Heidi Marie Rutchey, 46, pleaded guilty but mentally ill Monday to second-degree felony child abuse homicide in the August 2014 death of her son, Eli.

She faces a maximum penalty of up to 15 years in prison for the crime when she is sentenced on Aug. 14 in 1st District Court.

A judge has postponed his sentence for a River Height’s mother, Heidi M. Rutchey, who previously pleaded guilty but mentally ill to killing her infant son in 2013. Judge Thomas Willmore stayed his order of one-to-15-years until September 6.

Outside the courtroom, defense attorney David Perry said after the sentence was given, the judge realized Utah law requires Rutchey to be evaluated one final time.

“The judge ordered her to the Utah State Hospital but then it was continued because the State Hospital gets to have their input, whether she should go there or not,” explained Perry.

Heidi Rutchey sentenced to prison for murdering son

A judge has sentenced Heidi M. Rutchey to prison for killing her infant son almost four-years ago. Judge Thomas Willmore ordered the 46-year-old River Height’s mother to serve one-to-15-years, calling the homicide a horrendous crime.

Judge Willmore told Rutchey he would refer her to the mental health unit of the prison, give her credit for the almost four-years she has already served, and recommend to the parole board that when she’s released, they place her in a half-way house. Judge Wilmore said his sentence would hopefully help her to go forward in life without committing further crimes.
