They can't be legitimately basing denial of bond pending toxicology and final autopsy. They have to base it on the current charges and current circumstances. Not to say that they aren't going expecting g more to come, but what happens in court now has to be based on what they know now.

Going off of this then, would it be safe to assume that the initial autopsy report did not reveal that Noah's death was an accidental drowning and that he was dead before ending up in the septic? Or would they be holding them without bond just to protect them from the public? That kind of seems unlikely, if it was deemed accidental. Thinking too much, maybe.

ANonyMs probably could answer this definitively, but I do not think it is likely they would hold them against their will, solely to protect them. Seems like there must be more. [emoji4]

I agree. I feel like LE knows so much more than we're aware of, which is as it should be. It's just so hard on inquisitive minds to wait. It's kind of like an unfinished jigsaw puzzle and we'll be waiting, one piece at a time.

I believe they are only denying bail because she is a flight risk.

I have seen many cases where a defendant is held on no bail or high cash bail during an ongoing investigation when futher charges may be expected.

Nathaniel Kibby - initially kidnapping, $1 million cash bail, charges later increased to 205 indictments.

Enrique Arochi - aggravated kidnapping. $1 million bail. Victim has not been found yet.
http://www.websleuths.com/forums/sh...Marie-Morris-23-Plano-30-Aug-2014-39-*Arrest*

William Snyder - Abuse of corpse and tampering with evidence, $1 million bail, flight risk. According to his hearing additional charges forthcoming. Cause and manner of death not released yet. awaiting tox results.

Absolutely! The judge mentioned at her second bond hearing that she was a flight risk, so that factors in, but if we are basing our guesses off of what the Judge said, he also said it was "unthinkable" that she should be around ANY child at this point.

So, I don't believe that she is only being held because she is a flight risk. I think it will become very clear when the COD is released.

If this was accidental, why would she be a flight risk? Just to escape facing the townspeople and public? The judge in the first hearing felt that she shouldn't be living in the home with a child (eleven years old) and the grandfather would be living there too. Why would the judge feel that way?

When was it determined to be accidental?

Thanks for those links Steleheart!

This seems where we are in Noah's case. The sheriff (Pulaski Co) has said that more charges may be added or the current ones revised as more results come in.

Very true and the current circumstances are that Noah is deceased and the cause and manner of death are not known to the court yet as the investigation is ongoing. So current charges PLUS ongoing investigation.

It wasn't determined accidental. That was part of my question. Maybe I wasn't clear on that.

Whoa whoa whoa. Let me explain here. I think they are only "allowed" to deny bail because she is a flight risk. I do not know that the other charges are enough for them to keep her. Similar to when someone is held for questioning and they arrest them on a less severe charge to buy time for bigger charges to come.

Do ya dig?

I did it. I wrote "do ya dig" then didn't erase it. I am such a dork.

If that qualifies you as a dork, I must be one too! Lol. I dig!

I also find it telling that they are considering her a flight risk...and the "unthinkable" scenerio of having her around a child right now. These two things make me fairly certain that the court knows something intentional happened.
I can't see a judge seeing her around a child with additional adult supervision "unthinkable" if the neglect charges were due to a long nap...

This is just my opinion, of course, but I believe the nap was "The Nap That Never Happened".
