GUILTY UK - Lindsay Birbeck, 47, teaching asst, found deceased, Accrington, 12 Aug 2019 *teen arrested* #5

I'm thinking 15 years but we'll see.

Nay, nay Lad..you know where him and his family live, not exactly Fagin’s kitchen but not a desert when it comes to street smarts.

No he’s obviously not as daft as they are making out and has probably had assistance to some degree, but the initial horrific act and disposal of the body 400 yards away plus constantly returning to the site didn’t need Poirot & Columbo in to solve.

IQ of 67 and a defence who offered no defence and it looked like he may walk, at least from the court reports. IMO

I'm going to guess a minimum of 17 years. But if it was up to me he'd get much longer.

  • #245
I was hoping for 20 years.

  • #246
I would like to see a sentence of 20+ but I think it’ll be little over 15, which hardly seems fair.

  • #247
Why do you think she will give him the minimum? He showed how devious was with the cover up and the fact he was stalking waiting for a victim. I'm hoping for 25 but think it will be around the 20 mark.

The starting point is 12 years for under 18's. The final tariff will hopefully take into account aggravating factors of - premeditation (stalking), dismemberment and concealment. The mitigation - mental disorder and his age at the time of the offence.

Double counting for the aggravating factors associated with preventing a lawful burial is not allowed, but I do hope the Judge applies these to the murder conviction instead, to boost his sentence. Wishful thinking?

I sure as hell hope the Judge hits him with at least 20 years for the murder....the other count will no doubt run concurrently.

Nevertheless, I don't feel this individual will be coming out for a long time, if ever. I believe he is exceptionally dangerous.

What’s the minimum life sentence, is it 12years? I think she will give him the minimum she can IMO

I think she's already implied she'll do that.

Awwww! Bless!

does the defendant have an automatic right to appeal? if so this may go on for some time.

Did she? Where?

She said he must be sentenced to life, but it is up to her to set the minimum term and that’s what she’ll do. Not the minimum she can give, the minimum he must serve before considered for parole.

Shocked by the verdict, but glad the family have closure. I'm thinking there must
be a lot more evidence that was held back from public knowledge, because I can't understand how a unanimous verdict could be reached otherwise. Moving and disposing of a body yes....murder I'm not 100% convinced he acted alone moo

He most certainly in my opinion has not acted alone , if it’s to be believed his autism is as severe as implied he wouldn’t be street enough to do what he has . He has been too successful in his methods in such a small timescale to have been able to complete his tasks as he has . It would be overload for a neuro typical person . I have said previously that my son is on the autistic spectrum and find it difficult that he could meticulously plan anything like this at all but hey we are all different and who knows what any of us are capable of. All we can hope for now is a lengthy sentence that fits the crime .

Well that came quickly. Fair play to the jury, let’s hope he’s locked away for a Very very long time.

let’s also hope restrictions are lifted and he can be named and shamed. That should at least be the Price you pay when you go down that rocky road he’s sent himself down.

what a great shame this whole episode has been & the irony is she probably avoided the narrow ginnel behind the pub for exactly this reason. R.I.P
Lol... so true about the route she took. She obviously felt safer going the longer way round where it's more public. It's an absolute shame and so sad to think of what she went through.. poor poor lady. RIP

How did this lad manage to get Lindsay off of the path in The Coppice, take her to wooded area/overgrowth and kill her without anyone hearing her scream or see it? All in the middle of the day,, when kids are off school in a popular walking area.

IMO he's guilty but how did he manage all of the above??
Within a very short window too.. she either was taken by surprise really swiftly or she was with someone she trusted.. maybe she actually knew him?

I'm absolutely gobsmacked! I guess it's ok to now say that I knew the defendant.

100% dont think he acted alone and I 100% corroborate what the staff at his schools both said.

I'm so shocked. I mean, ok if he did he did... but I just cant see it at all :(
Wow u knew him... on a personal level? so you don't think he is a crazy woman stalking clever cold hearted psychopathic killer.. neither do I and I don't know him. They obviously saw evidence we didn't to say he did this and acted alone but I'm shocked. I know stranger killings are rare.. but teenage stranger killings are even rarer. If he did it he deserves his sentence.. what he admitted to alone he deserves prison time.. but I am shocked to say the least

I think unless someone always appears a real nasty piece of work people who know them are pretty much always shocked at what they are capable of. You hear it in many many cases. People thinking someone was a good guy, when he really wasn't. You just never know.

Today's outline ( posted last night by Lancs Live )

The Judge, prosecution and defence counsel will reconvene at Preston Crown Court at 10.30am tomorrow.

This is to consider the two sets of reporting restrictions in the case.

LancsLive and all other media outlets are currently prohibited from naming Lindsay Birbeck’s murderer due to a court order under Section 45 of the Youth Justice and Criminal Evidence Act.

This prevents the press from publishing anything which would be likely to lead members of the public to identifying the 17-year-old, including his name, address, school he attended and any still or moving image.

An application has been submitted to Her Honour Mrs Justice Yip to lift the reporting restrictions following his unanimous guilty conviction today.

Defence barrister Mark Fenhalls QC said they will be opposing the application due to the defendant’s vulnerabilities.

Legal arguments will be heard at 10.30am on Thursday before the judge makes her ruling. She said a decision will be made before the teenager is sentenced on Friday.

The Judge will also make a ruling on reporting restrictions surrounding the first murder trial which began on February 25 before being halted on March 10.

A jury of 11 women and one man were discharged from reaching their verdicts and a retrial was ordered.

Reporting restrictions were put in place under the Contempt of Court Act preventing the press from publishing the reasons for the jury being discharged.

LancsLive will bring you live coverage from 10.30am tomorrow.

I've just read that this morning. Sounds like it was something big from the last trial. I hope they name him and get his face out there! He will be 18 at the end of the year so which ever way he should be names and shamed for what he's done!
