Why would you change your clothes that late at night? Important meeting next morning, oh yeah, he was late for that meeting, 30 minutes? Impressive and very interesting, don't you think.

I think it's obvious that Jason changed his clothes so he could smoke a cigar in super windy conditions. He didn't want to get smoke all over the clothes he'd spent hours sweating in on the drive up. Better to put on clean clothes.

Had JY been seen on video wearing bunny slippers and some cozy flannel PJs, along with maybe a Hefner-wannabe smoking jacket & ascot, he sure would have painted a better picture as a late night cigar smoking bon vivant just heading out for 30 min or so to enjoy a lovely cuban on a chilly evening. A snifter of brandy would have completed the picture to perfection.

I have always wondered why one would change clothes after checking into a hotel late in the evening before running back down to the desk to get a day old newspaper , um going to smoke a cigar...um...or other things

I think fran was right with her guess that he was checking out whether there was any alert on the propped door when he was caught in that missing shirt. That's one of the teeny tiny details that he screwed up on - he should've changed his shirt in the car on the way home.

Based on the state's evidence 2nd degree by definition is not a valid choice for the jury.

Take the variation in sentencing b/w 1st, 2nd and NG, it falls as a compromise.

The jury is more likely to forget, or even happily disregard, the strict definition of 2nd when such a nice tidy compromise is in clear sight.

I think the Judge allowing 2nd indicates to the PT this is the last try. If hung JY walks forever.

Since there's no statute of limitations for murder, it would not necessarily be "walks forever." If new evidence came forward they could use it in a new trial. But I agree the state won't pay for another trial if they have only this same evidence, unless there is a major change in the DA team.

Lawyers pls correct me if I am wrong.

The only reason he may get away with this crime is that he instantly invoked his constitutional rights to be silent. I'm not loving the constitution so much lately.

IIRC JY wasn't sure what happened to the hush puppies, but he thought MY donated them. I don't think Klink would have said that if JY had said he was certain that the shoes had been donated.

I think the point was supposed to be that the shoes are a mystery, they could have been there or not, it's just not certain that the print at the crime scene came from JY's foot steps.

I think 2nd degree would be a wrong choice and I don't know why it's an option here since the murder was intentional, was premeditated, and with malice.

Regardless of whoever you believe murdered MY, they certainly intended to do so and knew their actions would kill and continued to do it anyway.

To me it's either 1st or nothing.

I agree, Madeleine. But, jurors may opt for that choice as a middle ground. I think it is there (MOO) to assist in getting some conviction.

I thought I was told that. I had the good fortune to sit next to a NC sc judge at a business dinner last night. It was an interesting conversation and now I wish I had't had those two cocktails before dinner. HC's short term memory loss is affecting me.:innocent: He told me about a case he presided over when a grandmother was bound with duct tape and stabbed 20 times. Her 3 yr old grandson was unharmed.

Hampton Inn surveillance photos... not a bunny slipper or smoking jacket to be found; only one murder suspect in entirely different clothes within an hour of arriving at the hotel.

I stand by my earlier theory that the missing clothes and shoes simply blew off while said suspect was outside enjoying a stinky cigar in 20+mph winds while reading day old sports scores.

If they vote 2nd degree, they still must believe JLY was there and killed his wife.
I can't see how this would be a 'compromise'?

Personally, I don't think they will even consider 2nd degree at all.

Just wanted to say how much I have enjoyed spending my time with you guys here during this trial....even the NG folks as you help balance my thoughts with your insights. My heart is now with M and L F. and regardless of the verdict, I hope they can get on with their lives with dignity. I am certain they will continue to shower CY with love and affection and will do everything possible to compensate for the loss of her beautiful mother.
JY is a vile and nasty man, guilty or not, and I hope if he is found not guilty he will leave this area and we will never hear his name again in any capacity.
Again, I love you guys and am looking forward to moving on to the next trial with you!

Yeah when I get to the beach I usually throw on my swimsuit, coverup & sandals and head down to the beach to soak up the sun and drink an adult beverage...

But when I arrive at a hotel at almost 11 p.m. in the evening after a relatively short drive and have to be up in the morning for a first time appointment with a new client that you shouldn't be late for, I don't go to my room and change into an outfit remarkably similar to the one I just had on and then go outside in inclement weather to stink up fresh clothes while smoking a cigar. MOO!

Speaking of being late to first time appointments... his googlemap or yahoo map or whatever was found in his car. He had the directions to the hotel clearly printed for him... how was he possibly 35 minutes late due to being "lost"?!

If he is found not guilty in this trial, he cannot ever been tried again....double jeopardy applies. He can get on tv or write a book and tell exactly how he committed the murder and they can't touch him.
