I thought he was being charged with 1st-degree aggravated Murder. I'm not sure where the 2nd-degree murder conversation came from but I got confused and thought I missed something somewhere and his charges were downgraded.

I’m no lawyer, but my guess is that the evidence they have shows she willingly met up with him and any of their texts show normal conversation arranging to meet when she got back to town. If they go for 1st degree they may not be able to prove it, so 2nd degree is safer because he may try to say it was an accident during rough consensual sex, which might be enough to raise reasonable doubt with a jury.

Even if he is only convicted of 2nd degree murder, this man will never walk free again. Too much against him.

Quite likely is the case, I agree. I too believe he will never be free. Everything he did even after was too horrid and heinous.

*Scheduling Conference Hearing (re Kenzie’s case) (@ am MT) - UT – MacKenzie “Kenzie” Lueck (23) (June 17, 2019, Salt Lake City, reported missing June 20, 2019, found June 26, 2019 charred female human tissue & bone, part of her scalp with hair, burned cell phone & personal belongings (clothing) burned & buried in his Salt Lake City backyard; body found July 3, 2019 in Logan Canyon (about 85 miles north of Salt Lake City).) - *Ayoola Adisa Ajayi aka “Joy” & “AJ” (31) arrested & charged (6/28/19) & formally charged (7/10/19) with criminal homicide 1st degree felony aggravated murder, 1st degree aggravated kidnapping, 2nd degree desecration of a body & 3rd degree obstruction of justice. Held without bond.

*Charged (8/13/19) with 19 counts of possessing child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬.
8/13/19 Update: An additional 19 charges were filed Tuesday of possessing child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬. The images are mostly of children between the ages of 4 and 8 years old, the charges state. 9/9/19: Preliminary hearing another set for 10/21.
*Charged (8/20/19) with 1st degree felony aggravated kidnapping & 3 counts of 2nd degree felony forcible sexual abuse.
8/20/19 Update: as been charged with aggravated kidnapping & 3 counts of forcible sexual abuse of another woman in March of 2018, were filed against Ajayi in the Third District Court Tuesday, 8/20.
8/23/19 Update: Had preliminary hearing sexual assault cases. No plea entered. Next preliminary hearing on 9/9. 9/9/19: Next preliminary hearing on 9/26.
9/26/19 Update: Third District Judge Vernice Trease accepted the two-page statement over the objection of Ajayi’s defense attorney Neal Hamilton, who said it was inconsistent with the woman’s initial statement to investigators. A written testimony from victim entered. Trease said she would allow Ajayi’s attorneys more time to work on a subpoena, but that doesn’t mean she’ll require the woman to testify. The judge also did not immediately rule Thursday whether the statement provides evidence for the case to go to trial. Waived his right to a speedy trial. Hearing (for assault) is scheduled to continue Nov. 27, when Ajayi will have a chance to testify in his own defense.

Man charged with Mackenzie Lueck’s murder appeared in court Monday

The next date he is scheduled to appear in court for charges related to the murder is March 11th.

“...the judge agreed to push back the next court date to determine if the case will go to trial.”

  • AA appeared in person at the Matheson Courthouse for a scheduling conference.
  • The judge scheduled a two-day preliminary hearing for March 11 – 12, 2020.
  • Evidence will be presented at the preliminary hearing to see if the case will advance to trial.

Wow -- doesn't 6 months until a preliminary hearing seem an extended period here?

Having just watched Utah justice for Lizzy Shelley (5) murdered by her uncle - I thought Utah courts extremely efficient -- (granted AW plead guilty)...

It does, but then again, I'm not familiar with the judicial system in Utah. I can say one thing though; this case is complex, and that's an understatement. :eek: MOO

Hopefully we never see another case like this.

Hopefully some will see just what and who they can connect with online and even in person and this will save others.

It is sad we cannot trust anyone.

I think Kenzie was naive and he knew exactly what he was up to and had an intent.

I have worse words but they are probably not allowed.

Sometimes I think this world has slid backwards. Empowerment? I don't think so... What a sales pitch though...

It is truly a scary world. Evil all.around lurking.on anyone they can touch. So hope her family.is doing ok.

I don’t think Kenzie was as naive as it may seem...I think the problem is that the massive amount of evil on the part of AA makes everything pale in comparison.

I think Kenzie was young and making some decisions that, as parents at least, we all hope our own children wouldn’t make, but that’s all part of growing up. Many of us got out of bad decisions we made without any negative consequences, but Kenzie got caught in the worst spider web that was ever woven (weaved?) and paid consequences 1000 fold.

I believe 100% that her death may have saved many lives, because there’s no question AA would have continued on if he hadn’t been caught. Not to mention victims of child 🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬🤬 and who knows what else he has been subjecting people to.

If we were not living in such a technologically advanced time, he would have had time to kill others before he was caught.

Her family must still be feeling so numb and in shock. Everything in their world changed in such a short time and nothing can ever be the same again.

I do not mean naive in an offensive way, I mean it in the way you say, that when we are young we do not always make the wisest choices or as well thought out ones as we may do when older. That in no way is putting this on her. Who would EVER expect to meet a monster like this one? He somehow stayed under the radar for years. I think what often plays in our youth too is never believing anything will happen to us, we feel somewhat invincible.

I cannot even begin to imagine what her family is going through. Loss is hard enough without such details of a crime such as this.
