Thank you debbiegarcia36 for your response.

Thanks to Whiteorchids and DD8 you are both correct I am only speculating.

I apologize for the wording of my original post it caused confusion among many WS posters.

All I wanted to do was illustrate Ayoola’s intent ‘especially’ when presented in their totality will justify the death penalty. The aggravated kidnapping charge just strengthens the prosecutions argument. The DA has their electronic communications and I am confident this will beyond any doubt prove all of AA’s practiced deception.

Aggravated kidnapping in this case includes ‘fraud’ which is defined as any type of deliberate or intentional misrepresentation for the defendant’s own benefit(i.e. a trick) here the victim did not know what she was agreeing to. Another example is MacKenzie had been promised one thing but AA fraudulently did another.Even if MacKenzie had agreed to voluntarily get in AA’s car and be moved, she could not have agreed to an offer or promise based on fraud (AA was a practiced deviant and hid all his malevolent phantasies).

I am not a lawyer so this is my interpretation as a lay person.

MOO

As a layperson, I think that the easiest way to show that the kidnapping was aggravated would be—that it resulted in her physical harm.

What can a man possibly say to you to at 3 in the morning for you to come out?

I want to know. I am having a hard time in the picking up women department. Well, women I can see myself with.
Maybe that he had a special gift for her to help her feel better with her Grandmothers passing or perhaps some books or information that could help her with her upcoming exam. Perhaps she was starving after the flight and he offered to take her to a 24 hr coffee shop to eat and talk.

Either he was going to take her home, KL call a friend or take another Lyft.

This guy seems to lie about every facet of his life. I wouldn’t doubt he could come up with a real good lie since he’s a sociopathic liar.

ineptitude- it has been suggested that AA picked Hatch Park because he used to live nearby, but he did not seem to know about the cameras, so he does not seem to have scouted out the park in advance of this meeting. I wonder if ML was originally going to go home and get her car, but when her plane was late, decided to take the Lyft directly to AA. I am undecided if he really had a complete plan. He would have had another situation if ML's car was at his Air B&B. I also wonder what he was telling his friend that he (AA) was with when he (AA) was arrested, if he was saying anything.

One thing that her friends said was that she did not know how to get around Salt Lake very well at all. I too had thought maybe she intended to take her car but the plane was late, however, their remark makes me think it less likely she would have been comfortable driving at that hour to NSLC. While at first it surprised me because she lived there many years, I then thought of quite a few people I know who are like that--they are familiar with their own neighborhood in the city but whip out their city map when having to go elsewhere in their city because it just is not something they do very often--well, look at GPS or Google a map probably more so than whip one out nowadays... :)

One of the friends also glanced on the mention of I thought another rape while he lived in that apartment building (that took place there or so it sounded) as well as being evicted also for not paying rent. I would have to listen to it anew but I know at least two prior rapes were referred to with regard to him and possibly more and someone can correct me if I am wrong, but it almost sounded like it was one of the reasons he was evicted, or an additional reason.

Unfortunately, none of this still tells us the reason for the park. They did mention there is nothing in this area to have any reason to head there at that hour and that it is not a nice area.

The girls did say they did not as often see her after they gained employment, more so on the weekends and that the roommates were two males, they all knew each other but it was just a roommate situation when an opening came about she took, and not one where the bunch sits around on the couch and watches TV together as buddies--but more one where each lives their own life and keeps more to their own space, etc. I found them to be pretty candid and upfront, it was quite impressive.

Just kind of jumping off of your post and providing a bit of info for those who have not had time to watch it. All of this is paraphrased not verbatim by any means I want to point out and anyone can feel free to correct me i I have anything wrong.

To the best of my recollection/jmo.

I couldn't figure out if her friends were saying she had a current boyfriend. Does anyone have any thoughts on this?

That would be cold as ice.

Okay, if ML wasn’t good at getting around SLC, I think that it’s even more likely that AA could have told her some lie, and she’d have believed him. (The point of the lie being: an excuse for him not to go to the airport, or for the Lyft not to take her to his place.

And if there’s no obvious reason for the park, that increases the chances that the real reason for the park was—so the Lyft wouldn’t have a record of her arrival at his place.

Was he known to any of her friends, before the murder? Or was that question asked? For that matter, did her friends make any comment about ‘Shaken Guy?’

No current boyfriend. Two serious relationships in the past three years, both with nice guys and relationships that ended amicably enough. They said she'd just been casually dating for the past few months after the breakup with the second boyfriend.

