I mentioned that at the bottom of my post. I suspect we’ll see additional charges, but as of right now he has not been charged with SA. People are misinterpreting the Probable Cause Statement of current charges.

Count 1, paragraph (d), of AW probable cause document.

We need to wait for AW advisement when formal charges will be be delivered.
It does not say he was charged of all the things in Count 1. Just the fact that she is under the age of 14 justifies the Aggregated Murder charge. ETA plus the kidnapping charge.

At the time that document was written, they did not charge him with Sexual Assault. It would be a separate charge. And IMO is likely to be added.

He has a SA charge now? Ah I can’t keep. Maybe I missed it when I read the criminal complaint? Is that where the charge is?
It's wrapped up in Count 1 of PC doc but AW has not been formally charged of anything additional since Lizzy remains recovered -- that will come at his advisement. MOO

ETA:
AW initial appearance in court for the new charges against him is scheduled to take place in the afternoon of June 3 in Logan’s 1st District Court.

Quite honestly I believe he’s a monster unlike one we’ve seen. The sexualized comments he made about the couple before he did his thing proves (to me) that’s on his mind a lot. It’s scary to even think that someone like this was out there like a ticking time bomb. How many more are? :::shivers:::

We need a complex algorithm, maybe neural network based, trained on historical cases, that can be implemted to try and detect animals like this before they strike. There are many behavioural parameters that can be used to train it.

I’m not understanding? He has been formally charged with 5 counts: aggravated murder, kidnapping, 2 counts of obstruction of justice and abuse of a human body.

Oh I agree. The comment about his sister and her boyfriend getting frisky really stuck out to me when reading the probable cause statement. Whether it was true or not, he thought they were having sex, which set him off.

I don’t think he went to the house planning the rape and murder of his niece. Something happened that set the wheels in motion in his warped brain.

Yes he was formally charged with 5 counts and will face these charges in court on Monday. It still does not charge him with sexual assault. Yet.

Same. I haven't stopped thinking about what her mom is going through, knowing that it was her own brother, who she loved & I'm sure Lizzy loved him too. I don't know how you get past something like that. She will blame herself forever, even though she did nothing wrong.
And yet even in her heartbreaking soul rending pain,and grief she asked people to donate to their library,because that was Lizzie's favorite place. I love that idea.

Oh, I love that part too. I hope the town will put up a plaque or something for Lizzy at the library. Maybe a bench for people to sit and reflect.

I want to say that this is one of the saddest cases I've followed and although it is horrific, there have been several in the last month, as well as in the recent past, that are just as sad and horrific. AJ, Maleah, Noah, Lucas, Sherrin, I could keep going on and on. The level of violence visited upon these children is horrific.

And here's the thing; Lizzy was not in the wrong place at the wrong time. I know we say that all the time, and I catch myself saying it too. Lizzy was where she was supposed to be. Lizzy was at home, asleep in her bed when evil came calling. AW was the guy in the wrong place. I have to keep reminding myself of this. The person in the wrong place was AW.

I'm just thinking out loud this morning because it seems that child abuse at this level is becoming more and more commonplace. How many times do we click onto a thread about a missing child and we collectively hold our breath because WE KNOW what's coming? We've seen it before and we are going to see it again. Children being thrown away in garbage bags, and hidden under debris in a backyard like they are nothing. They're disposable. They're trash - they're garbage. It's positively sickening to me.

I'm from Canada and we are not immune to this. It happens here too. I'm sure it's happening everywhere.

Lizzy has hit hard. She was where she was supposed to be. She was tucked into bed and should have been safe.

This has been a hard couple of months here at WS. Very hard on kids.

I'm not sure justice is the right word I'm seeking today. I'm not sure that any punishment is justice for a dead child.

This is all MOO. I'm going to go and have my coffee now and try not to think about this too much today.

My heart is breaking for Lizzy and all the children we've lost recently.


I agree with you. Morally, our culture now values the life of an animal over the life of a child. Seems we've lost our way. MOO

My guess would be that the attorneys may be using the charges of SA as another bargaining tool. Maybe saying if it goes to court, all the nasty details will be shared in court. But if he pleads guilty, then he won't be charged with SA. Plus, my guess would be that the attorneys would like to save ES's dignity and privacy, by not sharing that information...unless needing it as a last resort. MOO.

just watched the video of Lizzie's mom speaking at the candlelight vigil. Emotianlly devastating to watch. Her description of Lizzie's personality reminds me of my daughter at that age. So many things in common with my own wild child. My heart breaks for Jessica. I think she did an good job of helping us to know who Lizzie was and honoring that memory. I don't know that I could have gotten through it in her shoes.

Lizzy, my unique wild child, I love how much you love nature. You always kick off your shoes and let the earth touch your feet. We always adventure on the path less taken, your goals are always searching and hoping for a stream, a river or even a lake to dip your feet, or possibly jump right into the water. You love so many things, beautiful things that you want to share, like giving picked flowers to people or rocks that you would find. My friend called me today to tell me that she still has a rock that Lizzy gave her in her pocket and that makes me so proud to be your mom, always and forever. You are the best sister, always so helpful and so kind. You’ve taken so much time teaching your sister kind things, watching you reminds me to always be kind too,” Jessica continued.

Yes, this is thankfully starting to be a common practice in children's cases as of recent (Abby & Libby, Jayme, etc.). These young girls and their families deserve some dignity, even if they aren't on this earth with us anymore. Plus, I think we can make our own assumptions of what happened without the graphic details being shared.
Will tomorrow's hearing be live, and will this involve pleading guilty/not guilty? I sure hope to god that AW will spare this family any more pain.

BBM. You’re correct Kiranerys. The charging documents do not specifically say he sexually assaulted her. The top part of the affidavit just lists the legal reasons why anyone would be charged with aggravated murder. In this case just the fact that she was under the age of 14 constitutes Criminal Homicide - Aggravated Murder.

If they had evidence of SA, there would be an additional charge(s) of sexual assault.


The second part of the document under Probable Cause Statement lists the evidence they had at that point to justify the charges specifically against AW. There is nothing there that suggests SA. (At the time that document was written.). Additional charges may be made against him.

Yes the aggravated murder charge allows him to be charged if he killed her in the course of certain acts including sexual assault/rape OR child kidnapping (among other things).

We can all guess what this deranged monster did to her and why (rape and rage go hand in hand, BTW), but I don't need to know.

He's been charged with aggravated murder. It's a great charge because they don't have to prove intent to kill. They can but don't have to.

They have to show he either intended to kill her or knew what he was doing would likely kill her, OR he recklessly and indifferently caused her death while kidnapping her or assaulting her, etc.

He's done.
