Anyone got any guesses as to what they'll get?

I'm thinking around 3 years. Depends on any previous, I guess?

Alan Robertshaw who runs the Art of Law channel is saying about 2 years.

Yellowbelly helpfully posted a link to the relevant sentencing guidelines here.
These are the sentencing guidelines for criminal damage with a value of more than £5000. Given what we've heard so for, I think anyone convicted would be judged to have high culpability and have caused serious harm, so the start point would be 18 months in prison, which could be increased up to 4 years depending on aggravating and mitigating factors.

I feel it falls into A - High Culpability and Category 1 for Harm, so hopefully close to 4 years.

I think these aggravating factors are met:
  • Damaged items of great value to the victim (whether economic, commercial, sentimental or personal value)
  • (possibly) Commission of offence whilst under the influence of alcohol or drugs
  • Damage caused to heritage and/or cultural assets
  • Established evidence of community/wider impact
I think the only mitigating factor that can be taken into account is "No previous convictions or no relevant/recent convictions." They've not shown "Remorse" and I very much doubt they will be considered to have "Positive character and/or exemplary conduct (regardless of previous convictions)"

The authority commissioned Charlie and the Creative Communities art collective, a community interest company which creates sustainable art projects, to deliver an artistic response with the wood.

"It was very important at the beginning when we received the commission to kind of represent people that loved the tree, or knew the tree in life," says Nick Greenall, of the collective.

"It shows by its absence how much it meant to people."

Both men have been remanded into custody, in part for their "own protection", ahead of sentencing, which is due to take place on 15 July.

Mrs Justice Lambert said they should be prepared for "lengthy" custodial sentences.

I know what I'd sentence them to - although my views on crime and punishment don't really align with modern values, unfortunately.

They have finally admitted their guilt. If they had done that at the first opportunity they would have got lighter sentences. I predict AC will get a slightly shorter term than DG because he has no previous. I was thinking around the four year mark (which prosecutors have indicated in the attached).

Daniel Graham had convictions for violence and battery between 2007 and 2016 and for Public Order Act offences between 2021 and 2022.

The court heard those related to relationships he was in and he did not get any prison sentences.

Mr Graham also had a caution for stealing logs which he had chopped up with a chainsaw, the court heard.

Adam Carruthers had no previous convictions, warnings, caution or reprimands, Mr Wright said.
Sentencing hearing is underway, I expect they will adjourn shortly for lunch.

An application for the pair to wear handcuffs in court was denied.

Yeah, I thought that, because they've fallen out big time and it might get a bit punchy; but the other thing that caught my eye was the bit about the associates of Carruthers getting up and leaving the court, perhaps they were planning something, although likely this is me being a bit far fetched!

They have both been sentenced to 4 years and three months imprisonment (less time already served).

Both 4y3m, 6m to run concurrently for the second charge. Minus time already spent.