AA was not known to any of her friends. Nobody knew who he was and she'd never told any of them about him. They didn't mention SG.

That is a really good point--with no familiarity, perhaps she would question no address provided nor realize it was out of the way do you mean?

I believe it was said they did not know him but of course that some people may probably know him or were bound to or it was possible, I forget the exact words there, maybe someone else remembers better...

I do not recall Shaken Guy coming up at all.

All jmo.

I see SoCalGirl answered above me. Her wording is more accurate.

I want to know. I am having a hard time in the picking up women department. Well, women I can see myself with.

Hungry? Lets go for breakfast
Come over and smoke, watch a movie
Come sleep at my place, we can leave early the next morning to do XYZ
I have $500 for you, I'm downtown Ill meet you at XZY

I am guessing you have never been a young lady who wants a man, nothing will stop us from seeing a crush.

There are a million things a man could say to get a woman who is interested to meet them.

Another thing her friends shared is that her roommates were two guys and that they all pretty much kept to themselves but were friendly. ML needed a place to live and they had an extra room.

For some reason I thought they were girls but I was wrong.

That's really interesting about her not being very familiar with the city, despite living there awhile. I can definitely see him playing that to his advantage. That also makes me suspect he may have told her he'd drive her home later that day--with no intention of doing so.

I'm not much of a navigator myself, so all my friends know if they want to go somewhere with me, they better be driving, and it's one of the first things I ask about when making plans with someone. I suspect ML may have been the same way since her friends mentioned it. I wonder if in her messages with AA she expressed some unfamiliarity or discomfort with the idea of having to navigate around more unfamiliar areas, and he saw it as an opportunity and pounced. :(

This also makes me think he must have been the one to suggest the park since he had lived near there before. The fact she apparently didn't express any surprise about the location and how far it was from the city to the Lyft driver makes me think he must have been able to cobble together an explanation/excuse that didn't immediately make her uneasy.

@SoCalGirl @ilovechili Thanks to both of you!

Right—without familiarity with the area, she’d be more likely to believe whatever lame excuse he gave for sending her where he wanted her to be.

Assuming that Shaken Guy was telling the truth, his negative reaction to whatever she told him about AA might have been the reason she didn’t tell her friends about AA. (Didn’t want to have more friends warning her about him.) Or, it might have been something more simple, such as the connection being too recent, or having other things to talk about with her friends.

if she had a interest for whatever reason, personal, business, not limiting it to what the interest could have been then I understand why she went, I can not at all comprehend that she would have went for extortion or any kind of a threat. short of holding a gun to a adult how would anyone make a adult come to them at a place and time the adult didn't want to go? I'm sure she had not a clue that she was going willingly to someone that was going to cause her death. moo.

It could be as simple as him offering her free use of his AirBnB room (and perhaps describing it in luxurious terms). Since she apparently had time off from work (from the podcast last night - which is great), maybe she thought it would be cool to have a "vacation-like" experience for a couple of days. "It's hard to find, I'll pick you up at Hatch Park."

Give it up with your judgy attitude already.

This is exactly what I think happened.
Additionally, I think he hit her in the head as soon as she got into the car and HE turned her phone off.
No struggle, no noise...I think as she was putting her bags in his trunk, he was getting ready and applied the blow to her head that killed her as soon as she sat in the car (it was the left side of her head, no?)
I do not think she liked this guy nor was dating him in the traditional sense...come on...like any of us really believe that was her type to date...really date.
I think they met at the park because she was picking up something. Called when she got back into town, he said he was already out and about and he would meet her and then drive her home. Do any of us know if she even had a car of her own?
The podcast last night was great and very informative. What a great, strong group of friends she had rallying around her.
The details of this case are heartbreaking. I do hope justice is served for ML, her loving family and her friends. Her lifestyle and ALL the details of their meetings will come into play in the courtroom on this because LE already knows everything. Every text, every detail. I hope for strength for the family as they sit through all of this.
I hope he never sees the light of day again.

Yes, she had her own car. It was at her home.

I don’t think we know enough about her or him to know whether he could have presented himself in a way that interested her.

Possible perhaps a place without roommates to study for her test or just veg a few days and mourn her Grandmothers passing.

I confess that I’d also assumed that her roommates were female. Knowing that they’re male changes my perspective a little bit. They might well be the nicest guys in the world, and probably are, but somehow I can visualize the apartment dynamics being such that the offer of a quiet peaceful room might be very attractive. :(
