You may have noticed that in this trial ...the hearsay rules are often disregarded, particularly by the defense. But these prior statements being used to impeach the witness are permissible, despite the general hearsay rule.

If there was ever a topic that confuses me it's the hearsay. So many exceptions. Hats off to you. Cuz I get soooo confused. Now please consider I am Canadian. Do the hearsay rules vary? Meaning State to State? I hope this isn't a stupid question LOL

There might be slight variances from state to state but they are pretty consistent and usually based on the federal rules of evidence.

And don't worry because most attorneys get confused about hearsay too

I guess I missed that part - what happened?

The state moved to have her emails moved into evidence, the emails where she explains that her relationship w/ dr. M has become more serious and rejects a prospective suitor.

The defense objected based on hearsay: the emails are an out of court statement offered for the truth of the matter asserted. The judge asked the prosecutor if he had an exception to hearsay and he froze. The judge tabled it and then came back a few minutes later and threw them a bone and admitted them into evidence.

Yes they are and he has a case of darty eyes. She's a wild card with cleavage.

The defense is allowing these compound questions because they add to the confusion. Objection....compound question!!!

Approach and refresh her recollection. Point it out. This is stupid.

She certainly is cavalier at this trial.

She has said several times that it was "..a VERY long time ago" as an explanation for her failed memory then she laughs a little. What, pray tell, is so damn funny?

So why did Gypsy go to the funeral of Michele? Was this at the request of Martin or did she just decide to show up?

Oh so the prosecutor had no reply as to why they were admissible? Yeah, that's pretty shoddy. But I like this attorney better than his younger co-counsel.

Reception between two parties is greatly enhanced if they are both in the same building burying one of their spouses.
