I'm listening to Spencer's closing cuz I missed most of it. He just does not communicate very clearly - it is always confusing.

Ok just got done watching the guy who sold fake rolexes.

McNeill is guilty. I have felt he was even before the trial,I watched the 20/20 about this case. For his own daughters to feel that he is guilty tells me a Lot. They know their father better than anyone. Hopefully the jurors will feel the same way.

I really hate that I have not been able to keep up with this trial. :tantrum:

So true! A few weekends ago, the whole family drove down to St. George, UT for the weekend (about 4 hours). On the way down, I talked through all the scummy things Martin had done. Despite the fact that WE'RE TALKING ABOUT ONE OF THE MOST NARCISSISTIC PEOPLE WHO HAVE EVER WALKED THE PLANET, about an hour into it, they were clearly getting bored. But by then, I was on a roll, and there was no stopping me. Eventually, I look back and my little girl has stealthily slipped on headphones, my son is asleep, and my wife is in the passenger seat, sneaking glances at a Reader's Digest.

I thought they all seemed a little thankless! I could have been obsessing over the Denver Broncos (one of my other big vices).


Big Broncos fan here too.

In speaking with prosecutor Chad Grunander after court today, he informed me that the state is not going to ask for lesser included charges. They believe Martin MacNeill planned this murder.

However, as well as arguing that he premeditated Michele's murder the judge will allow the argument that MacNeill acted with depraved indifference.

To constitute depraved indifference, the defendant's conduct must be 'so wanton, so deficient in a moral sense of concern, so lacking in regard for the life or lives of others, and so blameworthy as to warrant the same criminal liability as that which the law imposes upon a person who intentionally causes a crime. Depraved indifference focuses on the risk created by the defendant’s conduct, not the injuries actually resulting.

The jurors do not need to be unanimous on one or the other. For example of the 8 jurors, 6 could decide premeditated while 2 are more comfortable with depraved indifference and he would still be guilty of 1 degree murder.

Hi,first post here. I have not go to watch all of this trial. I am catching up now. What is the consensus here? Guilty or not? I'm going to watch archives of days I have missed so I can decide. I feel in my gut he is guilty,but don't know if pros proved it or not. I am watching the inmates testimony now.

I hate when I get behind in live trials like this. My luck a verdict will come in when I am catching up!!!!!

Your feelings are pretty common around here. He did it, but can they prove it.

This is a good place to hang out, through in come cases like the Jodi Arias trial it is IMPOSSIBLE to keep up with the fast flow of comments. The mods do a great job keeping us under control so we can have intelligent discussions.

I think you mean Rolex paraphernalia, right? According to Spencer, he was dealing in Rolex paraphernalia.

Rolex paraphernalia is WAY worse than just fake Rolexes. :facepalm:

There has been no decision on how long they will deliberate tonight. The judge is probably going to let them decide. #MartinMacNeill

Were any charges filed or will they be filed against MM for false info in his medical and lawyer degree, for military ID card and any benefits he got, for any SS benefits he got or anything else he falsified?

thank you for all the great information. I like these options...as I mentioned earlier I think Martin MacNeill is the poster boy for "depraved indifference" and one would have to be sitting in a different courtroom not to have seen that with every witness every day.

No, but stupid move on any attorneys part to bring NG up after juror questioning. The reason potential jurors can be asked is b/c the entire 30 seconds of shows (after commercials) is all prosecution directed. Hang 'em high and dry before there is even a case. Really should never be asked in any trial, it is a moot point. Any intelligent attorney, prosecution or state, must approach jurors with personal questions during Voir Dire that will reflect the jurors feelings on issues, not what t.v. told them.

{Just gives NG's shows boosts, which IMO the shows should not exist. They are harmful to any case broadcasted, from a legal point of view.}
