Fauquier County Circuit Court Judge Jeanette Irby granted a second “not guilty by reason of insanity” evaluation Friday for a Fauquier County teen accused of fatally shooting his mother and younger brother on Valentine's Day 2020.
The request was granted over the commonwealth’s objection, according to deputy public defender Ryan Ruzic, who is representing Levi Norwood, 18. Another competency to stand trial evaluation was also ordered. The evaluations must be completed within 60 days. The court will review the findings in May.

The Friday, March 5, hearing was originally scheduled to set a trial date in the case, but Ruzic’s successful motion to assess Norwood's competency and sanity at the time of the offense has pushed that back.

Norwood underwent a similar evaluation in August 2020, and it was established that he was competent at that time. In the motion on Friday, Ruzic stated that the August evaluation also noted that Norwood “has significant mental health problems, and that when confronted with intense or emotionally activating information or decisions, it may be expected that his abilities will deteriorate significantly.”

The motion also states: “On Feb. 16, this court and counsel received notification that Mr. Norwood was removed from the Fauquier Adult Detention Center through a temporary detention order and was subsequently committed to the Western State Hospital. … After receiving treatment there, Mr. Norwood has been returned to the Fauquier Adult Detention Center.”

The Western State Hospital is a state psychiatric facility that treats people with “serious mental or substance abuse disorders,” according to its website.
Ruzic stated he has met with Norwood twice since his return, according to the motion, and has noted that “there is a noticeable withdrawal from the defendant in his participation with defense counsel.”

Norwood is accused of killing his mother, Jennifer Norwood, 34, and his 6-year-old brother, Wyatt, in their Midland home on Valentine’s Day, Feb. 14, 2020. He was indicted as an adult in July 2020 on two counts of first-degree murder, three counts of using a firearm in the commission of a felony and one count of grand theft of an automobile.

Norwood, who was 17 at the time of his arrest, was being held at the Loudoun County Juvenile Detention Center but was transferred to the Fauquier County Adult Detention Facility when he turned 18 on Jan. 11.

Plea delayed in Norwood murder case

A status hearing is now scheduled for Dec. 9, but it is unclear when Norwood will be released from the mental health facility. “I’ve been unsuccessful in getting a timeline from Western State,” Ruzic told the judge. “My past experience is that it will probably be about 30 days.”

Levi Norwood has pleaded guilty in Fauquier County Circuit Court to shooting and killing his mother and 6-year-old brother in the February 2020, in the family’s Virginia home.

Norwood pleaded guilty to first-degree murder in the death of his mother, Jennifer, and a reduced charge of second-degree murder in the death of his brother, Wyatt.

Other charges in the case, involving the wounding of his father, were dropped.

The now-19-year-old Norwood spoke in a barely audible voice in answering the judge’s questions about his understanding of the plea arrangement reached by Commonwealth’s Attorney Scott Hook and public defender Ryan Ruzic.

Judge James Fisher ordered a presentence investigation, and set a status hearing for Nov. 3.

“It will not be a short sentencing,” Ruzic told the judge.

Since the Feb. 14, 2020 crime, Norwood has undergone two psychiatric evaluation. Ruzic hasn’t revealed the findings.

While his attorney earlier was considering a plea of not guilty by reason of insanity, Norwood had repeatedly been found competent to stand trial.

As WTOP reported in July 2020, charging documents said that on the day of the shootings, Norwood told his girlfriend at school “that he wanted to kill his mother.” The girlfriend also said Norwood was depressed and anxious, and said he told her he was schizophrenic and would see “shadow people.”

Ruzic never filed a motion alerting prosecutors of using an insanity defense prior to the plea, suggesting the psychiatric evaluations determined Norwood was not insane at the time of the offenses.

Another teenage boy to add to the long list of mostly boys that murder their families, their are cases where girls have done so but they are far less likely to do so than boys, seems this boys father has since committed suicide post the murders,

it is just so sad that this is the only answer they feel they have left to deal with any problems they are having within their family dynamic,

In the article you posted, a family member alludes to their home life and I suspect that will come out in the sentencing hearing.

All above articles mention Levi was troubled, suicidal, depressed. My first question, is how did he get a gun? Is it normal practice to just have guns laying around your mentally disturbed teen?

In August, Norwood pleaded guilty to first-degree murder in the death of his mother, Jennifer, and a reduced charge of second-degree murder in the death of his brother, Wyatt.

Under Virginia law, Norwood, who was 17 at the time of the crimes, will be eligible for parole after 20 years, under Virginia’s recent law prohibiting life in prison with no chance of parole for juveniles.

During sentencing, prosecutors played a 70-minute clip recorded in a holding cell, after Norwood had been arrested by police in Durham, North Carolina. Sitting by himself, Norwood held a quiet monologue, on a variety of topics — often speaking about his girlfriend.

Norwood’s public defender, Ryan Ruzic, told Circuit Court Judge James Fisher that his client had been physically abused by his father, who was also shot and wounded by Norwood.

Ruzic said Norwood’s father told him “he’d kill him if he ever dated a Black girl.” Norwood was dating a Black teen at the time of the shooting.

Fauquier County Commonwealth’s Attorney Scott Hook told Fisher, “This is about a girl,” and that Norwood was angry that his father was trying to prevent him from dating his girlfriend.

”Mom and dad wanted to remove [the girlfriend], so they had to go,” said Hook, repeating what Norwood said on hard-to-hear video. “I killed my brother and mother to punish my dad.”

Hook told Fisher that claims Norwood’s father, Joshua, was abusive and racist only surfaced after Norwood was arrested.

In his closing statements, Hook read Norwood’s 17th birthday card, in which both parents expressed pride and love for their son.

Joshua Norwood was found dead in the family's home in April 2020, an apparent suicide.

When asked if he wanted to say anything before sentencing, Levi Norwood declined.

Fisher sentenced Norwood above the sentencing guideline recommendation of 32 years: “I believe Mr. Norwood is a danger to himself, others, and society, and that would continue.”

As he was led away by sheriff’s deputies, Norwood’s grandmother called “I love you, Levi,” as the courtroom door closed behind him.
