I had thought the same Nurse. Until yesterday. Now seeing what Derstine what able to keep out of the Courtroom I think he got an incredible Defense.

Gerry Spence successfully defended Randy Weaver in the Ruby Ridge Case and did so by not even calling a single witness and shooting holes in the prosecutions case... Hopefully DD wasnt as convincing as Gerry, but the cases were also totally different and one is an example of a person getting railroaded by the govt and the other is one of sick and twisted individuals.
 
I'm pretty sure that Heeny designated the computers as a place not a thing, and that is why he said LE needed a separate warrant. I know it was in the Globe article from yesterday. I will look again.

Except he was applying a precedent that had been established after Rafferty's arrest, so IMO, his decision is faulty.

How many times did they retry Guy Paul Morin and he was innocent. I think there are grounds for an appeal but the real fear here is that they come back with a lesser charge IMO.

what about in the eyes of the jury.. they saw him only call one witness (and a shakey one at that imhoo) and than give a crazy hypothetical in his closing argument.

(I totally agree what he got kicked out was a feat and aided his defense but what the jury sees is what is in the courtroom)
 
Hey Mike, great idea posting link to the decision trees...it is absolutely critical for the jury to help them reach a verdict objectively under the law with the evidence they were presented with. Remember...they are all just like us as "laypersons" in terms of the legal system. gives all of us an idea of what kind of discussions they will be having following the charts. thanks for your great coverage.

yeah I can't right now! Still reeling from reading all the #Rafferty evidence that was left out!

#rafferty should have everything done to him that he has done himself. #guilty
 
Was the BB on his person when he was arrested, or was it in his car?

Perhaps he voluntarilly turned over his phone? If he thought it was "clean"

If it was on his person they would have needed a separate warrant to search that.
