Almost immediately after everyone was seated, Mrazik ruled in favor of the state’s request to drop the drug distribution charges — count three and four — before moving on to the motions that required greater discussion.

Richins’ attorneys then discussed their request to sever the aggravated murder and attempted criminal homicide charges, arguing that they should be tried in separate trials to avoid jury prejudice. They also argued that the mortgage fraud and forgery charges were “wholly unrelated” to the death of Eric Richins.

After much discussion on the issue, Mrazik denied the motion to sever the murder charge from the attempted criminal homicide charge saying there is an argument that the two are connected under “a common scheme or plan.”

Skye did, yes. I miss her sashaying around the courtroom in her delectable outfits. Those lemon-colored pumps with 6-inch stiletto heels added a je ne sais quoi element to the proceedings.

Oh gosh for sure, those lemon stiletto’s were not suitable for an attorney in a courtroom on a death defense case.

To me it lessens credibility, it’s a distraction and it’s just not professional.

The stated reason was a "conflict of interest" that could not be resolved. But I think that was a cover label for a simpler explanation: money.

Skye was put in the middle with questionable writings and possible witness tampering charges, but that was all resolved. But Kouri's cases and hearings kept growing, with new issues and charges that arose and got added. On top of the murder charge, there were drug-dealing charges, fraud charges, and more.

With Skye being a super high-dollar attorney, and the workload getting bigger and bigger, Kouri eventually ran out of money, and Skye was not willing to work for free. imo
 
Sorry, I should know this but do we know if the prosecution offered the defense a plea deal?

I don't think so but I think it's still early for this case.

Generally, a defendant waits until the prelim hearing when they learn all the evidence the state has against them before they'd ever consider a plea agreement. In this case, KR's initial legal team withdrew from the case (May 17, 2024) only weeks before the scheduled prelim hearing -- causing the hearing to be postponed even longer than previously delayed. The three day prelim finally held end of August, and IMO, the state has since been busy with the recent defense Motions to separate the criminal homicide and mortgage fraud & forgery into two trials.

I was all about the yellow stilettos. I think SM had been slandering Skye for looking like Morticia, so at the next appearance, she sashayed into the courtroom with a Vogue hairstyle, elegant navy suit, and the delectable stilettos. Maybe she just happened to have them in her closet.
 
A newly-revealed witness claims Kouri Richins asked them if they could get her fentanyl and propofol weeks before Eric Richins' death.


SUMMIT COUNTY, Utah (Scripps News Salt Lake City) — There’s a new person allegedly involved in the case of Kouri Richins, a Utah woman accused in the overdose death of her husband.

But this witness won’t be called to the stand, as he died in a motorcycle accident just two months ago.

Kouri’s trial is scheduled for four weeks next year, starting at the end of April. Her next pre-trial conference is Dec. 12.

11/8/24 Update: Prosecutors filed a motion on Friday to dismiss two drug charges against Richins. Filing asked the court to dismiss the charges without prejudice, meaning prosecutors would like to have the option to file charges against her again. The motion comes before a hearing Tuesday morning where attorneys are expected to debate multiple other motions — including requests from Richins' attorneys to split the charges into separate trials, to have 12 rather than eight jurors & to reconsider whether she can be released on bail. Next motions hearing on 11/12/24.
11/12/24 Update: Judge Richard Mrazik said that when he first considered bail after Richins was arrested in June 2023, she had structural ties to the community through her business & her children. Now, her children are under the guardianship of her husband's family & her business is gone. "There simply are not reasonably available means of mitigating her risk to the community & to herself or the strong incentive for her to flee the jurisdiction of the court," Mrazik said. He also said although she no longer faces the possibility of the death penalty, like she did when he last considered it, Richins is now charged with two first-degree felonies, meaning she could still spend the rest of her life in prison. Bail denied. Judge Mrazik also ruled there should be a separate trial for her mortgage fraud charges, but not for her attempted murder charge. The judge also denied a request from Richins' attorneys to try her charge for attempted murder in a separate trial from the aggravated murder charge, ruling that the two were part of a common scheme or plan. He said in both instances, charges allege she purchased fentanyl, administered it to her husband in food or drink & left her husband alone. He also ruled on other motions as attorneys prepare for a jury trial planned for next April. Mrazik granted a motion from prosecutors during Tuesday's hearing to dismiss two counts of distributing a controlled substance, second-degree felonies. The judge also denied a request to have 12 jurors on the case, rather than eight. He said Utah's law requiring eight instead of 12 jurors "may be on the wrong side of history," but it is the law he took an oath to uphold, and the U.S. Supreme Court has ruled a 12-person jury does not violate Sixth Amendment rights. He granted a motion agreed to by both prosecutors & Richins' attorneys that people will be summoned for the jury from both Salt Lake & Summit counties. Next pretrial conference hearing on 12/12/24 @ 9:30am.

12/12/24 Update: Both sides agree they need more time to make their cases for and against the Richens. The Summit County Attorney’s Office & attorneys for Richins both told that to a 3rd District Judge at a pretrial conference Thursday, Dec. 12. Richins’ murder trial was originally scheduled for two weeks in May 2025. Third District Judge Richard Mrazik has now given both teams another week in court. But he had to move up the trial to accommodate the extra time. Richins’ murder trial now begins 4/28/25. With the accelerated timeline, Mrazik also moved up jury selection to the week of 4/21/25. he sides agree the intense media coverage of the Richins murder case has complicated jury selection. Until Thursday, prosecutors & the defense thought they’d have jurors from both Summit & Salt Lake counties. But now, Judge Mrazik says he’s not allowed to call jurors from Salt Lake. That’s because of a recent order from a 3rd District presiding judge regarding in-person versus virtual jury selection. Presiding Judge Laura Scott denied prosecutors’ & defense attorneys’ request for in-person jury selection, and in her order, mentions that both sides have agreed to expand the jury pool. Scott says there’s “a significant & unwarranted burden” on jurors driving from Salt Lake to Summit County “for in-person jury selection.” Richins’ next is evidentiary hearing is 1/23/25 when the court is expected to decide which evidence will be admissible during the murder trial. Hearings are also scheduled for March & April to make other pretrial decisions. Juror questionnaire hearing on 2/3/25 @ 9:30am.
