BBM- I'm sure I read that the septic tank area was searched a second time, but haven't yet found a credible link to that info. If anyone finds that, please link? TIA.

This states the yard was searched many times.

This one says they had previously looked at septic

Both of these are posted in the media thread, too.

NG talking about Noah now

  • #326
So, Nancy Grace's "Shocking Developments" are a recap of septic info that was put out by other MSM sources a week ago?

Edited to add: If you missed the NG segment tonight, you did not miss much. And some of us had to sit through a seriously oogey segment that preceded it.

Mark Klass says no way anyone other than parent involved.

  • #328
Marc Klass saying absurd that he got in tgere by himself. Doctor said autopsy will show if he was alive when he went in and will show bruises. Lid could be defective. Taking about baby was taken right away.

  • #329
And that's all on poor Noah. :(

  • #330
Big disappointment IMO,from NG.

I don't know the family dynamics. But there is a reason and we don't know YET, why the infant was removed from the home, the day after Noah was reported missing. I haven't read where anyone has stated that CPS has been involved with the family prior. Small community someone would surly be talking about stuff like that... Whatever that reason for removing the infant, evidently has some bearing on care of both children.

^^ Per this link http://www.scb.virginia.gov/scbvcc/VCC12.HTML we get Explanation of description, the VCC Code (FAM3806F4 & FAM3808F6) , the Statute and sentence.

FAM3808F6 / FAM3806F4 The "F" prior to the 4 and 6 on these charges stands for FELONY (may sound like a given, but there are actually an A and a C that could be there) http://www.vcsc.virginia.gov/VCCs/2012/2012VCC_Book.pdf

Per this link https://leg1.state.va.us/cgi-bin/legp504.exe?000+cod+18.2-371.1 we get the explanation of the Statute for that VCC Code

Which for both Paul and Ashley's charges its same statute, diff subsections is : § 18.2-371.1. Abuse and neglect of children; penalty; abandoned infant. *the abandoned infant, the way I am reading is if you leave the infant at a hospital or rescue facility, and not pertinent to these children, as far a I can tell

the class 4 and 6 Felony, pertains to the sentence guidelines

What do the grade A and F mean? Paul's first charge has Letter F, and other is an A. Ashley has A for both her charges.

§ 18.2-371.1. Abuse and neglect of children; penalty; abandoned infant.

A. Any parent, guardian, or other person responsible for the care of a child under the age of 18 who by willful act or omission or refusal to provide any necessary care for the child's health causes or permits serious injury to the life or health of such child shall be guilty of a Class 4 felony. For purposes of this subsection, "serious injury" shall include but not be limited to (i) disfigurement, (ii) a fracture, (iii) a severe burn or laceration, (iv) mutilation, (v) maiming, (vi) forced ingestion of dangerous substances, or (vii) life-threatening internal injuries.

B. 1. Any parent, guardian, or other person responsible for the care of a child under the age of 18 whose willful act or omission in the care of such child was so gross, wanton and culpable as to show a reckless disregard for human life shall be guilty of a Class 6 felony.

Ok, I understand that Ashley has one count of each. Paul has 2 counts of B... wasn't exactly sure what wanton meant but my friend Google, led me in the right direction.

Wanton
Grossly careless or negligent; reckless; malicious.
The term wanton implies a reckless disregard for the consequences of one's behavior. A wanton act is one done in heedless disregard for the life, limbs, health, safety, reputation, or property rights of another individual. Such an act is more than Negligence or gross negligence; it is equivalent in its results to an act of willful misconduct. A wanton injury is one precipitated by a conscious and intentional wrongful act or by an omission of a known obligation with reckless indifference to potential harmful consequences. http://legal-dictionary.thefreedictionary.com/wanton

Yeah, I liked her years ago when she seemed like such an advocate for victims and got stories out that no one else did. This was truly a sensationalized headline met with nothing but recap.

Jmo, you will never get anything from NG that we have not hashed over for days.

Thanks for taking one for the team! I've never been so happy to not be a coffee drinker though.

I agree. And yet when I know she has a BOMBSHELL on a case I am following, and although I KNOW my info is more up-to-date than hers, I still watch.

Dunno why, exactly.

IMHO I think Ashley and Paul left the children home alone at the time Paul was taken to work on Sunday, and possibly have admitted to doing so. I think that is the wanton disregard charge. Again just my humble opinion.

This is throwing back to something that was discussed early today or yesterday. I can't find the post so I am wondering if it was snipped.

Someone mentioned AW's Aunt stating that AW contacted her asking of Noah was with her. I recall it from FB but it was also reported here...
http://www.roanoke.com/news/crime/p...cle_317ae1ed-ccc2-52cc-bb94-0ebfb2e94095.html
I don't have the quote handy but my memory is that it was PT's sister, Stephanie that said she got the call. So Noah's aunt, not Ashley's.
