I am more concerned about the testimony coming from someone who is clean as a whistle and as dirty as they come. Kinda like MacNeill before his daughters understood the father they knew was a total sham and started pressing for justice for their mother.

Just outline what each inmate has done/been convicted of and let the jury weight that in.

I am going on gut instinct with Mr. P - there is so much information that this inmate is an opportunist/criminal and all around bad guy, and I feel this will come across to the jury and not help the prosecution.

It will be interesting to see how this plays out!

I have noticed some witnesses seem well prepared as if they have refreshed their memories before appearing in court and others like this current gentleman have no recollection while testifying.

Are there posters here with a legal background? How do you feel? Better for your witness to be prepared or wing it?

WHAT THE FRACK???? The things that website says about Damian make me so angry! The defense was trying to throw HIM under the bus?!?!?!? :stormingmad:

In a motion to the court on Dec 17, 2012, MacNeill’s defense attorneys suggest that Damian may have been involved in his mother’s murder. In the motion, among other things, it states, "Investigators in the Utah County Attorney’s Office deemed (Damian MacNeill) to be a very dangerous individual who possessed homicidal impulses and discussed the "joys of killing". Yet defense attorneys claim that Michele’s death was not a homicide.

The State is outlining their case and this witness is agreeing that if he had known ... would that have raised suspicion.

The defense is a big, fat copycat. :P

Inmate #3 is up. He met Martin in Texarkana Federal Prison.
