When he arrived on scene, Fields was in handcuffs sitting on the side of the road where he was pulled over. Kirschnick described Fields as calm and wide-eyed. He was also sweating profusely and cooperative.

NBC29 Fields Trial‏ @NBC29Trials 5m5 minutes ago
Kirschnick said Fields had a stain on his shirt and a light smell of ammonia. He also said Fields said he felt light-headed and asked to sit down at the police department.

Prosecutors use Hitler image texted to mother in James Alex Fields murder trial

December 4, 2018

"WASHINGTON — James Alex Fields told Charlottesville authorities he thought he was in danger when his car collided with a crowd counterprotesting 2017’s “Unite the Right” rally, killing one and injuring dozens.

On what was the final day of prosecution witnesses, prosecutors showed jurors a text message James Alex Fields sent to his mother — which included a photo of Adolf Hitler — to demonstrate he expected a violent confrontation at that white nationalist rally in Charlottesville.

On Tuesday, jurors heard from detective Steve Young, whose body-camera video of Fields being searched provided jurors their first chance to hear Fields’ voice.

“I’m sorry that — I don’t know. I didn’t want to hurt people, but I thought they were attacking me,” Fields told Young.

Later, in a police headquarters interview room, Fields was read his Miranda rights, and declined to speak. When told several people were severely injured and one had died, Young testified Fields hyperventilated for several minutes...."

Updated: Video and Audio Recordings of James A. Fields Jr. Played for Jury

Dec 04, 2018

"CHARLOTTESVILLE, Va. (WVIR) -
Defense attorneys for James Alex Fields, Junior are presenting their case to jurors in Charlottesville Circuit Court.

The commonwealth rested Tuesday, December 4, having presented its case over the course of four days. Throughout the morning and early afternoon, the commonwealth gave jurors new insights into Fields, the man who was behind the wheel of the car attack in downtown Charlottesville on August 12, 2017.
The commonwealth played police body-camera footage from Charlottesville Police Detective Steven Young – who also testified on Friday - while he interacted with Fields at the scene of his arrest on Monticello Avenue. ...

Jurors also saw a detective reading Fields his Miranda rights. After hearing of many people being injured and one casualty on Fourth Street, Fields appears to hyperventilate for several minutes before calming down.

Later, Fields was taken to the jail and questioned by a magistrate. Fields told authorities he was trying to go home and saw crowds forming around cars in front of him. He didn't know what to do and said he got a feeling he didn't know how to describe. Fields did not elaborate further in the video.

The nine women and seven men on the jury - four of whom are alternates - have mostly heard testimony from victims of the car attack that occurred hours after the Unite the Right rally was held in downtown Charlottesville....

Judge Moore told jurors that they should expect to hear from seven or eight witnesses Wednesday, and one more on Thursday. The judge said closing arguments could be presented Thursday afternoon."

The Latest: Defense set to present case in rally death trial

"CHARLOTTESVILLE, Va. (AP) — The Latest on the trial of a man accused of deliberately driving his car into a crowd of counterprotesters at a white nationalist rally, killing one and injuring dozens more. (all times local):

3:15 p.m.

Prosecutors have rested their case against an Ohio man accused of killing a woman and injuring dozens when he drove his car into a crowd of counterprotesters at a white nationalist rally in Virginia last year.

The defense is set to begin presenting its case Tuesday afternoon to jurors in the trial of James Alex Fields Jr., who is charged with killing Heather Heyer and injuring dozens at the 2017 rally in Charlottesville.

Lawyers plan to call witnesses to support Fields' claim that he was acting in self-defense when he drove into the crowd....

1:05 p.m.

A judge is allowing jurors to see a text message including an image of Adolf Hitler that was sent by the man who drove into a crowd of counterprotesters at a white nationalist rally in Virginia.

News outlets report Judge Richard Moore ruled Tuesday that prosecutors can show the text James Alex Fields Jr. sent his mother days before the 2017 rally. It was a response to his mother's plea to be careful. Fields wrote "we're not the one (sic) who need to be careful," accompanied by Hitler's image.

Fields' attorneys argued that the image would prejudice the jury. But the judge said it shows intent or motive of violence...."

Driver sobbed after learning he killed woman at Virginia rally

•December 4, 2018

"CHARLOTTESVILLE, Va. (Reuters) - The white nationalist who drove a car into a crowd of counterprotesters at a Virginia rally last year began sobbing and whimpering after his arrest when police told him he had killed someone, according to video played at his trial on Tuesday.

Within minutes of the mayhem at the "Unite the Right" rally in Charlottesville on Aug. 12, 2017, James Fields could be heard on footage recorded by a detective's body-worn camera saying he acted in self-defense.

