Yes the Crown can appeal a verdict here. It's actually one of the things I question about our system. The state has a lot of power and, when they want to, effectively unlimited resources. Perhaps we should be expecting the system to get it right the first time rather than retrying verdicts they don't like. IIRC an appeal is how Guy Morin got wrongfully convicted.

The Crown can't appeal just because they don't like a verdict. The CCC sets out the conditions under which the Crown CAN appeal:

Right of Attorney General to appeal

676 (1) The Attorney General or counsel instructed by him for the purpose may appeal to the court of appeal

(a) against a judgment or verdict of acquittal or a verdict of not criminally responsible on account of mental disorder of a trial court in proceedings by indictment on any ground of appeal that involves a question of law alone;


(b) against an order of a superior court of criminal jurisdiction that quashes an indictment or in any manner refuses or fails to exercise jurisdiction on an indictment;


(c) against an order of a trial court that stays proceedings on an indictment or quashes an indictment; or


(d) with leave of the court of appeal or a judge thereof, against the sentence passed by a trial court in proceedings by indictment, unless that sentence is one fixed by law.

I'll have to rewatch LH's report but I think she said he's being better searched now... so I'm not sure if the implication is he was getting it while out for court.

Thanks, jash! I'd hope DM is thoroughly searched when entering / leaving the courtroom. The way DM glares at MS during the trial, if DM had a knife on him he could try to knife MS. I hope there is good security around them both when the verdicts are read!

OMG -- LH just reported live on CHCH. Just last week, DM was found with a knife and weed in his cell. And previously, he had hidden a shiv in his cell wall (found when guards did a search with metal detectors).

Are we really surprised? Throughout this entire trial he's given off this smug, entitled, untouchable air, with zero regard for consequences that he has likely had for a very long time.

yup handed a private note and left. I wonder if they have to get a replacement when that happens because this will be the third one that has left now.

Please check your facts before posting stuff like this. No jurors quit or were dismissed today.

I feel some sorrow for the man. I think he probably never really had a chance to live a free life for the whole of his life and that his perceptions are distorted by a personality disorder, or some kind of brain damage. The bad just feels baked into him in a way even he can't be in touch with.

So, court outbursts , smuggled paraphernalia, and most of what the jury didn't hear is about DM. What about MS? I don't believe he is a model inmate but besides a LH calling him cunning and creepy, his family has been there to support him and we haven't heard of any antics really. Is it only I contrast to DMs emerging eccentricities that makes MS look "good"?

Nothing, I don't think. There but for the grace of God and all that. Do you want to be Dellen Millard? If you had been born with his genetic makeup, and had his identical set of experiences, do you imagine you would be somebody other than he? I have enough humility and insight to know that I didn't deal the hand I drew in life. In that, I can feel empathy for others who were set on a very different path than I get to walk.

MS appears to be a normal human being in a way DM does not. Normal doesn't mean not criminal, mind you. Still, he seems to me to be a much better candidate for rehabilitation in time.

Still, one of the reporters said MS was creepy--his eyes were hollow--even now 3 yrs later.

I too always feel sad for those with mental in capabilities. There are some in my extended family. So dreadful.

And his teachers said he was a good student who was a pleasure to work with. We all bring a certain bias to our assessments. Teachers, posters, reporters, Alex Pierson..
