??

'Felt guilty'
Ms Alderson said at the time she was not aware of Lindsay Birbeck’s disappearance.

However she saw after learning of the discovery she ‘felt guilty’.

The jury heard that Ms Alderson believed the ‘flattened ground could have been made by a wheelie bin being pulled through the undergrowth’.

Yeah, that has never made sense to me.