"I didn't want to hurt people, but I thought they were attacking me," Fields told the police, according to the video footage played to the jury, who will soon vote on whether to convict Fields on 10 charges, including murder.

After police arrested him, Fields, 21, asked at the police station about the extent of the injuries he caused.

"There were people with injuries, one had passed away," a detective tells Fields, according to video footage from the police station.

Fields is then heard sobbing, whimpering and gasping for breath.

Steven Young, the lead detective on the case, testified that it took about two minutes to calm him down. "Mr. Fields appeared to be in a panic," Young told the court...."

The defense's first witness of the day is Haden Calhoun, who is from Richmond and attended the Unite the Right rally on August 12, 2017. #FieldsTrial

NBC29 Fields Trial‏ @NBC29Trials 4m4 minutes ago
Clahoun arrived with his girlfriend in Charlottesville around 10 a.m. on the morning of the rally, parked at the Jefferson School, and walked to Emancipation Park. They were there for about 45 minutes before going to McDonald's to use the restroom.

NBC29 Fields Trial‏ @NBC29Trials 4m4 minutes ago
When they walked back, they saw thst violence had erupted and tear gas was being deployed. A group walked by and told Calhoun and his girlfriend to join them in walking to McIntire Park, where the backup location was for the rally.

NBC29 Fields Trial‏ @NBC29Trials 3m3 minutes ago
When they got there, National Guard was not letting them into the park. At that point, Calhoun and his girlfriend met Fields and nother protester. The group decided to stay together for safety and walk back to their cars.

NBC29 Fields Trial‏ @NBC29Trials 3m3 minutes ago
On the way back, the group encountered counter protesters who shouted at them. One member of Calhoun's group shouted back, but he didn't remeber who.

NBC29 Fields Trial‏ @NBC29Trials 2m2 minutes ago
The group got to Fields' car, who drove Calhoun and his girlfriend to their car. Fields asked them if they wanted to get lunch, but they said no because they wanted to go home.

NBC29 Fields Trial‏ @NBC29Trials 58s59 seconds ago
About three days later, Calhoun contacted the FBI after learning that Fields was involved in the car crash on 4th and Water.

NBC29 Fields Trial‏ @NBC29Trials 1m1 minute ago
During cross examination, Calhoun clarified the timeline of the day and said he was wearing a white polo that day to match the protesters.

The next witness was Virginia State Police tropper Cliffird Thomas, who is a crash reconstructionist.

NBC29 Fields Trial‏ @NBC29Trials 6m6 minutes ago
According to aerial footage of the crash and calculations made by Thomas, the Challenger was going 28 mph before impacting the crowd on 4th and Water.

NBC29 Fields Trial‏ @NBC29Trials 6m6 minutes ago
To explain further, the Challenger was traveling at 28 mph when behind a parked pickup truck on 4th Street and 23 mph by the time it passed the truck. There were people in the area in between, but it was not said whether or not impact with pedestrians caused deceleration.

NBC29 Fields Trial‏ @NBC29Trials 5m5 minutes ago
Thomas gathered data from the Toyota Camry impacted by the Challenger. According to that data, the Camry traveled at a speed of 17.1 mph in 160 milliseconds after beiglng impacted by the Challenger.

NBC29 Fields Trial‏ @NBC29Trials 7m7 minutes ago
To clarify, the Camry was parked, traveling 0 mph before impact and traveled 17.1 mph in 150 milliseconds (this is a correction) after impact.

NBC29 Fields Trial‏ @NBC29Trials 3m3 minutes ago
Thomas said no airbags were deployed in the Challenger. From data collected from the Challenger, it was traveling 23 mph when it reached the rear of the Toyota Camry.

NBC29 Fields Trial‏ @NBC29Trials 2m2 minutes ago
During cross examination, Thomas clarifed to the prosecution that 17 mph was the speed of the parked Camry after being impacted, not the speed of Fields' car.

Sara Bolstad, girlfriend of earlier witness Haden Calhoun, testified next. #FieldsTrial

NBC29 Fields Trial‏ @NBC29Trials 24m24 minutes ago
Bolstad said Calhoun wanted to come to the rally to listen to speakers, including Chris Cantwell. She said she would not have gone if he didn't want to.

NBC29 Fields Trial‏ @NBC29Trials 22m22 minutes ago
After being at the rally for about an hour, Bolstad said they left so Calhoun could use the bathroom. When they came back, they saw violence break out and people throwing bottles of urine. They were then told to go to McIntire Park, the backup location of the rally

NBC29 Fields Trial‏ @NBC29Trials 21m21 minutes ago
On the way, groups stopped at a Shell gas station to get milk to treat people who were pepper sprayed. Bolstad was worried about being in a large group since and unlawful assembly was declared, so they separated from the group.

