I agree.

Rather, it sounds like an idiot was challenged by another idiot who flashed a weapon at him (a rifle) when he did not truly need to. The second idiot then turns his car into a weapon and attacks a softer target.

There was no reason to “wave somebody off with a rifle” who did not pose an imminent threat. The idiot with the rifle is also a professor and should have known that macho weapons flashing could be very provocative in that setting.

Though the professor may have uhmmm…… “secured” their “western perimeter”- love the semi military jargon favored by militias on both sides, he could well have contributed to Heather’s death at the hands of an attacker who “one upped” him.

I don’t think Heather's death bothers the professor at all though. Heather, to him, is just a side note in his "me centered" narrative.

Yes. And I'm a bit worried that the defense plans to use the "nutty professor" as their witness.

4:45 p.m. update:

Two witnesses have testified so far in the afternoon session of the fifth day of the trial of James Alex Fields Jr., including the lead investigator for Charlottesville Police Department. Fields is being tried on a raft of state charges including first-degree murder in the car attack that killed Heather Heyer and injured 35 others.

Corporal Steve Young confirmed that Fields did not stop his car after hitting the crowd at Fourth and Water streets. Earlier in the day, Young said, Fields was in what is now Market Street Park with other Unite the Right protesters and had acquired a shield.

During Young’s testimony, prosecutors played several videos of the rally, the car attack and its aftermath...."

Ryan Kelly, who at the time worked for the Daily Progress, said he was taking pictures at the violent rally on Aug. 12, 2017 when he saw a grey Dodge Challenger reversing uphill on the one-way street.

From the defense point of view, I think it makes sense

The professor not only seems to relish attention, but also seems to view himself as an assertive "protector". What he does not realize is that one side's "assertive protector" is the other side's "threatening goon".

I think that skilled questioning by the defense could get the witness to really emphasize how macho assertive he was in his "protector role". Maybe even entice him to claim a leadership role in the "perimeter defense" ie
- Did you make others aware of the "threat" posed by the vehicle?
- What other steps did you take to "defend" the perimeter? after you pointed the rifle?


The defense will then flip the point of view and argue that the defendant feared an attack by armed goon who had pointed a weapon at him and appeared to be directing others to attack. The defendant feared for his life and was then forced to ram his way out of a trap that Professor Anarchy was closing.... .

Even if the jury does not buy the "self defense" claim in its entirety, the professor's weapon flashing makes both groups as a whole look like "mutual combatants". This can reduce sympathy for the victim, even though there is no evidence that she had attended the protest ready to fight, much less engaged in any fighting.

Yeah, I think Dixon is an egotistical nut who could be manipulated by the defense. But hopefully the prosecution can effectively squash the "terrified kid fleeing for his life" defense. The factors I mentioned in post #75 are obvious.

I think you are right.

The evidence that the defendant went to Charlottesville with at the very least, a pre disposition to make an attack, that he had not been trapped by angry rivals, and that he later boasted of the attack is overwhelming. Like many criminals, the defendant is his own worst enemy.

I still cant help but think that if the defendant and professor anarchy had not engaged in a "one upping" contest ( I"ll screw with them by cruising by real slow several times, Screw with us- I"ll threaten you with a rifle, OK, we will see who really has the nerve to do what- reversing now....), Heather might still be alive. I think she would be.

My general understanding of the Napoleonic code is that Professor Anarchy would also be charged with Heather's death (though not to the same degree as the attacker). Of course, we don't have Napoleonic law. Rather, our legal system is Roman based and centered on whether one did an illegal action or not- period. Sometimes, however, I wish we had Napoleonic law.

"Charlottesville, Virginia (CNN)The man on trial for killing Heather Heyer at a white nationalist rally in Charlottesville, Virginia, last year shared two images on Instagram that showed a car hitting protesters months before he did exactly that, according to court documents.

The images were released on Day Two of the trial of James Alex Fields Jr., who is accused of driving his Dodge Challenger into a crowd of counterprotesters during the August 2017 Unite the Right Rally, killing Heyer and injuring several others.

The posts -- shared in court documents posted to the city's website Friday -- are similar to each other. One was sent in a private message on May 12 while the other was a public post shared four days later, according to court filings....

The prosecution said in its opening statement Thursday it would present the posts from May 2017 as evidence during the trial. They were shared publicly in court documents Friday, but haven't been presented to the jury.

Defense attorneys for Fields tried to stop the Instagram posts from being admitted into evidence, arguing they could unfairly prejudice the jury against Fields. But prosecutors said the posts were relevant and indicative of Fields' "intent, motive and state of mind," before he drove his car into counterprotesters on August 12, 2017...."

Heyer's color idicated to Barrell that Keyer was salvageable. He continued CPR whole observing injuries. She had no pluse snd could not hreathe on her own. She had a large bruise across her chest. Barrell said a bruise right after impact indicates a very serious injury.

Heyer's leg had a large laceration and a state trooper was applying a tourniquet. Heyer's color was fading. After they got Heyer in an ambulance, they began advanced care to her chest for decompression. Barrell said Heyer had almost no chance of survival outside of a hospital.