NBC29 Fields Trial‏ @NBC29Trials 20m20 minutes ago
Bolstad and Calhoun were then approached by Joshua Matthews and Fields, who said there is safety and numbers and offered to walked back toward downtown with them. On the way, counter protesters yelled at them and Matthews yelled back. Bolstad said Fields did not.

NBC29 Fields Trial‏ @NBC29Trials 19m19 minutes ago
Bolstad described Fields as calm and not angry. She said Fields was wearing a white polo with a yellow stain on it. They got to Fields' car, who offered to drive them to their car. They got in and Bolstad noticed his car was cleam and well-taken care of.

NBC29 Fields Trial‏ @NBC29Trials 17m17 minutes ago
Bolstad said nobody in their group had any weapons, helmets or flags. She said she did not feel uneased around Fields. They were invited to go to lunch with Matthews and Fields, but declined because they wanted to go home

NBC29 Fields Trial‏ @NBC29Trials 17m17 minutes ago
Later, the two were made aware of the incident on 4th Street. They recognized the vehicle, but didn't think it was Fields. "Didn't seem like to kind of person to do that" said Bolstad.

NBC29 Fields Trial‏ @NBC29Trials 16m16 minutes ago
When they found out it was Fields from the news, they initially decided to never tell anyone. Soon after decided to tell FBI and cooperated with questioning.

NBC29 Fields Trial‏ @NBC29Trials 14m14 minutes ago
During cross examination, Bolstad said they decided to go home instead of staying in Charlottesville because Calhoun's mom called and was "freaking out" because of the car crash. She offered to pay them the money for their Airbnb if they decided to come home.

NBC29 Fields Trial‏ @NBC29Trials 13m13 minutes ago
The prosecution asked Bolstad if she identifed with UTR protesters in the park. She said "I guess." Bolstad and Calhoun wore white polos so they would have backup from other protesters if fights broke out.

NBC29 Fields Trial‏ @NBC29Trials 13m13 minutes ago
Bill DePue testified next. He is a digital forensic examiner in Fairfax, Virginia. #FieldsTrial

NBC29 Fields Trial‏ @NBC29Trials 13m13 minutes ago
After examining data on Fields' phone, DePue took information from Google Maps on August 12, 2017.

NBC29 Fields Trial‏ @NBC29Trials 12m12 minutes ago
At 1:39 p.m. that day, Google Maps generated two route to Maumee, Ohio. One route directed Fields to drive down E Market St. to Old Preston and the other directed him to turn right onto E Market from 4th Street NE toward 9th Street.

NBC29 Fields Trial‏ @NBC29Trials 10m10 minutes ago
During cross examination, DePue told the prosecution there is no way to determine which route Fields took and that no routes directed him to drive down 4th Street toward Water Street.

Edmund Davidson was in Charlottesville taking photos on August 12, 2017. Davidson is the son of a Confederate veteran.

NBC29 Fields Trial‏ @NBC29Trials 9m9 minutes ago
The defense shared photos taken by Davidson that day. His photos included pictures of armed police throughout the park and on roofs. Also included pictures of protesters suffering bleeding and treating pepper spray.

NBC29 Fields Trial‏ @NBC29Trials 7m7 minutes ago
Another photo showed counter protesters holding a sign saying "This Machine Kills Fascists." Davidson said "when I saw the word 'kill' that changed my entire perception of that day." Thought "they're here to kill me."

After the unlawful assembly was declared, Davidson moved to the downtown mall, where he took a photo of a VSP armored truck. There was no cross examination.

Updated: Defense Attorneys Continue to Call Witnesses in Fields Trial

Dec 05, 2018

"CHARLOTTESVILLE, Va. (WVIR) -
Attorneys for James Alex Fields, Junior are expected to rest their case Thursday, December 6.

The defense called six people to the witness stand Wednesday, December 5. Attorneys for the 21-year-old Ohio man are expected to call two more people to testify inside Charlottesville Circuit Court Thursday morning....

Jurors saw photos taken by Edmund Davidson, who also took the witness stand Wednesday. His photos included pictures of armed police throughout the area of the rally and on rooftops. Fields could be seen in some of Davidson’s pictures. There were also pictures of protesters bleeding and being treated for pepper spray.

Davidson told the court he thought counterprotesters might kill him after he saw one holding a sign saying "This Machine Kills Fascists."...

Philip DePue, a digital forensic expert, examined data on Fields’ phone. His testimony went over two routes Google Maps suggested to Fields around 1:39 p.m. in order for him to get back to Ohio....

Also called to testify were Hayden Calhoun and Sara Bolstad, a couple who attended the Unite the Right rally together. Calhoun recounted how they met Fields and a fourth person - later identified as Joshua Matthews during Bolstad's testimony. The four of them stuck together, and Calhoun said Fields later invited the couple to go get lunch....

Charlottesville Police Detective Steven Young was also called back to the witness stand. Young went over much of the same evidence brought forth by the commonwealth Tuesday regarding data pulled from Fields' phone.

Court was initially delayed for about two hours Wednesday. Judge Richard Moore announced that something was said in the presence of a juror Tuesday that needed to be followed-up on. The judge said it did not affect the trial.

Judge Moore said at the end of the Wednesday’s proceedings that he hopes to move into closing arguments after the courts’ lunch break Thursday."

After reading news articles and tweets over the last two days, it seems to me that the defense from Fields' lawyers is more vapor than anything else. I agree with Molly Congor's tweet: "i have been waiting and waiting for the defense's strategy to coalesce into something coherent. for the moment it zooms out and you can see all the bread crumbs actually form a trail to... something? and it hasn't happened. it's all loose ends and false starts. it's nothing."

But lo & behold.. Tomorrow, Dwayne Dixon will be one of the last two defense witnesses.

Day 9 is about to begin. The defense is expected to call two more witnesses this morning and attorneys on both sides are expected to deliver closing arguments this afternoon. #FieldsTrial

NBC29 Fields Trial‏ @NBC29Trials 1h1 hour ago
Dwayne Dixon was the first witness of the day. Dixon is a UNC-Chapel Hill professor of Asian studies and was at the Unite the Right rally with a group of counter protesters called Redneck Revolt.

NBC29 Fields Trial‏ @NBC29Trials 55m55 minutes ago
Dixon's group was providing perimeter control for counter protesters. Dixon was carrying at AR-15 rifle on August 12, 2017. He testified that he saw a gray Challenger 3 times that day on Market Street but did not see Fields through the tinted windows.

NBC29 Fields Trial‏ @NBC29Trials 53m53 minutes ago
On the third encounter with the Challenger, Dixon stepped off of the curb and yelled "get the **** out of here" at the car. His rifile was pointed at the ground at this time and Dixon said he did not threaten the car with his gun.

NBC29 Fields Trial‏ @NBC29Trials 52m52 minutes ago
CORRECTION: Dixon did not testify that the car he saw was a Challenger. He described it as a gray muscle car.

NBC29 Fields Trial‏ @NBC29Trials 46m46 minutes ago
After Fields was identified as the driver of the Challenger who drove into the crowd on 4th and Water Street, Dixon posted a photo Facebook. During cross examination, Dixon said he did not see the crash because he was being interviewed.

NBC29 Fields Trial‏ @NBC29Trials 3h3 hours ago
Matthews was in Charlottesville on August 12, 2017 to attend the Unite the Right rally and gather with "like-minded people."

NBC29 Fields Trial‏ @NBC29Trials 2h2 hours ago
Matthews described the scene outside of the park as "pandemonium" and the inside of the park as relatively calm. After an unlawful assembly was declared, Matthews left and followed people who were headed to McIntire Park. He did not know the purpose for going there.

NBC29 Fields Trial‏ @NBC29Trials 2h2 hours ago
On the way to McIntire Park, Matthews met Fields. The two decided to return to their cars downtown where it was safer because they saw people who had been pepper sprayed and were bleeding. They asked if other people wanted to go back and that's when they met Calhoun and Bolstad.

NBC29 Fields Trial‏ @NBC29Trials 2h2 hours ago
The group stopped at a Shell station to get drinks. Matthews bought a cigar to celebrate their safe return. On the way back, they were yelled at by a group on the other side of the road which Matthews described as ANTIFA. He said Fields yelled back at the group.

NBC29 Fields Trial‏ @NBC29Trials 2h2 hours ago
Fields offered to drive everyone back to their cars. After dropping off Calhoun and Bolstad, Fields drove Matthews to the Market Street parking garage. Matthews said they made plans to get lunch, but Fields did not show up.

NBC29 Fields Trial‏ @NBC29Trials 2h2 hours ago
During cross examination, Matthews said that Fields was not angry or aggressive when he yelled at the group across the road. Earlier, he described Fields as calm and a little scared throughout the day.

NBC29 Fields Trial‏ @NBC29Trials 2h2 hours ago
Judge Moore is holding Matthews in contempt. He said "I'll deal with you later on today." Moore originally did not show up to testify today.
